Decree of the President of the Republic of Uzbekistan

On Amendments and Additions to Certain Documents of the President of the Republic of Uzbekistan, as well as on Declaring Some of Them Invalid

In accordance with the Law of the Republic of Uzbekistan "On Non-Bank Credit Organizations and Microfinance Activities", the Decree of the President of the Republic of Uzbekistan dated May 25, 2022 No. PF-141 "On Measures to Improve the Payment System and Increase the Payment Discipline of Business Entities", and the Resolution dated July 22, 2022 No. PQ-329 "On Additional Measures to Improve the System of Vocational and Entrepreneurship Training for Women", as well as for the purpose of further developing investment potential:

1. Amendments and additions providing for the following shall be made to certain documents of the President of the Republic of Uzbekistan in accordance with Appendix 1:

• systematization of sub-legal documents related to non-bank credit organizations and microfinance activities;

• termination of non-withdrawable special purpose accounts opened by business entities in commercial banks;

• granting the Government Commission on Foreign Trade, Investments, Development of Local Industry, and Technical Regulation the authority to allow the linkage of rent payments in lease contracts for commercial buildings within the framework of investment projects for the construction of large shopping and entertainment centers to foreign currencies and conditional units;

• expanding the scope of organizations involved in the vocational and entrepreneurship training of youth and women.

2. Certain documents of the President of the Republic of Uzbekistan shall be declared invalid in accordance with Appendix 2.

3. The control over the execution of this Decree shall be entrusted to Deputy Prime Ministers J.A. Kuchkarov and J.A. Khodjaev.

Appendix 1 to the Decree of the President of the Republic of Uzbekistan dated April 26, 2023 No. PF-62

Amendments and Additions Being Made to Certain Documents of the President of the Republic of Uzbekistan

1. In the Decree of the President of the Republic of Uzbekistan dated May 12, 2020 No. PF-5992 "On the Strategy for Reforming the Banking System of the Republic of Uzbekistan for 2020-2025", the word "microcredit" in the fifth bullet point of Sub-section 4 of Section III of Appendix 1 shall be replaced with the word "microfinance".

2. In the Decree of the President of the Republic of Uzbekistan dated August 18, 2020 No. PF-6042 "On Additional Measures to Further Develop Export and Investment Potential in the Republic":

a) it shall be supplemented with the following fifth bullet point:

"allowing the linkage of rent payments in lease contracts for commercial buildings within the framework of investment projects for the construction of large shopping and entertainment centers with an investment amount of more than 200 million US dollars and a leased area of more than 70 thousand square meters to foreign currencies and conditional units. In this regard, rent payments shall be made in the national currency at the exchange rate set by the Central Bank";

b) the fifth and sixth bullet points shall be considered the sixth and seventh bullet points, respectively.

3. In the Resolution of the President of the Republic of Uzbekistan dated January 3, 2007 No. PQ-553 "On Measures to Implement the Investment Project 'Equipping the Housing Fund of the Republic of Uzbekistan with Cold and Hot Water Metering Devices'":

a) the third and fourth bullet points from paragraph 4 shall be deleted;

b) in paragraph 7:

• the fourth bullet point shall be deleted;
• the fifth bullet point shall be considered the fourth bullet point;
• the fourth bullet point shall be stated in the following edition:

"personal responsibility shall be imposed for the timely repayment of funds from the population for the installation of water metering nodes";

c) the words "funds accumulated in special purpose accounts" shall be deleted from the "explanations" section of Appendix 1;

d) the word "spec." shall be deleted from Note 8 in the Russian language text of Appendix 3.

4. The second bullet point from paragraph 8 of the Resolution of the President of the Republic of Uzbekistan dated July 15, 2013 No. PQ-2001 "On Measures to Implement the Project 'Improving Drinking Water Supply to the Aloy and Qorako'l Districts of Bukhara Region' with the Participation of the International Development Association" shall be deleted.

5. The third bullet point from paragraph 7 of the Resolution of the President of the Republic of Uzbekistan dated March 28, 2014 No. PQ-2156 "On Measures to Implement the Project 'Restoration of the Amu-Bukhara Irrigation System' with the Participation of the Asian Development Bank" shall be deleted.

6. The third bullet point from paragraph 5 of the Resolution of the President of the Republic of Uzbekistan dated April 7, 2015 No. PQ-2332 "On Measures to Implement the Project 'Improving Water Resources Management in Surkhandarya Region (Restoration of the Khazarbog-Aqqapchiq Canal System)' with the Participation of the Islamic Development Bank" shall be deleted.

7. In the Resolution of the President of the Republic of Uzbekistan dated November 22, 2016 No. PQ-2660 "On Measures to Implement the Program for the Construction and Reconstruction of Affordable Multi-Apartment Houses in Cities for 2017-2020":

a) the words "by opening special purpose accounts (22626)" shall be deleted from the fifth bullet point of paragraph 4;

b) paragraph 6 shall be declared invalid.

8. In sub-paragraph "b" of paragraph 10 of the Resolution of the President of the Republic of Uzbekistan dated March 29, 2018 No. PQ-3638 "On Additional Measures to Continue the Implementation of the Investment Project 'Construction of the Tashkent Metallurgical Plant'":

• in the first bullet point, the words "'Uzbekenergo' JSC and its construction organizations" shall be replaced with the words "'Regional Electric Networks' JSC and enterprises within its structure";
• in the third bullet point, the words "regional departments of the State Committee of the Republic of Uzbekistan on Land Resources, Geodesy, Cartography and State Cadastre" shall be replaced with the words "regional departments of the Cadastre Agency under the Ministry of Economy and Finance".

9. The words "No. 22626 'Target Funds of Enterprises and Organizations' financing special" shall be deleted from the fourth and fifth bullet points of paragraph 4 of the Resolution of the President of the Republic of Uzbekistan dated September 10, 2018 No. PQ-3937 "On Measures to Implement the Project 'Development of Engineering Infrastructure in Rural Areas for Individual Housing Construction on Sample Projects' with the Participation of the Kuwaiti Fund for Arab Economic Development".

10. In the Resolution of the President of the Republic of Uzbekistan dated October 13, 2020 No. PQ-4862 "On Improving the System of Involving the Population in Entrepreneurship and Additional Measures to Develop Entrepreneurship":

a) in paragraph 3:

• in the second bullet point, the words "non-state educational organizations" shall be replaced with the words "non-state educational organizations, vocational schools, colleges and technical schools (hereinafter - professional education institutions), the Higher School of Business and Entrepreneurship and its regional branches";
• the third bullet point shall be supplemented after the words "non-state educational organizations" with the words "professional education institutions, the Higher School of Business and Entrepreneurship and its regional branches";

b) in paragraph 4:

• the first bullet point shall be supplemented after the words "Higher School of Business and Entrepreneurship" with the words "and the Ministry of Higher Education, Science and Innovation";
• the second bullet point shall be supplemented after the words "non-state educational organizations" with the words "professional education institutions, the Higher School of Business and Entrepreneurship and its regional branches";

c) the first bullet point of paragraph 5 shall be supplemented after the words "non-state educational organizations" with the words "professional education institutions, the Higher School of Business and Entrepreneurship and its regional branches";

d) the fourth bullet point of paragraph 6 shall be supplemented after the words "non-state educational organizations" with the words ", professional education institutions, the Higher School of Business and Entrepreneurship and its regional branches";

e) the fifth bullet point of paragraph 8 shall be supplemented after the words "non-state educational organizations" with the words "professional education institutions, the Higher School of Business and Entrepreneurship and its regional branches";

f) in the fourth bullet point of paragraph 13, the word "microcredit" shall be replaced with the word "microfinance";

g) in the first and fourth bullet points of paragraph 14, the word "microcredit" shall be replaced with the word "microfinance".

11. The fourth bullet point of sub-paragraph "b" of paragraph 4 of the Resolution of the President of the Republic of Uzbekistan dated June 19, 2021 No. PQ-5152 "On Further Improving the System of Management of Multi-Apartment Housing" shall be stated in the following edition:

"covered by 30 percent of owners".

2. The Resolution of the President of the Republic of Uzbekistan dated April 19, 2010 No. PQ-1325 "On Additional Measures to Encourage the Development of the Payment System Using Bank Plastic Cards".

3. Position 6 of Appendix 2 to the Resolution of the President of the Republic of Uzbekistan dated October 30, 2012 No. PQ-1843 "On Additional Measures to Further Increase the Efficiency of the Activity of the Information and Communication System of the State Tax Service Agencies of the Republic of Uzbekistan".

4. Paragraph 1 of the Resolution of the President of the Republic of Uzbekistan dated September 12, 2017 No. PQ-3270 "On Additional Measures to Further Develop and Increase the Stability of the Banking System of the Republic".

5.
