Modifying Circular 20/15 of the Single Document on Insurance and Sureties

The National Commission for Insurance and Sureties reduces the submission deadline for the fourth-quarter statistical reports of the Insurance Sector Statistical System (SESA) and the Surety Sector Statistical System (SESAF) from 65 and 29 business days, respectively, to 22 business days following the close of the quarter. This modification applies to insurance institutions, mutual insurance societies, surety institutions, and other entities subject to the Commission's inspection and supervision. The change takes effect the day after its publication in the Official Gazette of the Federation.

Modifying Circular 20/15 of the Single Document on Insurance and Sureties

MODIFYING CIRCULAR 20/15 OF THE SINGLE DOCUMENT ON INSURANCE AND SURETIES

(Provision 38.1.9.)

The National Commission for Insurance and Sureties, based on the provisions of articles 366, fraction II, and 372, fraction VI, of the Law on Insurance and Surety Institutions, and

CONSIDERING

That in accordance with the provisions of article 389 of the Law on Insurance and Surety Institutions, insurance institutions and mutual insurance societies, surety institutions, as well as other persons and entities subject to the inspection and supervision of the National Commission for Insurance and Sureties under the terms of said Law, must submit to it, in the form and terms established by general provisions, the reports and tests regarding their organization, operations, accounting, investments, or assets that it requests for regulatory, supervisory, control, inspection, surveillance, statistical, and other functions corresponding to it under the cited Law or other legal, regulatory, and administrative provisions.

That pursuant to article 380 of the Law on Insurance and Surety Institutions, the National Commission for Insurance and Sureties may provide assistance to the National Commission for the Protection and Defense of Users of Financial Services, among other public entities, in the exercise of its functions, for which it may provide it with information and documentation in its possession regarding insurance institutions and mutual insurance societies, surety institutions, as well as other persons and companies subject to the inspection and supervision of the National Commission for Insurance and Sureties.

That the National Commission for the Protection and Defense of Users of Financial Services, in order to duly and timely comply with the powers conferred upon it by the Law for the Protection and Defense of Users of Financial Services, has expressed to the National Commission for Insurance and Sureties the need to reduce the deadline for submitting information related to the Statistical Systems of the Insurance Sector (SESA) and the Statistical Systems of the Surety Sector (SESAF), corresponding to the fourth quarter of each year, from sixty-five and twenty-nine business days after the close of said quarter, respectively, to twenty-two business days.

For the aforementioned reasons, this Commission has resolved to issue a Modifying Circular to the Single Document on Insurance and Sureties under the terms set forth below:

The SESA summary statistical information by operation, line of business, and type of insurance, referred to in fraction IV of Provision 26.1.4, shall be submitted within the first twenty-two business days following the close of the relevant quarter, in the form and terms indicated in Annex 38.1.9-u, adhering to the "Manual of Statistical Information by Operation, Line of Business, or Insurance," which will be made available through the Commission's Website;

The SESAF summary statistical information by line of business and sub-line, referred to in fraction II of Provision 26.2.4, shall be submitted within the first twenty-two business days following the close of the relevant quarter, in the form and terms indicated in Annex 38.1.9-x, adhering to the "Manual of Statistical Information by Line of Business and Sub-line," which will be made available through the Commission's Website;

TRANSITORY

SINGLE.- This Modifying Circular shall enter into force the day after its publication in the Official Gazette of the Federation.
