The National Banking and Securities Commission (CNBV) formally acknowledges the definitive closure of Banco Caixa Geral, S.A.'s Representation Office in Mexico and revokes the authorization for its establishment. This action follows a notification submitted by the bank on October 1, 2020, requesting the revocation of its license due to the office's closure. The revocation is based on the unanimous agreement of the CNBV Board of Governors dated November 13, 2020, and applies to the entity previously authorized as Banco Simeon, S.A. and later Banco Caixa Geral, S.A.

We refer to the document submitted to this Commission on October 1, 2020, through the email address VPSupervisionGIFB@cnbv.gob.mx, by Banco Caixa Geral, S.A., Representation Office in Mexico (Banco Caixa Representation Office), by which it notified its definitive closure and, consequently, requested the revocation of its authorization to establish itself as a representation office in Mexico.
BACKGROUND
By office letter 102-E-367-DGBM-IV-B-b-2552 dated November 29, 1984, the Ministry of Finance and Public Credit (SHCP) authorized Banco Simeon, S.A. to establish a representation office in Mexico, named Banco Simeon, S.A., Vigo, Spain, Representation in Mexico.
By office letter UBA/147/2006 of October 13, 2006, the SHCP resolved to modify the authorization referred to in point 1 above, in order to provide for the authorization of Banco Caixa Geral, S.A. (formerly Banco Simeon, S.A.), to establish a Representation Office in Mexico to be named Banco Caixa Representation Office.
Regarding this, considering that the request and documentation presented comply with the applicable provisions, this Commission, based on the provisions of the Fifteenth, fraction VI of the "Rules for representation offices of foreign financial entities", published in the Official Gazette of the Federation on December 31, 2014, takes note of the closure of Banco Caixa Representation Office.
Likewise, this Commission notifies you that, based on the aforementioned Fifteenth Rule, the members of the Board of Governors of this Commission, in the session held on November 13, 2020, adopted the following Tenth Agreement:
"... the members of the Board of Governors, based on article 12, fractions V and XV of the Law of the National Banking and Securities Commission, in relation to article 7 of the Credit Institutions Law and the Fifteenth, fraction VI of the Rules for representation offices of foreign financial entities, unanimously revoked the authorization granted by the Ministry of Finance and Public Credit, by office letter number 102-E-367-DGBM-IV-B-b-2552 dated November 29, 1984, for the establishment in national territory of Banco Caixa Geral, S.A., Representation Office in Mexico, due to the closure of said representation office. "
This office letter is issued based on articles 16, penultimate paragraph of the Law of the National Banking and Securities Commission; 12, 19, fractions I, subsection f), III and last paragraph and 40, fractions I and VII of the Internal Regulations of the National Banking and Securities Commission.
