Chapter 1. General Provisions

This Regulation establishes the procedure for allocating and repaying education credits (hereinafter referred to as "education credits") from the funds of the Education Credit Financing Fund under the Ministry of Economy and Finance of the Republic of Uzbekistan (hereinafter referred to as the "Fund") to citizens of the Republic of Uzbekistan for tuition-based study in the full-time form of bachelor's and master's programs at all higher, secondary special, and professional education institutions (hereinafter referred to as "educational institutions") operating in the Republic of Uzbekistan, with a study period of one year or more (state, non-state higher, secondary special, and professional education institutions, foreign higher, secondary special, and professional education institutions operating in the territory of the Republic of Uzbekistan and their branches) and joint educational programs. The rules of this Regulation:

are not applied to foreign citizens and stateless persons;

are not applied to education credits provided by commercial banks from sources other than the Fund's funds.

  1. The provision of education credits is carried out by commercial banks in accordance with established requirements based on the conditions of their repayment, profitability, term, and targeted use. View previous edition.

Starting from the 2024/2025 academic year, for students of the second and higher levels, the education credit is allocated in an amount of up to 80 percent of the contract payment sum if the average indicator of subject mastery (grade point average) is below "3", provided that the credit is allocated after the student pays the initial 20 percent of the contract payment sum; View previous edition.

in an amount equal to the education credit contract payment sum if the average indicator of subject mastery (grade point average) is "3" and above, and (or) for members of families registered in the Social Registry who are receiving education.   1. The average indicator of subject mastery (grade point average) of the student who intends to receive an education credit for the current academic year is obtained from the "Management of Higher Education Processes" (HEMIS) information system based on the results of the previous academic year.

  2. The average indicator of subject mastery (grade point average) of the student and relevant information are automatically formed through the "Management of Higher Education Processes" (HEMIS) information system, and information on contract payments is formed through the "Accounting for Services Provided to Students on a Contract Basis" (kontrakt.edu.uz) information system.

In this regard, information on contract payments for students of non-state and foreign higher education institutions is formed by integrating their information systems with the "Accounting for Services Provided to Students on a Contract Basis" (kontrakt.edu.uz) information system or by using this information system. Starting from the 2024/2025 academic year, an interest-free education credit is allocated for the next academic year if the average indicator of subject mastery (GPA (grade point average)) for children of families registered in the Social Registry studying at higher education institutions is "3.5" and above.

In this regard, children of families registered in the Social Registry studying at higher education institutions are identified through the "Social Registry" information module of the National Agency for Social Protection under the President of the Republic of Uzbekistan, and this information module is mutually integrated with the "Management of Higher Education Processes" (HEMIS) information system of the Ministry of Higher Education, Science and Innovation.   1. Education credits are provided by commercial banks to students (hereinafter referred to as "borrowers") who are citizens of the Republic of Uzbekistan recommended or admitted to study in the full-time form of bachelor's and master's programs at tuition-based study at educational institutions, as well as those who have transferred their studies. In this regard, family members of the borrower with a permanent source of income (parents, brothers, sisters, husband or wife) or other third parties may participate in the education credit contract as co-borrowers. View previous edition.

It is not permitted to allocate education credits for the payment of tiered contract payments and one-time other payments equal to the minimum amount of the tiered contract payment, as well as for the payment of contract payments for applicants and students admitted to study at state higher education institutions for master's programs based on additional admission parameters.   1. The main debt of the education credit is repaid over a period of 7 years starting from the seventh month after the official study period of the student ends. View previous edition.

In this regard, the calculation and payment of interest on education credits are carried out starting from the date funds are transferred to the educational institution, and the repayment of the main debt is carried out starting from the seventh month after the official specified period of study of this type at the educational institution by the borrower is completed. Interest payments on education credits allocated to students admitted based on additional admission parameters specified in subparagraph "a" of paragraph 10 of the Decree of the President of the Republic of Uzbekistan dated August 31, 2022, No. PF-213 "On Additional Measures to Increase the Well-being of the Population through Rapid Development of Entrepreneurship, Innovative Technologies, and Infrastructure in the Republic of Karakalpakstan" are covered from the Fund. Chapter 2. Compliance Criteria for Commercial Banks and Procedure for Allocating Funds to Them

  1. The following compliance criteria are established for commercial banks regarding the allocation of funds for education credits by the Fund:

the presence of clearly defined internal regulations for the allocation of education credits by the commercial bank;

the commercial bank must have a long-term credit rating at a level not lower than "B" from "Fitch Ratings" or "Standard & Poorʼs" or "B2" from "Moodyʼs Investors Service";

the presence of a positive conclusion of an audit organization based on financial reports for the last three years. If the commercial bank has been operating for less than three years, a positive conclusion of the audit organization based on financial reports for the years of operation of the commercial bank must be present;

the bank's regulatory capital must not be less than 500 billion soums; View previous edition.

there must be no current measures and sanctions preventing the provision of education credits to it due to the violation of prudential norms established by the Central Bank. View previous edition.

The Ministry of Economy and Finance requests the commercial banks referred to in subparagraphs two through six of this paragraph to submit documents and information, and requests information from the Central Bank in the manner specified in subparagraph seven of this paragraph. The Ministry of Economy and Finance may request additional information about the financial condition of commercial banks from the Central Bank when assessing their compliance with the criteria specified in this paragraph.   1. Commercial banks submit documents and information confirming compliance with the criteria specified in paragraph 5 of this Regulation to the Fund.

The submitted documents and information are reviewed by the Fund for compliance with the criteria specified in paragraph 5 of this Regulation within five working days. View previous edition.

A Master Agreement (hereinafter referred to as the "Master Agreement") is concluded between the Ministry of Economy and Finance and commercial banks recognized as compliant with the established criteria regarding the allocation of funds for education credits. The funds allocated by the Fund within the framework of this Regulation must not exceed the bank's first-tier regulatory capital.

  1. If commercial banks are found not to comply with the criteria specified in paragraph 5 of this Regulation, they are notified in writing of the refusal to conclude a Master Agreement. View previous edition.

The Ministry of Economy and Finance regularly publishes on its official websites the list of commercial banks that have concluded a Master Agreement with the Ministry of Economy and Finance within the framework of this Regulation.   3. The Ministry of Economy and Finance places deposit funds with commercial banks for a period of no more than 15 years for the allocation of education credits.   4. Commercial banks form a registry of borrowers wishing to receive an education credit (hereinafter referred to as the "Registry"):

based on applications received from borrowers for credit by September 1 each year for 25 percent of the contract payment amount;

based on the calculation of the needs of borrowers who have concluded education credit contracts during the academic year and new applications received for credit by December 15, March 15, and June 15 each year, respectively, for 50, 75, and 100 percent of the contract payment amount.

  1. Commercial banks submit an order to the Fund for the purpose of obtaining funds for education credits based on the registries formed for each quarter by September 5, December 20, March 20, and June 20.

Commercial banks may submit one or more orders to the Fund based on the Registry formed by the deadlines specified in the first subparagraph of this paragraph. View previous edition.

To ensure the timely satisfaction of citizens' demand for education credits, education credits allocated by commercial banks from their own funds under the conditions specified in this Regulation may be refinanced from the funds allocated by the Ministry of Economy and Finance.   1. Commercial banks continue to form the Registry based on applications submitted after the deadlines specified in paragraph 10 of this Regulation due to changes in admission parameters of educational institutions by the State Commission on Admission to Educational Institutions of the Republic of Uzbekistan (hereinafter referred to as the "State Commission") and other reasons, and send an order to the Fund on the 15th and last day of each month.   2. Educational institutions notify commercial banks within five working days starting from the day the contract payment amount changes if the contract payment amount changes during the academic year.   3. The Fund signs a deposit contract with commercial banks and the Ministry of Economy and Finance for the allocation of funds for education credits and transfers these funds to the respective accounts of commercial banks within five working days from the date the orders are received.   4. According to the Master Agreement, the Fund places funds with commercial banks at a rate four percentage points lower than the main rate of the Central Bank. View previous edition.

In this regard, if the main rate of the Central Bank is reduced, the relevant amendments are made to the deposit contract concluded between the Ministry of Economy and Finance and commercial banks for the allocation of funds for education credits to reduce the interest rate by the corresponding percentage points for the relevant period. If the main rate of the Central Bank is increased, the interest rate for the allocation of funds for education credits remains unchanged. View previous edition.

  1. The repayment of funds placed with commercial banks by the Ministry of Economy and Finance for education credits and the payment of interest on them are carried out in the manner and deadlines specified in the deposit contract concluded between commercial banks and the Ministry of Economy and Finance. For the purpose of mutual distribution of credit risks that may arise on education credits, a collateral contract (hereinafter referred to as the "collateral contract") is concluded between the commercial bank and the Ministry of Economy and Finance regarding the placement of 50 percent of the funds placed with commercial banks by the Ministry of Economy and Finance according to the Master Agreement as a collateral deposit from the Fund's funds.   3. To apply for a contract payment:

students of higher education institutions submit an application through the "Accounting for Services Provided to Students on a Contract Basis" (kontrakt.edu.uz) information system;

students of professional education institutions submit an application through the "Management of Professional Education Processes" (prof.edu.uz) information system.

  1. The application is reviewed by the higher education institution through the "Accounting for Services Provided to Students on a Contract Basis" (kontrakt.edu.uz) information system, and by the professional education institution through the "Management of Professional Education Processes" (prof.edu.uz) information system.

If the borrower is recognized as compliant with the relevant internal regulations or rules of the higher education institution on admission to study or continuation of study (hereinafter referred to as "internal regulations and rules"):

the borrower recommended for the first level is registered in the "Management of Higher Education Processes" (HEMIS) information system and concludes a contract payment contract in the established manner;

a contract payment contract is concluded with the student of the second and higher levels in the established manner.

If the borrower is recognized as non-compliant with the internal regulations or rules, they are notified in the established manner with justified reasons for the refusal to submit a contract payment contract.

If the borrower is recognized as compliant with the internal regulations or rules of the professional education institution:

the borrower recommended for the first level is registered in the "Management of Professional Education Processes" (prof.edu.uz) information system and concludes a contract payment contract in the established manner;

a contract payment contract is concluded with the student of the second and higher levels in the established manner.

If the borrower is found to be in violation of internal rules or regulations, they are notified in the established manner with justified reasons for the refusal to submit the tuition contract.

17.3. The borrower applies to commercial banks announced on the official website of the Ministry of Economy and Finance in the established manner for obtaining an education credit through the "Unified Interactive State Services" (my.gov.uz) portal, the "Education Credit" (taʼlim-krediti.mf.uz) information system, or directly.

17.4. When the borrower applies directly to a commercial bank for obtaining an education credit, the commercial bank forms the application for obtaining an education credit through the personal cabinet in the "Education Credit" (taʼlim-krediti.mf.uz) information system opened for them.

In this case, the commercial bank obtains the borrower's consent to process personal data based on its internal rules and indicates the obtained consent in the "Education Credit" (taʼlim-krediti.mf.uz) information system. Chapter 3. Procedure for Formalizing and Disbursing Education Credits

a) application for obtaining an education credit; See previous edition.

b) the contract (agreement) formalized in the established manner regarding study on a tuition basis between the student and the educational organization, and the attached invoice/facture (if available). c) document on the security of the repayment of the education credit in accordance with the bank's credit policy and internal rules. e) other documents established in the bank's internal documents (policy), including information and documents related to the borrower.

  1. The borrower (joint borrower) personally presents a document confirming their identity, including a citizen's passport or the person's identification ID card, at the same time as submitting the above documents to the bank. The bank has the right to obtain necessary copies and duplicates from the submitted documents.

  2. Commercial banks must review the application submitted by the borrower to the bank for granting an education credit and all attached documents within five working days and either sign the education credit contract or, in case a decision is made to refuse the credit, issue a reply letter to the applicant indicating the reason for the refusal.

The education credit contract is concluded for an amount equal to the annual payment amount indicated in the contract (agreement) regarding study on a tuition basis between the student and the educational organization submitted by the borrower. In this case, based on the payment amount established in the contract regarding study on a tuition basis for the next academic year and the application for obtaining an education credit, the credit amount is increased by signing an additional agreement to the education credit contract.

  1. Education credits are disbursed by commercial banks to the borrower at the amount of the Central Bank's key rate.

In this case, if the Central Bank's key rate is lowered, the interest rate on the education credit decreases proportionally; if the Central Bank's key rate is increased, the interest rate on the education credit remains unchanged.

The conditions set forth in the second paragraph of this paragraph must be reflected in the education credit contract concluded between the commercial bank and the borrower. See previous edition.

  1. Education credits by commercial banks are implemented by transferring funds from the borrower's loan account to the account indicated in the contract (agreement) formalized in the established manner regarding study on a tuition basis between the borrower and the educational organization or in the invoice/facture, based on the borrower's written order. Funds for education credits are transferred to educational organizations by commercial banks in the established manner during the academic year for study, by dividing the full amount of the annual payment into four equal parts according to the conditions indicated in the education credit contract. Commercial banks may implement the payment amount for half a year or a full year of study at once in cases provided for in the contract (agreement) regarding study on a tuition basis, based on the borrower's written application. See previous edition.

  1. Commercial banks return funds attracted from the Ministry of Economy and Finance but not utilized by the borrower in the amount of the unutilized part of the education credit to the Ministry of Economy and Finance within three working days after the deadlines indicated in the second paragraph of Article 24.   2. If the borrower has overdue interest debt on the education credit obtained from the commercial bank or has regularly missed payment deadlines, the commercial bank may refuse to allocate the next part of the tuition contract or education credits for subsequent years to the borrower in the manner established in the education credit contract.

Chapter 4. Procedure for Repaying the Credit and Implementing Credit Monitoring

  1. Principal debt and interest payments are paid by the borrower (joint borrower) under the conditions indicated in the education credit contract.

  2. The borrower (joint borrower) has the right to repay the education credit ahead of the deadlines established in the education credit contract.

  3. If the borrower (joint borrower) does not repay interest payments and principal debt on the education credit within the deadlines established in the education credit contract, the commercial bank takes repayment measures for overdue debts on the education credit based on its internal documents.   4. In the event of overdue debt on the principal debt and/or interest of the education credit exceeding 180 days, the bank performs the relevant accounting entry to reduce its obligations to the Ministry of Economy and Finance by 50% of the remaining principal debt of the education credit in accordance with the collateral contract and notifies the Ministry of Economy and Finance by the 15th of the month following the reporting month.   5. The reduction of the commercial bank's obligation to the Ministry of Economy and Finance in the cases indicated in Article 30 of this Regulation does not release the borrower (joint borrower) from the obligation to fully repay the interest and principal debt on the education credit to the bank.   1. If the education credit is fully or partially repaid after the commercial bank's obligation to the Ministry of Economy and Finance is reduced, the commercial bank increases its obligation to the Ministry of Economy and Finance by an amount equal to 50% of the repaid funds and extinguishes this obligation from the returned funds. The commercial bank directs the remaining part of the repaid funds to extinguish the borrower's debt to the commercial bank.

Chapter 5. Final Provisions

  1. Disputes arising in the application of this Regulation are resolved in the manner established by legislative acts.
