Official Letter Revoking the Authorization Granted to Unión de Crédito Mixta del Estado de Veracruz, S.A. de C.V. to Operate as a Credit Union

The authorization for Unión de Crédito Mixta del Estado de Veracruz, S.A. de C.V. to organize and function as a Credit Union is revoked based on Articles 97, 99, and 100 of the Credit Unions Law. Following notification of this resolution, the entity is prohibited from conducting operations and must enter a state of dissolution and liquidation in accordance with Article 99 of the Credit Unions Law. The National Banking and Securities Commission issued this decision based on grounds established in the legal framework and an agreement adopted by its Governing Board on November 28, 2022.

OFFICIAL LETTER whereby the authorization granted to Unión de Crédito Mixta del Estado de Veracruz, S.A. de C.V., to operate as a Credit Union is revoked.

Subject: Revocation of authorization to continue performing operations as a Credit Union.

LEGAL REPRESENTATIVE OF UNIÓN DE CRÉDITO MIXTA DEL ESTADO DE VERACRUZ, S.A. DE C.V. Avenue 1, No. 609 Interior Department 4 between street 6 and 8, Veracruz Neighborhood Center, Zip Code 94500 of the City of Córdoba Veracruz.

This National Banking and Securities Commission, based on the provisions of articles 97 sections II and XIV, 99 and 100 of the Credit Unions Law (hereinafter LUC), 2 first paragraph; 4, sections I, XI and XXXVIII, 5, 12 sections V and XV and 16, sections VI and XVII of the Law of the National Banking and Securities Commission (hereinafter LCNBV), this Decentralized Body of the Secretariat of Finance and Public Credit, has the purpose of supervising and regulating within its competence the entities comprising the Mexican financial system, in order to procure their stability and correct functioning, as well as maintain and promote the healthy and balanced development of said system as a whole, in protection of the public interest, authorize the constitution and operation of those entities indicated by the laws and, where applicable, agree on the revocation of said authorizations.

In order to comply with said legal provisions, the present resolution of revocation of the authorization to continue operating as a Credit Union is issued, which at the time was granted to the society denominated LEGAL REPRESENTATIVE OF UNIÓN DE CRÉDITO MIXTA DEL ESTADO DE VERACRUZ, S.A. DE C.V. , (hereinafter UNICREMIX , Credit Union, Entity or Society, indistinctly), according to the following:

For the foregoing it is appropriate to conclude that in accordance with the information available to this Commission, concatenated with the fact that said Credit Union did not provide sufficient elements to disprove the causes for revocation for which it was summoned, and much less offered element of conviction by which to discredit said circumstance, which leads this Commission to the conviction that causes for revocation for which UNION DE CRÉDITO MIXTA DEL ESTADO DE VERACRUZ, S.A. DE C.V. was summoned have been updated, established in article 97 sections II and XIV , of the Credit Unions Law.

RESOLVES

FIRST. This Decentralized Body, based on the provisions of article 97 sections II and XIV as well as 99 and 100 of the aforementioned Credit Unions Law and 12, section V and XV, of the Law of the National Banking and Securities Commission; as well as in accordance with the SIXTH Agreement adopted by the Governing Board of the own Commission in its ordinary session held on November 28, 2022 , and to the considerations that were exposed in the present resolution, REVOKES to UNION DE CRÉDITO MIXTA DEL ESTADO DE VERACRUZ, S.A. DE C.V., the authorization for the organization and functioning to operate as a Credit Union.

SECOND. From the date of notification of the present resolution, UNION DE CRÉDITO MIXTA DEL ESTADO DE VERACRUZ, S.A. DE C.V. , is disabled to perform operations and will be placed in a state of dissolution and liquidation, in accordance with the provisions of article 99 of the Credit Unions Law.

The foregoing, is made known to you based on the provisions of articles 16, section VI, and penultimate paragraph, of the Law of the National Banking and Securities Commission and 14 of the Internal Regulations of the National Banking and Securities Commission, as well as in terms of the SIXTH Agreement adopted by the Governing Board of the own Commission in its ordinary session held on November 28, 2022.

Thus provided the President of the National Banking and Securities Commission, based on the provisions of articles 16, sections VI and XVII, of the Law of the National Banking and Securities Commission and signs, in substitution for absence of the same, the Legal Vice President of this Commission, in accordance with the provisions of articles 3, section III, second paragraph, 4, section I, section A, section II, section A, subsection 7), 9, 14 and 60 of the Internal Regulations of the National Banking and Securities Commission.
