Resolution of the Cabinet of Ministers of the Republic of Uzbekistan

On Amendments and Additions to Certain Resolutions of the Government of the Republic of Uzbekistan, as well as on Recognizing Some as Invalid (Regarding the Resolution of the President of the Republic of Uzbekistan No. PQ-2164 of April 15, 2014 "On Measures to Further Improve Regulations Related to Conducting Business Activities and Providing State Services")

In accordance with the Resolution of the President of the Republic of Uzbekistan No. PQ-2164 of April 15, 2014 "On Measures to Further Improve Regulations Related to Conducting Business Activities and Providing State Services", with the aim of further liberalizing business activities, reducing and lowering the cost of permitting regulations, and eliminating excessive bureaucratic barriers, the Cabinet of Ministers resolves:

1. Amendments and additions shall be made to certain resolutions of the Government of the Republic of Uzbekistan in accordance with Appendix 1 to this Resolution.

2. Certain resolutions of the Government of the Republic of Uzbekistan shall be recognized as having lost their force in accordance with Appendix 2 to this Resolution.

3. Ministries and departments shall align the normative legal acts adopted by them with this Resolution within one month.

4. Control over the execution of this Resolution shall be entrusted to the First Deputy Prime Minister of the Republic of Uzbekistan R.S. Azimov.

24. In the Resolution of the Cabinet of Ministers of the Republic of Uzbekistan No. 508 of October 28, 2004 "On Rational Use of Biological Resources, Strengthening Control Over Their Import into and Export from the Republic of Uzbekistan" (Collection of Legislation of the Republic of Uzbekistan, 2004, No. 10, Article 102):

a) In Appendix 1:

Item 18 shall be stated in the following edition:

"18. Permits for the import into and export from the Republic of Uzbekistan of wild plants and their parts are issued by the State Committee for Nature Protection of the Republic of Uzbekistan.

Permits for the import into and export from the territory of the Republic of Uzbekistan of samples of plant species included in Appendices I, II and III of the Convention on International Trade in Endangered Species of Wild Fauna and Flora (CITES) are issued by the CITES Administrative Authority in Uzbekistan (State Biological Control of the State Committee for Nature Protection) to legal and physical persons, except for the objects of the plant world specified in the first sub-item of this paragraph.";

The words "Import and Export of Plant World Objects" in Item 20 shall be replaced with the words "Import and Export of Wild Plants and Their Parts";

The words "Import and Export of Plant World Objects" in the first sub-item of Item 21 shall be replaced with the words "Import and Export of Wild Plants and Their Parts";

Item 22 shall be stated in the following edition:

"22. The following payments are collected for issuing permits for the export of wild plants and their parts:

For one unit of a plant included in the Red Book of the Republic of Uzbekistan, as well as for botanical collections of these plant species — 5 percent of the value of the permit to pick these plants;

For one kilogram of raw materials of wild plants not included in the Red Book of the Republic of Uzbekistan (except for naked rhubarb) — 10 percent of the value of the permit to harvest this plant species for citizens of the Republic of Uzbekistan — legal and physical persons;

For 1 ton of naked rhubarb raw materials (HS code 121190850 0) — 225 US dollars at the exchange rate of the Central Bank of the Republic of Uzbekistan on the day of payment for citizens of the Republic of Uzbekistan — legal and physical persons for issuing a permit to export naked rhubarb.

No payment is collected for issuing a permit for the import of wild plants and their parts.";

Item 23 shall be stated in the following edition:

"23. A permit for the import and export of wild plants and their parts, or a reasoned refusal to issue such a permit, is sent to the applicant within 15 days from the day the application was submitted.";

The words "Import and Export of Plant World Objects" in the first sub-item of Item 24 shall be replaced with the words "Import and Export of Wild Plants and Their Parts";

28. In the Railway Charter of the Republic of Uzbekistan, approved by the Resolution of the Cabinet of Ministers of the Republic of Uzbekistan No. 232 of October 23, 2008 (Collection of Legislation of the Republic of Uzbekistan, 2008, No. 10, Article 58):

a) In Item 76:

The second and third sub-items shall be replaced with the following second sub-item:

"Construction and reconstruction of railways connected to general railway networks or underground railway networks, as well as the production of facilities intended for loading, unloading, and cleaning wagons and containers, shall be carried out according to a project approved by the regional railway head based on the order of the railway head.
