Decree of the President of the Republic of Uzbekistan
On Approval of the Concept for Improving Lawmaking Activities
In accordance with the Strategy of Actions on Five Priority Areas of Development of the Republic of Uzbekistan for 2017–2021 (hereinafter referred to as the Strategy of Actions), one of the key tasks for improving the system of state and public construction is defined as a fundamental improvement in the quality of lawmaking activities, aimed at strengthening the influence of adopted laws on the course of socio-political, socio-economic, and judicial-legal reforms.
At the same time, the successful implementation of the planned large-scale reforms depends to a significant extent on the legislative framework formed over the past years, as well as the quality of the lawmaking process.
Existing shortcomings in this area lead to the continuation of negative practices of fragmented regulation of social relations in various fields, which becomes the cause of legal collisions, divergent interpretations, and difficulties in law enforcement.
Today's realities require an operational response to systemic problems, the lack of resolution of which is reflected in the reforms being carried out in the country. However, the lawmaking approach applied in this regard does not take into account the need to assess the impact of legislative acts on the country's economic sectors and does not ensure the achievement of tasks to improve the lives and well-being of citizens, taking into account public opinion.
Along with this, the predominance of framework laws, as well as the adoption of individual decisions without a specific mechanism for their implementation, negatively affects the development of the state and society as a whole, leading to the regulation of social relations primarily by subordinate acts.
In order to form a systematic legislative base, improve the legal support for the reforms being carried out, and consistently implement the tasks defined by the Strategy of Actions:
a) to the Chambers of the Oliy Majlis of the Republic of Uzbekistan jointly with the Cabinet of Ministers to develop a unified methodology for the legal and technical design of draft normative legal acts, as well as information and analytical materials attached to them, within three months;
b) to the Supreme Court jointly with the Ministry of Justice of the Republic of Uzbekistan within three months:
Establish the Commission for the Implementation of the Concept for Improving Lawmaking Activities (hereinafter referred to as the Commission) in the composition according to Appendix No. 3.
To the Commission (N. Ismailov):
a) ensure the high-quality development and submission in the established order of draft normative legal acts aimed at implementing the Concept and the Plan of Practical Measures;
b) organize within the framework of implementing the Concept meetings, seminars, "round tables", and press conferences with the wide involvement of representatives of civil society institutions, mass media, scientific circles, and foreign experts;
c) within one month, submit proposals on organizing a continuous inventory of the legislative base and a review of normative legal acts for the purpose of:
d) within two months, submit proposals on determining a specific list of departmental normative legal acts adopted by each department, providing for a phased narrowing and exclusion of powers with the transfer of norms contained in them to acts of legislation of higher legal force and the application of the "regulatory guillotine" method to the remaining acts, including within the framework of the ongoing systematization of legislation;
e) within two months, ensure the formation of an accessible unified list of proposals and recommendations of international organizations, requirements of international treaties that need to be considered, as well as requirements that must be strictly observed and cannot be excluded from the legal framework, for use in conducting the systematization of legislation.

b) the modernization of the National Legislative Database of the Republic of Uzbekistan, including by:
To the Ministry of Information Technologies and Communications of the Republic of Uzbekistan: ensure the integration of the "Legislative Impact Assessment System" portal into the Unified Electronic System for the Development and Coordination of Draft Normative Legal Acts as an integral part of it.
To the Ministry of Higher and Secondary Special Education jointly with the Academy of Sciences and the Ministry of Information Technologies and Communications of the Republic of Uzbekistan, by February 1, 2019, create an accessible online information system containing proposals for improving legislation, developed as a result of scientific and analytical activities of representatives of scientific and expert circles, students of higher educational institutions, and candidates for scientific degrees, ensuring its constant updating.
To the Ministry of Justice of the Republic of Uzbekistan:
To the Institute of Legislative Problems and Parliamentary Research under the Oliy Majlis of the Republic of Uzbekistan to provide scientific, methodological, and information-analytical assistance to responsible bodies and organizations in the preparation of draft normative legal acts provided for in the Plan of Practical Measures.
To the Ministry of Foreign Affairs of the Republic of Uzbekistan to assist the Commission in organizing the study of legislation and law enforcement practice of advanced foreign countries in the field of lawmaking, involving, if necessary, representatives of foreign (international) organizations.
Place control over the execution of this Decree on the Prime Minister of the Republic of Uzbekistan A.N. Aripov and the First Deputy State Advisor of the President of the Republic of Uzbekistan B.M. Mavlonov.

CONCEPT for improving lawmaking activities
The dynamic development of legislation, associated with changes in a number of spheres of public life, has led to the emergence of a large number of norms, sometimes contradicting current legislation.
This circumstance necessitates a fundamental review of the entire array of legislation to achieve the set goals and tasks of the reforms being carried out.
I. Systematization of the Legislative Base, Ensuring Stability of Legal Regulation of Social Relations
Clear distinction of the grounds for adoption and the subject of regulation of normative legal acts in order to determine the specific type of act necessary for regulating a particular social relation.
Improvement of the classification of normative legal acts based on their functional purpose, procedure for adoption, and legal consequences of their action.
Systematization and codification of normative legal acts regulating relations in specific spheres, taking into account the maximum reduction of departmental normative legal acts, review of framework, inactive, and legislation acts that do not affect law enforcement, and elimination of unjustified restrictions, excessive administrative procedures, and outdated regulation mechanisms.
Ensuring the functioning in practice of the principle of sufficiency of grounds for adopting regulatory decisions, according to which state regulatory intervention is permitted only if other measures (administrative procedures, management decisions, judicial review) cannot resolve the corresponding problem and its necessity is properly based, including on the basis of studying and analyzing appeals, results of public opinion polls, and gaps in current legislation.
Restriction of lawmaking powers of departments by clearly defining the list of jurisdictions of each of them, the regulation of which is associated with the adoption of normative legal acts, providing for a phased narrowing and exclusion of powers to adopt departmental normative legal acts.
Ensuring the compliance of the legal framework of the Republic of Uzbekistan with generally recognized principles of international law and norms of international treaties.
Introduction of effective mechanisms for adopting laws of direct action.
Improvement of the process of adopting resolutions of the Plenum of the Supreme Court regarding the explanation of the application of legislation with the definition of the boundaries of their application, the procedure for appeals to the Constitutional Court of the Republic of Uzbekistan, as well as the introduction of a mechanism for appealing acts of explanation and interpretation.
II. Improving the Quality of Processes for Developing and Adopting Normative Legal Acts, as well as Improving Monitoring of Their Implementation
Improvement of the procedure for initiating, developing, and adopting normative legal acts, as well as monitoring their implementation, providing for the introduction of conceptually new mechanisms ensuring quality, transparency, systematization, coordination, and public involvement.
Creation of an effective mechanism for monitoring and control by the Constitutional Court of the compliance of norms of adopted normative legal acts, interstate contractual, and other obligations of the Republic of Uzbekistan with the Constitution of the Republic of Uzbekistan and the urgent adoption of a decision aimed at repealing adopted acts and decisions contradicting its norms, with the introduction of an effective order for the execution of its decisions.
Increasing the level of influence of public discussions on the lawmaking process by organizing effective work on involving citizens, institutions of civil society, mass media, subjects of entrepreneurship, and representatives of science in this process.
Implementation of an effective system for evaluating the lawmaking activities of agencies based on the quality of the draft regulatory legal acts developed, the success of their implementation, as well as the benefits and costs (including losses and damages) incurred by citizens and business entities as a result of inefficient regulation. IV. Application in lawmaking of elements of the "smart regulation" model
