Chapter 5. Detection of corruption offenses, curbing them, and inevitability of liability

Article 25. Measures to ensure timely detection of corruption offenses and curbing them, and the principle of inevitability of liability for committing corruption offenses [OKAZ: 1. 16.00.00.00 Security and Law Enforcement / 16.04.00.00 Public Security / 16.04.12.00 Anti-Corruption]

Measures to ensure timely detection of corruption offenses and curbing them, and the principle of inevitability of liability for committing corruption offenses include:

  • organizing the effective work of state bodies directly implementing anti-corruption activities based on systematic analysis of the corruption situation and trends, preventing corruption-related offenses in their activities;
  • using modern forms and methods of combating corruption offenses, increasing the level of technical support of law enforcement agencies, and introducing modern information and communication technologies into their work;
  • ensuring the independence and freedom of courts, and the openness of their activities;
  • ensuring coordination and cooperation between state bodies directly implementing anti-corruption activities;
  • ensuring the full, impartial, and timely consideration of appeals by individuals and legal entities regarding facts of corruption offenses;
  • ensuring the protection of persons providing information about corruption offenses;
  • creating effective criminal-legal and criminal-procedural mechanisms for combating corruption.

Article 26. Obligation of state body employees to report facts of corruption offenses [OKAZ: 1. 16.00.00.00 Security and Law Enforcement / 16.04.00.00 Public Security / 16.04.12.00 Anti-Corruption]

Employees of state bodies must inform their supervisor or law enforcement agencies about all cases where a person has appealed to them with the aim of inducing them to commit a corruption offense, as well as about any facts of similar offenses committed by other employees of state bodies that have become known to them.

Failure to fulfill the obligation provided for in the first paragraph of this Article by employees of state bodies entails liability in accordance with the legislation. Committing a corruption offense entails liability in accordance with the legislation. (Paragraph 1 of Article 27 in the edition of the Law of the Republic of Uzbekistan No. URQ-683 dated April 21, 2021 — National Database of Legislation, 21.04.2021, No. 03/21/683/0375)

Persons who have committed a corruption offense may be deprived by court decision of certain rights, including the right to hold certain positions, in accordance with the law. [OKAZ: 1. 03.00.00.00 Civil Legislation / 03.03.00.00 Legal Entities / 03.03.01.00 General Rules]

Legal entities are liable for committing corruption offenses in the manner established by law.

Agreements concluded as a result of a corruption offense may be recognized as invalid by the court upon the application of the competent state body or interested person, in the manner established by law. Article 27-1. Electronic Register of Persons Found Guilty of Committing Corruption Crimes Persons found guilty of committing corruption crimes are included in the Electronic Register of Persons Found Guilty of Committing Corruption Crimes (hereinafter referred to as the Electronic Register).

The Ministry of Internal Affairs of the Republic of Uzbekistan enters information about the person into the Electronic Register within three working days from the moment the accusatory judgment (ruling) against persons found guilty of committing corruption crimes enters into legal force.

Information about persons found guilty of committing corruption crimes in the Electronic Register is stored for the period of conviction established by the Criminal Code of the Republic of Uzbekistan.

The following restrictions are established for persons entered in the Electronic Register:

  • access to state service and awarding of state awards;
  • nomination for elected and specially appointed positions;
  • membership in public councils under state bodies and interdepartmental collegiate bodies;
  • participation as a participant (executor) in state procurement and agreements on public-private partnership by business entities founded by them and (or) in which they own more than 50 percent of the share in the authorized fund (capital);
  • holding management positions in organizations with a state share of more than 50 percent and in state educational institutions.

The Electronic Register is maintained by the Anti-Corruption Agency of the Republic of Uzbekistan in cooperation with the Ministry of Internal Affairs of the Republic of Uzbekistan.

The procedure for obtaining information from the Electronic Register, the grounds and procedure for removing persons found guilty of committing corruption crimes from the Electronic Register, as well as the cooperation of state bodies in maintaining the Electronic Register, are implemented in the manner established by legislation. Persons reporting information about corruption offenses and their close relatives are under state protection. [OKAZ: 1. 12.00.00.00 Information and Informatization / 12.03.00.00 Information Resources. Information about persons reporting information about corruption offenses constitutes a service secret and is disclosed only in cases provided for by law and on the basis of written consent of the person themselves, as well as the head of the body implementing anti-corruption activities. If there are sufficient grounds confirming a real threat to the life and health of persons reporting information about corruption offenses and their close relatives, the use of violence against them, or the destruction or damage to their property, bodies implementing anti-corruption activities must take necessary measures to protect them in accordance with the Law of the Republic of Uzbekistan "On Protection of Victims, Witnesses and Other Participants in Criminal Proceedings". Infringement on the rights and lawful interests of persons reporting information about corruption offenses and their close relatives due to their reporting of information about corruption offenses, as well as violations of their labor rights by the employer, are not permitted and entail liability in accordance with the law.

It is not permitted to apply disciplinary sanctions to a person who has reasonably reported a corruption crime in the state body where they work, without prior notification to the Anti-Corruption Agency of the Republic of Uzbekistan, for a period of two years.

The encouragement of persons reporting information about corruption offenses is guaranteed by the state.

Encouragement may be carried out in the form of a one-time monetary award, a letter of appreciation, a souvenir gift, or other forms not prohibited by legislation. Encouragement of persons reporting information about corruption offenses is implemented in the manner established by the Cabinet of Ministers of the Republic of Uzbekistan.

The rules of this Article are not applied to persons who knowingly reported false information about corruption offenses; they are liable for such offenses in accordance with the law. Article 28-1. Security Guarantees for Employees of Compliance and Anti-Corruption Internal Control Structures of State Bodies and Organizations

Employees of compliance and anti-corruption internal control structures of state bodies and organizations are under state protection.

Access to the residential premises or office of employees of compliance and anti-corruption internal control structures of state bodies and organizations, inspection of their vehicles, conducting searches in them or seizing items from them, listening to their telephone conversations, inspecting and personally searching employees, as well as inspecting, seizing, or taking their correspondence, items belonging to them, and documents may be carried out only with the written permission of the Prosecutor General of the Republic of Uzbekistan, in the established manner.

Questioning as a witness or suspect, applying preventive measures in the form of detention, and holding employees of compliance and anti-corruption internal control structures of state bodies and organizations, including former employees within two years after the termination of the employment contract or dismissal, is permitted only with prior notification to the Prosecutor General of the Republic of Uzbekistan, in the established manner.

A criminal case against employees of compliance and anti-corruption internal control structures of state bodies and organizations may be initiated only by the Prosecutor General of the Republic of Uzbekistan.

Employees of compliance and anti-corruption internal control structures of state bodies and organizations are legally and socially protected in the manner established by legislation. Article 29. Cancellation or amendment of decisions adopted as a result of corruption offenses [OKAZ: 1. 16.00.00.00 Security and Law Enforcement / 16.04.00.00 Public Security / 16.04.12.00 Anti-Corruption]

Decisions adopted as a result of corruption offenses may be canceled or amended by the competent state body, other organization, or official upon the application of the interested person, or recognized as invalid by the court.

If a decision adopted as a result of the commission of corruption offenses is canceled, amended, or recognized as invalid, the damage caused to individuals and legal entities as a result of its adoption must be compensated in the manner established by legislation.
