Circular Triq l-Imdina, Zone 1 Central Business District, Birkirkara CBD 1010 +356 2144 1155 communications@mfsa.mt www.mfsa.mt ESAs Joint Committee Public Consultation on the Harmonisation of Conditions Enabling the Conduct of the Oversight Activities under Article 41(1) Point (c) of Regulation (EU) 2022/2554 on Digital Operational Resilience for the Financial Sector This circular is an update to Circular titled Regulation (EU) 2022/2554 and Amending Directive (EU) 2022/2556 on Digital Operational Resilience for the Financial Sector published on the EU Official Journal published by the Authority in January 2023. As detailed by the latter circular, Regulation (EU) 2022/2554 (“the Regulation”) is to be supplemented by, inter alia, a series of Technical Standards and Guidelines. Following an interinstitutional drafting process by the European Supervisory Authorities (”ESAs”), the first set of Technical Standards with a delivery deadline of January 2024 was open for public consultation between June and September 2023, as detailed by Circular titled ESAs Joint Committee Public Consultation on the First Set of Technical Standards under Regulation (EU) 2022/2554 on Digital Operational Resilience for the Financial Sector. The second set of Technical Standards with a delivery deadline of July 2024 was open for public consultation between December 2023 and March 2024, as detailed by Circular titled ESAs Joint Committee Public Consultation on the Second Set of Technical Standards under Regulation (EU) 2022/2554 on Digital Operational Resilience for the Financial Sector. The ESAs are now publicly consulting on a draft Regulatory Technical Standard (“RTS”) that complements the harmonization of conditions enabling the conduct of oversight activities under Article 41(2) point (c) of the Regulation, more specifically on the composition of joint examination teams for the purpose of the Oversight Framework, established under Chapter V Section II of the Regulation.
