The document modifies and adds provisions to the General Provisions governing Retirement Fund Administrators (AFOREs) concerning their Promoting Agents and Previsional Advisors. It authorizes Educational Institutions to offer Certification Courses and establishes a three-year validity period for Promoting Agent registration numbers, aligned with certification validity. It mandates that AFOREs request registration or renewal within twenty calendar days of certification results and requires senior officials to obtain registration within four months of hiring. Additionally, it strengthens the role of National SAR Database Operating Companies in centralizing data and validation, and imposes a one-year ban on re-submitting candidates whose exams were cancelled for ethical violations.

El Presidente de la Comisión Nacional del Sistema de Ahorro para el Retiro, previa opinión favorable del
Comité Consultivo y de Vigilancia, con fundamento en los artículos 1o, 2o, 5o, fracciones I, II, XII y XVI, 12
fracciones I, VIII y XVI, 16 fracción XIII y 36, de la Ley de los Sistemas de Ahorro para el Retiro; 1o, 34, 45, 60,
67 fracciones II, XII y XIII, 68 fracciones XI, inciso b) y XXIII, 104 y 105 del Reglamento de la Ley de los
Sistemas de Ahorro para el Retiro; 1, 2, fracción III y 8 del Reglamento Interior de la Comisión Nacional del
Sistema de Ahorro para el Retiro, y
CONSIDERANDO
Que, de conformidad con los artículos 5, fracción I, y 36 de la Ley de los Sistemas de Ahorro para el
Retiro, la Comisión está facultada para regular el Registro de Agentes Promotores y establecer los requisitos
para su inscripción y permanencia, entre los cuales se encuentra la capacidad técnica necesaria para el
adecuado desempeño de sus funciones;
Que, a fin de ampliar las alternativas para que las Administradoras obtengan la certificación de sus
Agentes Promotores o Asesores Previsionales, resulta conveniente que las Instituciones Educativas también
puedan ofrecer cursos con dichos fines;
Que, para mejorar la gestión del pre registro, registro, validación, entrega de resultados de evaluaciones y
demás información generada en los procesos realizados ante las Instituciones Educativas e Instituciones
Evaluadoras, es necesario fortalecer el ecosistema de control del Registro de Agentes Promotores mediante
la consolidación de una base de datos administrada por las Empresas Operadoras de la Base de Datos
Nacional SAR, incluyendo su intervención en la centralización, distribución y validación de esa información,
con lo cual se generarían eficiencias operativas;
Que, con objeto de agilizar la entrega de resultados derivados de los procesos que las Administradoras
llevan a cabo ante las Instituciones Educativas e Instituciones Evaluadoras, resulta pertinente establecer
mecanismos de intercambio de información entre dichas instituciones y las Empresas Operadoras de la Base
de Datos Nacional SAR, a fin de eliminar la necesidad de que las Administradoras entreguen directamente las
constancias de certificación y recertificación a las citadas Empresas Operadoras;
Que para dar certeza las Administradoras y a sus funcionarios, empleados y demás personas que dirijan,
coordinen o ejecuten las políticas y las actividades comerciales de una Administradora, así como aquellas que
supervisen a los Agentes Promotores y a los Asesores Previsionales, que ingresen a prestar sus servicios, es
necesario precisar un periodo de prudente para que obtengan su registro de Agente Promotor;
Que, a efecto de homologar los tiempos de vigencia de los números de Agente Promotor con la vigencia
de las certificaciones y recertificaciones, y de permitir a las Administradoras concluir de forma ágil la
inscripción o renovación de sus colaboradores en el Registro de Agentes Promotores, se estima conveniente
establecer plazos concretos para tal fin, y
Que, para que la Comisión cuente con información confiable que permita un mejor ejercicio de sus
facultades de supervisión, es necesario que las Administradoras pongan en su conocimiento un plan anual de
capacidad de Agentes Promotores o Asesores Previsionales, por lo que se expiden las presentes:

ÚNICO. - Se MODIFICAN los artículos 2, fracciones X bis y XII bis; 3, fracciones II y VIII; 4, primer párrafo;
7, fracciones V, XVII en su inciso b y XIX; 9, segundo párrafo; 13, fracciones II y III; 16, primer párrafo y actual
segundo párrafo; 18, primer párrafo; 21, cuarto párrafo; 23, primer párrafo, las fracciones II y III, así como el
tercero, cuarto y quinto párrafos; 23 bis, fracción I, en su segundo y tercer párrafos; 23 ter, primer párrafo,

technical capacities through Recertification Exam, Update Course, or Professionalization Program.
Recertification may be carried out during the six months prior to the conclusion of its validity, the
registration number of Promoting Agents or Previsional Advisors must remain valid throughout
the renewal process; otherwise, it will be cancelled, interrupting the process. In that case, Administrators may carry out the process referred to in the previous section.
In the event that Administrators do not request the renewal of the registration of their candidates within the period referred to in the previous paragraph, or if they are rejected for not meeting the requirements
provided in these general provisions, the Operating Companies must cancel the registration of the Promoting Agents Register from the date on which its validity ends.

Previsional Advisors or Promoting Agents must accredit their technical capacity through the processes offered for this purpose by the Evaluation Institutions or Educational Institutions designated by the Commission for this purpose, in order for the latter to certify or recertify them to exercise the functions they perform.

Provisions occurs, the recertification that has been issued by the Commission shall lose all validity

behavior rules established by the Evaluation Institution by signing their
commitment, agreement, and willingness to do so, through the mechanisms established by said
institutions.
In the event of evidence of transgressions to the aforementioned ethical
behavior rules, the Evaluation Institution shall proceed to cancel the Certification or
Recertification Exam of the candidates involved, which it shall inform promptly
to the Administrator, to the
Operating Companies, and to the Commission with the cases duly
documented, providing this with the evidence or probative elements where the
transgressions are recorded.
Likewise, the call for applications shall establish that Administrators may not submit,
during a calendar year, candidates whose exam has been cancelled in terms of what
is established in the previous paragraph; this year shall be counted from the date on which the
cancellation occurred, and the provisions of article 28 bis of these provisions shall apply. The
Operating Companies must identify the candidates referred to, for the purposes of
article 28 bis of these provisions.

that of the National Population Registry (RENAPO), ensuring that the CURP has
the characteristics provided in article 7 fraction V of these provisions.
Likewise, for candidates who have a Promoting Agent Number,
they must include it in the pre-registration.
When Administrators do not carry out the process referred to in the previous
paragraph, registration in the Register of Promoting Agents may not continue,
so they must submit their pre-registration again for subsequent events.
Operating Companies will validate from the pre-registration that the information of the candidates that Administrators register with the Educational Institutions for
obtaining certification or recertification, complies with what is established in the present
provisions to obtain certification or recertification and must notify the
Administrator and the Educational Institution, which candidates will be
able to take the Certification or Recertification Exams, as well as those who did not
pass the corresponding validation, indicating for such effect the reasons for rejection.
The foregoing shall be carried out in accordance with the mechanisms and processes that are
established in the Transactional Procedures Manual. "

IV. Individuals who opt for Certification Courses or Update Courses to obtain certification or recertification, as the case may be, must obtain a minimum passing grade of 80% in said courses.

I. That it has at least 5 years of track record as an educational institution, with installed capacity, infrastructure, human and technological resources necessary for the design and delivery of Certification Courses, Update Courses, and Professionalization Programs at the national level;

" Article 23 quinquies. Operating Companies shall establish mechanisms for the exchange of information with Evaluating Institutions and Educational Institutions in order to safeguard, validate, and centralize information regarding the certification or recertification processes, for which purpose they must comply with the following:
I. Validate the information registered in the pre-registration process of the certification and recertification processes.
II. Receive from Evaluating Institutions and Educational Institutions the results of the evaluations of the certification and recertification processes.
III. Generate automatic validation mechanisms regarding Pension Advisors or Promoter Agents who have a passing evaluation for certification or recertification.
IV. Automatically identify the validity of the Promoter Agent registration in accordance with the results of the evaluations of the certification and recertification processes provided by Educational Institutions and Evaluating Institutions.
The foregoing, in accordance with what is established in the Transactional Procedures Manual. "
" Article 28. The candidate who does not obtain a passing grade may present in subsequent certification or recertification events, in accordance with what is provided in article 23 of these provisions, the exams that the Administrator deems convenient. " Article 63. Administrators must prepare and remit to the Commission, within the first quarter of each calendar year, an annual capacity plan for Promoter Agents or Pension Advisors, which shall have the object of accrediting that they have an operational strategy for the attention of Workers during the corresponding calendar year.
I. The plan referred to in this article must contain, at least the following:
a) The number of active Promoter Agents or Pension Advisors considered for attention at the close of the same exercise;
b) The annual projection of variation of Promoter Agents or Pension Advisors, expressing the estimated number of Promoter Agents or Pension Advisors that the Administrator expects to incorporate during the calendar year, broken down by quarter, including high, low, and estimated rotation; and
c) The methodological justification used, including, when applicable, the relationship with the indicator of coverage of promoter agents or pension advisors or other service indicators. "
TRANSITORY PROVISIONS
ARTICLE FIRST. These general provisions shall enter into force three months after the date of their publication in the Official Gazette of the Federation, with the exception of the following:
I. Article 63 of these modifications and additions shall enter into force on the next business day following its publication in the Official Gazette of the Federation.
ARTICLE SECOND. The submission of the plan referred to in article 63 of these modifications and additions must be made for the first time within fifteen business days following its entry into force and must contain the information that the Administrator has projected for the remainder of the 2026 exercise. With respect to the submission that must be made for the year 2027, the provisions of article 63 of these modifications and additions shall apply.
ARTICLE THIRD. At the date of entry into force of these general provisions, all those provisions issued by the Commission that are contrary to this regulation are repealed.
