On Additional Measures to Increase the Efficiency of Free Economic Zones and Small Industrial Zones

The President of Uzbekistan mandates the termination of redundant commissions and working groups to streamline the management of Free Economic Zones (FEZs) and Small Industrial Zones (SIZs). The decree establishes a new system for selecting investment projects based on specific criteria, including job creation and export potential, and introduces an electronic online auction process for land allocation in SIZs. It requires the Ministry of Finance to ensure credit line openings for project financing through the Recovery and Development Fund, caps insurance premiums for loan collateral at 0.5%, and directs the creation of a Unified Portal for FEZs and SIZs to facilitate investor services and information access.

On Additional Measures to Increase the Efficiency of Free Economic Zones and Small Industrial Zones

It is noted that in recent years, specific and large-scale work has been carried out in our country to create free economic and small industrial zones, including forming a solid regulatory and legal framework regulating their activities, and creating a wide system of tax and customs preferences and benefits that allow attracting foreign and local investments to develop free economic and industrial zones.

At the same time, there are serious shortcomings and flaws in organizing the activities of free economic zones that hinder the development of such zones and their effective operation. During inspections conducted by the Interagency Commission established by Decree No. PQ-3175 of the President of the Republic of Uzbekistan dated August 7, 2017, the following were identified:

first, there are no clear criteria for selecting projects for placement in the territories of free economic and small industrial zones. When considering investment projects, the number of new jobs created, the presence of a potential foreign partner and investor-country, the demand for produced products in domestic and foreign markets, export volume, and the degree of localization of production are not taken into account;

second, the mechanism for agreeing and approving investment projects proposed for placement and implementation in the territory of free economic zones has become excessively bureaucratic in practice, which delays decision-making on these projects for months;

third, sufficient attention is not being paid to the timely construction of the necessary engineering, communication, and production infrastructure required for free economic and small industrial zones;

fourth, the reliable provision of proposed investment projects with reliable financial sources, including local and foreign credit resources and direct foreign investments, has not been developed in detail. Commercial banks attached to free economic and small industrial zones are participating sluggishly in resolving these issues;

fifth, participants of free economic zones face significant difficulties in purchasing raw material resources in the required volumes through the Republic Commodity and Raw Materials Exchange;

sixth, the production capacities of enterprises put into operation in the territory of free economic zones are being used extremely inefficiently, as a result of which production and export volumes and the number of jobs do not match the parameters of the approved business plans;

seventh, there is no effective mechanism for coordinating the work of regional commissions established under the leadership of the First Deputy Chairman of the Cabinet of Ministers of the Karakalpakstan Republic, the First Deputies of the Governors of the regions and the city of Tashkent on economic and entrepreneurial issues, to promptly resolve issues arising on the ground regarding the coordination of activities of free economic and small industrial zones.

All of this necessitates the creation of a fundamentally new system for selecting investment projects to be placed in free economic and small industrial zones, the procedure for allocating land plots, ensuring the use of raw materials and materials, and allocating credit resources to business entities.

To create a highly favorable business environment for attracting foreign and local investments to build high-tech modern production for deep processing of mineral-raw and agricultural resources that produce high value-added, competitive, and quality products in demand in foreign markets, as well as to comprehensively and effectively utilize the production and resource potential of the regions of the republic, thereby organizing new jobs and increasing population income:

Aripov) shall determine the industry specialization of each free economic zone by December 1, 2017, taking into account the existing mineral-raw, land, water, agricultural resources, production and export potential, and environmental conditions of the regions.

The State Committee for Investments of the Republic of Uzbekistan, together with the Ministry of Economy, Ministry of Foreign Trade, Ministry of Foreign Affairs, Chamber of Commerce and Industry, and commercial banks, shall develop "roadmaps" for attracting foreign investors to these zones within two months, taking into account the industry specialization of each free economic zone.

depriving an entrepreneur of the status of a participant of a special economic zone does not lead to the suspension of their activity in the territory of the special economic zone, nor to the suspension of rights to other objects belonging to the participant of the special economic zone by right of ownership. approve the updated regulation on the procedure for applying exemptions on taxes and customs payments in the territory of free economic zones, providing that exemptions shall be applied taking into account the main economic and social indicators of the business plans/technical-economic justifications of projects (the volume of invested capital, turnover and export amounts, the number of permanent jobs created, currency coverage of production, etc.);

submit to the Cabinet of Ministers of the Republic of Uzbekistan draft normative legal documents on approving the standard agreement on investment between directorates of free economic zones, participants, and investors.

  1. The Cabinet of Ministers of the Republic of Uzbekistan shall adopt a decision within one month on approving the boundaries of territories included in the pharmaceutical free economic zones established by the Decree of the President of the Republic of Uzbekistan dated May 3, 2017, No. PF-5032.

  2. The second paragraph of paragraph 4 of the Resolution of the President of the Republic of Uzbekistan dated August 7, 2017, No. PQ-3175 "On Measures to Strengthen the Coordination of Ministries, Departments, and Local State Authority Bodies for the Effective Operation of Free Economic Zones and to Increase Their Responsibility" shall be deleted.

  3. The Ministry of Economy of the Republic of Uzbekistan, the Ministry of Finance, the State Committee for Investments, the State Committee for Assistance to Privatized Enterprises and Development of Competition, the Ministry of Justice, together with other interested ministries and departments, shall within one month submit proposals to the Cabinet of Ministers of the Republic of Uzbekistan on amendments and additions to legislative acts arising from this decision.

  4. Supervision over the implementation of this decision shall be entrusted to the Prime Minister of the Republic of Uzbekistan A.N. Aripov, State Advisor to the President of the Republic of Uzbekistan V.A. Golyshev, the Minister of Economy of the Republic of Uzbekistan G.K. Saidova, and the Chairman of the State Committee for Investments of the Republic of Uzbekistan A.I. Akhmedkhodjaev.
