On Additional Measures to Support the Export of Small Business and Private Entrepreneurship Entities

A Fund for Supporting Export of Small Business and Private Entrepreneurship Entities is established under the National Bank of Foreign Economic Activity to provide legal, financial, and organizational assistance. The Fund's initial capital is set at 5.0 billion sum, with 2.5 billion provided from the state budget, and it receives exemption from most taxes and mandatory contributions until January 1, 2019. Relevant ministries and banks are instructed to complete the Fund's registration and staffing within specified deadlines, although a note indicates the document lost force on November 21, 2023, pursuant to Presidential Decree PF-198.

Resolution of the President of the Republic of Uzbekistan

On Additional Measures to Support the Export of Small Business and Private Entrepreneurship Entities

LexUZ commentary This resolution lost force pursuant to the Decree of the President of the Republic of Uzbekistan dated November 21, 2023 No. PF-198 "On Additional Measures Aimed at Producing High-Quality and Competitive Products in Certain Industrial Sectors".

In order to further expand the export potential of small business, private entrepreneurship entities and farmer households, provide them with necessary legal, financial and organizational assistance in increasing the production of modern, competitive products in foreign markets and exporting them, and ensure reliable protection of our country's exporting entrepreneurs from the risks of changes in external market conditions: (preamble in the edition of the Resolution of the President of the Republic of Uzbekistan dated March 16, 2016 No. PQ-2507 — Collection of Legislation of the Republic of Uzbekistan, 2016, No. 12, Article 110)

  1. The proposal of the Ministry of Economy of the Republic of Uzbekistan, the Ministry of Finance, the Ministry of Foreign Economic Relations, Investments and Trade, the National Bank of Foreign Economic Activity, the Chamber of Commerce and Industry of Uzbekistan and the Farmers Council on establishing the Fund for Supporting Export of Small Business and Private Entrepreneurship Entities under the National Bank of Foreign Economic Activity with territorial branches in the regions of the republic, as well as representative offices in foreign countries, is accepted. (Clause 1 in the edition of the Resolution of the President of the Republic of Uzbekistan dated March 16, 2016 No. PQ-2507 — Collection of Legislation of the Republic of Uzbekistan, 2016, No. 12, Article 110)

  2. The following shall be considered the main tasks and directions of the activity of the Fund for Supporting Export of Small Business and Private Entrepreneurship Entities:

  • conducting in-depth marketing research of external markets on studying the current and prospective conjuncture of demand and supply, as well as identifying potential opportunities for exporting products manufactured by small business, private entrepreneurship entities and farmer households of our country;

  • systematically analyzing the assortment and types of products produced by small business, private entrepreneurship entities and farmer households, determining their level of competitiveness in external markets, forming a relevant database, and on this basis developing proposals aimed at ensuring that the products produced for export meet the demand and supply in global and regional markets;

  • providing legal, financial and organizational services in exporting products of small business, private entrepreneurship entities and farmer households to external markets, in searching for potential buyers, in preparing and concluding contracts, in carrying out export operations, in reliably protecting exporters from potential risks, as well as in obtaining and paying necessary licenses, certificates and other permits and fees required by the legislation of foreign countries;

  • assisting in expanding the participation of small business, private entrepreneurship entities and farmer households in tender auctions abroad, as well as in organizing contacts between our country's commodity producers and foreign buyers through organizing fairs, "round tables" and others.   1. It is established that:
  • the Fund for Supporting Export of Small Business and Private Entrepreneurship Entities is a legal entity in the form of a non-state institution;

  • the Fund serves and provides assistance only to small business and private entrepreneurship entities and farmer households;

  • the Fund Council is the highest body of Fund management, the Executive Directorate is the executive body of the Fund and disposes of its funds;

  • the initial amount of Fund funds is 5.0 billion sum, of which 2.5 billion sum is provided at the expense of a one-time contribution from state budget funds, and the remaining part is formed at the expense of voluntary contributions from the founders — small business, private entrepreneurship entities and farmer households, the National Bank of Foreign Economic Activity of the Republic of Uzbekistan, as well as other commercial banks, financial institutions and donors; (Clause 3, fifth paragraph in the edition of the Resolution of the President of the Republic of Uzbekistan dated March 16, 2016 No. PQ-2507 — Collection of Legislation of the Republic of Uzbekistan, 2016, No. 12, Article 110)

  • income received in the form of commission deductions of up to 1 percent of the contract value, but not less than 100 thousand sum, for providing legal, financial and organizational services related to carrying out foreign economic operations to small business, private entrepreneurship entities and farmer households, as well as other sources not prohibited by legislation are considered sources of Fund funds.   1. Consent is given to the proposal of the Ministry of Foreign Economic Relations, Investments and Trade of the Republic of Uzbekistan, the Ministry of Finance and the National Bank of Foreign Economic Activity for the Fund to provide small business and private entrepreneurship entities, farmer households:
  • development of our country's brands of products intended for export, promotion of export supply, including payment of necessary licenses, permits, certificates in accordance with the legislation of foreign countries, as well as registration fees and other payments related to the participation of small business, private entrepreneurship entities and farmer households in international tender auctions; (Clause 4, second paragraph in the edition of the Resolution of the President of the Republic of Uzbekistan dated March 16, 2016 No. PQ-2507 — Collection of Legislation of the Republic of Uzbekistan, 2016, No. 12, Article 110)

  • gratuitous financial assistance for participation in exhibitions and fairs abroad, having concluded export contracts, ensuring entry into new markets and export of new product types.

4¹. It is established that the Fund has the following rights:

  • in accordance with the legislation, to enter into the composition of founders (participants) of small entrepreneurship entities that do not have sufficient funds to organize the production of export-oriented products, subsequently selling the Fund's share at market value within two years after the production of finished products and export supply begins;

  • to provide financial assistance to small business, private entrepreneurship entities and farmer households by covering part of the expenses related to modernization and expansion of production, bringing the product design level to international standards, involving foreign specialists, and taking into account the demand for local products abroad, bringing them to external markets. Financial assistance provided by the Fund is carried out by small business, private entrepreneurship entities and farmer households subject to subsequent repayment.   1. The Fund for Supporting Export of Small Business and Private Entrepreneurship Entities, including its territorial branches, shall be exempt from payment of all types of taxes, fees, customs duties and mandatory contributions to state target funds until January 1, 2019, except for the unified social payment.   2. The National Bank of Foreign Economic Activity of Uzbekistan, the Chamber of Commerce and Industry, the Farmers Council together with small business and private entrepreneurship entities shall take necessary measures to hold an organizational meeting of the Fund founders, approve its charter and form the Fund Council within two weeks.

The Fund Council within one month:

  • together with the Ministry of Justice of the Republic of Uzbekistan, shall register the Fund for Supporting Export of Small Business and Private Entrepreneurship Entities in the established manner;

  • shall approve the structure of the Fund Executive Directorate and its territorial branches, fully provide the Fund with highly qualified specialists in the field of marketing, foreign trade operations and international law;

  • shall approve the Regulation on the procedure for forming and using the funds of the Fund for Supporting Export of Small Business and Private Entrepreneurship Entities in the established manner, in agreement with the Ministry of Finance of the Republic of Uzbekistan.

7¹. The Fund Council shall determine the staff units and structure of the Fund, as well as its territorial branches in the regions of the republic and representative offices in foreign countries, based on economic feasibility.   1. The proposal of the Tashkent City Khokimiyat and the National Bank of Foreign Economic Activity of the Republic of Uzbekistan on locating the Fund Executive Directorate in Tashkent city, G. Gulom street, 1-house is accepted, providing for its equipping with necessary equipment, instruments and types of communication.

The Fund Council together with the Cabinet of Ministers of the Republic of Karakalpakstan and regional khokimiyats, the National Bank of Foreign Economic Activity of the Republic of Uzbekistan shall ensure the formation and placement of territorial branches of the Fund within two months.

It is established that the placement of the Fund's Executive Directorate and its territorial branches shall be carried out without charging rent fees.

  1. Control over the execution of this resolution shall be assigned to the Prime Minister of the Republic of Uzbekistan Sh.M. Mirziyoyev.
