The National Insurance and Sureties Commission modifies the Single Insurance and Surety Circular to simplify the registration process for legal reviewers. Specifically, it eliminates the requirement to submit two infant-sized photographs for applicants seeking registration to sign legal opinions on contractual documentation. The amendment updates Article 30.6.3 by removing the former subsection I regarding photographs and adjusts Annex 30.6.4 accordingly. This modification enters into force on the next business day following its publication in the Official Gazette of the Federation.

The National Insurance and Sureties Commission, based on the provisions of articles 366, fraction II, 372, fractions VI and XLII, 373 and 381 of the Law of Insurance and Surety Institutions, and
CONSIDERING
That on March 8, 2017, the "Agreement establishing the guidelines that must be observed by the dependencies and decentralized organisms of the Federal Public Administration, regarding the issuance of general administrative acts to which Article 69-H of the Federal Administrative Procedure Law applies," was published in the Official Gazette of the Federation, through which, in terms of its Fifth Article, the Dependencies of the Federal Public Administration that issue new general administrative acts must expressly indicate in the corresponding draft the two regulatory obligations or the two acts that will be repealed or abrogated and that refer to the same regulated matter or economic sector.
That on December 12, 2017, Modifying Circular 11/17 of the Single Insurance and Surety Circular was published in the Official Gazette of the Federation, by virtue of which, in accordance with what is established in its Second Transitional Provision and with the purpose of complying with the Fifth Article of the aforementioned Agreement, the National Insurance and Sureties Commission acquired the commitment to simplify the CNSF-12-026-A procedure, "Registration and/or renewal of legal reviewers before the National Insurance and Sureties Commission, for the signing of the legal opinion that certifies the compliance of contractual documentation with the applicable current regulations. Modality A: Registration of legal reviewer in matters of insurance and sureties," within a period of six months counted from the publication of said Modifying Circular in the Official Gazette of the Federation.
That in order to comply with the Second of the Transitional Provisions of the aforementioned Modifying Circular 11/17, the National Insurance and Sureties Commission simplifies the aforementioned CNSF-12-026-A procedure, eliminating the requirement to present two infant-sized photographs of the persons who wish to obtain their registration as legal reviewers, thereby suppressing fraction I of Article 30.6.3 of the Single Insurance and Surety Circular and making the necessary adjustments in Annex 30.6.4 of the same Single Circular.
For the aforementioned reasons, this Commission issues the following modification to the Single Insurance and Surety Circular in the following terms:
MODIFYING CIRCULAR 7/18 OF THE SINGLE INSURANCE AND SURETY CIRCULAR
(Article 30.6.3; Annex 30.6.4)
FIRST.- Article 30.6.3 of the Single Insurance and Surety Circular is modified, to read as follows:
30.6.3. Interested parties seeking registration to sign the legal opinion referred to in Article 30.6.1, in addition to complying with the requirements established in the LISF and in these Provisions, must present the following documentation when applying for registration:
I. Curriculum vitae of the applicant and supporting documentation that accredits their professional experience in accordance with what is established in fraction II of Article 30.6.2. To accredit the requirement of the preceding paragraph, the applicant must attach their curriculum vitae, in which, among other aspects, the activities carried out on their own behalf, or as an employee of public or private companies, that validate their experience are clearly and precisely indicated, stating the dates in the realization of said activities. To accredit what is stated in the curriculum vitae, the applicant must exhibit:
a) Certified copy of the notarial instrument in which the power granted in their favor is recorded, from which the required professional experience can be inferred, or
b) Copy of the appointments or positions held, or original certificate of services signed by the human resources area of the corresponding Institution, Mutual Society, company, dependency or entity, which are undeniable to prove the necessary professional experience.
In addition to what is stated in the preceding paragraph, the Commission will take into account all those documents provided by the applicant that allow demonstrating that they have the theoretical knowledge in matters of insurance or sureties required, such as: participation in courses, conferences, national or international seminars, congresses, etc., as well as documentation that supports the applicant's experience, such as letters issued by an Institution or Mutual Society or other type of documents, and
II. Copy of the respective professional license issued by the Ministry of Public Education, which contains the Unique Population Registry Key, as well as its original for comparison purposes; in case said license does not contain the Unique Population Registry Key, a copy and original of the latter must be exhibited for comparison.
SECOND.- Annex 30.6.4 of the Single Insurance and Surety Circular is modified.
TRANSITIONAL PROVISION ONLY.- This Modifying Circular will enter into force on the next business day following its publication in the Official Gazette of the Federation.
