The Central Bank of Uzbekistan approves the Instruction regulating the procedures for resident and non-resident legal entities, individuals, and individual entrepreneurs to open, maintain, and close various types of bank accounts, including demand deposit, savings, time deposit, metal, escrow, and agency accounts. The regulation mandates that banks open accounts for residents on the next business day following document submission, while non-residents must be served within fifteen days, and prohibits banks from requiring additional documents beyond those specified. It establishes strict anti-money laundering and counter-terrorist financing (AML/CFT) requirements, including mandatory customer due diligence for crypto-asset exchange participants, and permits remote account opening for specific entities when identification conditions are met.

RESOLUTION OF THE BOARD OF THE CENTRAL BANK OF THE REPUBLIC OF UZBEKISTON
On Approval of the Instruction on the Procedure for Opening, Maintaining, and Closing Bank Accounts

In accordance with the Law of the Republic of Uzbekistan "On the Central Bank of the Republic of Uzbekistan", the Board of the Central Bank of the Republic of Uzbekistan resolves:
Approve the Instruction on the Procedure for Opening, Maintaining, and Closing Bank Accounts in accordance with Appendix 1.
Recognize as invalid certain departmental normative legal acts in accordance with Appendix 2.
This Resolution has been coordinated with the Representative for the Protection of the Rights and Legitimate Interests of Business Entities under the President of the Republic of Uzbekistan and the Chamber of Commerce and Industry of the Republic of Uzbekistan.
This Resolution enters into force from the date of its official publication.
Paragraph 1, first sub-paragraph of Appendix 1 to this Resolution enters into force on May 1, 2023.

Instruction on the Procedure for Opening, Maintaining, and Closing Bank Accounts
This Instruction establishes the procedure for banks to open, maintain, and close bank accounts for resident and non-resident legal entities and individuals, including individuals carrying out entrepreneurial activity without forming a legal entity (hereinafter referred to individually as individual entrepreneurs), peasant (farmer) farms, and representative offices and branches of legal entities.
Chapter 1. General Provisions
bank account — an account opened by the bank for the client in accordance with the contract, whereby the bank undertakes to accept and credit funds falling into the client's account, execute instructions for transferring and disbursing relevant funds from the client's account, and carry out other operations related to the account;
demand deposit account — a bank account for accounting funds that are payable or transferable upon the client's first request;
savings deposit account — a bank account for accounting funds formed based on periodic contributions by clients, accumulated for a specific purpose, directed to that purpose, or returned as a result of contract termination;
time deposit account — a bank account for accounting funds deposited by clients for a strictly agreed term in the contract;
metal account — an account opened by banks to carry out operations with precious metals and account for them for clients; [See previous edition.]

National Information Database of Bank Depositors (hereinafter referred to as NIDBD) — an information database maintained by the Information and Analytics Center of the Central Bank, which ensures the issuance of a unique number (client code) to clients when banks open bank accounts, maintains a list of their accounts without storing information on balance amounts, and provides access to information about clients' relevant accounts.

Organizations subject to treasury execution may open bank accounts at banks without opening a main account for the purpose of accounting for proceeds from payment terminals, cash payments, savings and time deposits, funds in bank corporate cards, and special purpose funds, as well as in other cases provided for by legislation. Information regarding the opening, transfer to another bank, closing, temporary suspension of withdrawal of funds, and restoration of bank accounts in the NIDBD is formed based on electronic requests sent by banks and transmitted on the same day by the Information and Analytics Center of the Central Bank to banks serving the client and the State Tax Committee of the Republic of Uzbekistan. This information is entered into the bank's database software and cannot be modified by the bank. When clients open bank accounts, a bank account contract (a contract for bank deposits of individuals, a contract on agency relations for agency accounts) (hereinafter referred to as the contract) is concluded.
Contracts between the bank and its clients may be concluded in written form, electronic form, or by confirming an offer contract through remote service systems.
The contract establishes the terms for the bank to credit funds to the client's bank account and withdraw them, execute the client's instructions regarding the disposal of funds in the bank account, the rights and obligations of the client and the bank in this regard, the amount of intermediary fees payable for bank services, and other terms.
Banks are prohibited from requiring business entities to affix seals to documents or certify documents with seals.
The procedure for opening, maintaining, and closing bank accounts (credit loans, leasing, transit, etc.) for services not specified in Paragraph 2 of this Instruction but related to providing bank services to clients is regulated by the bank's internal documents.
Banks must open bank accounts for non-resident individuals and legal entities without delay within fifteen days after all documents specified in this Instruction are submitted to the bank, except for cases indicated in legislation. [See previous edition.]
Documents for opening bank accounts are submitted by persons whose signature samples are indicated on the signature specimen sheet, or by persons authorized by legal entities. Exceptions apply to cases where bank accounts are opened remotely for legal entities whose founders are residents of the Republic of Uzbekistan, individual entrepreneurs, and legal entities residing in IT-Park with a non-resident founder. Banks are prohibited from requiring additional documents other than those specified in this Instruction.
Clients are responsible for the authenticity of the documents submitted for opening a bank account.
When opening bank accounts for non-resident legal entities who are participants in crypto-asset trading on crypto-exchanges, banks must examine such non-resident legal entities and the sources of origin of funds credited to their accounts in accordance with the "Know Your Customer" (KYC, e-KYC, and/or video-KYC) and "Combating the Legalization of Income Obtained from Criminal Activities and Financing of Terrorism" (AML/CFT) systems. Opening a bank account remotely for business entities during the state registration process is carried out through the Automated System for State Registration and Accounting of Business Entities or by accepting the offer of a bank account contract posted on the bank's official website. When bank accounts are opened remotely for legal entities whose founders are residents of the Republic of Uzbekistan, individual entrepreneurs, and legal entities residing in IT-Park with a non-resident founder, persons authorized to make payments (bank transactions) on their behalf are identified in the prescribed manner, and if their electronic digital signature or handwritten signature samples are obtained through electronic devices, a paper signature specimen sheet is not required. Bank accounts in foreign currencies for which official exchange rates against the sum are established by the Central Bank of the Republic of Uzbekistan may be opened for non-resident legal entities who are participants in crypto-asset trading on crypto-exchanges. [See previous edition.]
Individuals registering as self-employed individuals submit, in addition to the documents specified in the first sub-paragraph of this paragraph, the original of the certificate confirming their registration as self-employed individuals or its electronic form issued through the Unified Interactive State Services Portal of the Republic of Uzbekistan and/or the "Social Card" mobile application.
Non-resident individuals must submit to the bank an application for opening a bank account, the original or electronic copy of the document certifying the identity of the non-resident individual (biometric passport or identification ID card or driver's license of the new sample), and a document confirming the presence (residence) of the non-resident individual in the Republic of Uzbekistan. Exceptions apply to foreign specialists who are residents of IT-Park and have obtained a Personal Identification Number (PIN) through diplomatic missions (consular institutions) of the Republic of Uzbekistan abroad, where remote opening of bank accounts is possible using digital identification (Face-ID) or relying on the bank's "Know Your Customer" (KYC, e-KYC and/or video-KYC) and "Anti-Money Laundering/Combating the Financing of Terrorism" (AML/CFT) systems.
Banks may require documents confirming that non-resident individuals are registered for a permanent (not less than three months) period and are engaged in activity in the Republic of Uzbekistan (information regarding permanent or temporary registration in the Republic of Uzbekistan, documents confirming employment or study, and documents confirming sources of income).
Foreign specialists who are residents of IT-Park and have obtained a Personal Identification Number (PIN) through diplomatic missions (consular institutions) of the Republic of Uzbekistan abroad may open bank accounts remotely.
If a non-resident individual has previously opened a bank account at a specific bank, they may open other bank accounts at that same bank remotely.
Non-resident individuals who have obtained a special tax regime must additionally submit to the bank a decision on the provision of the special tax regime.
Deposit accounts for resident and non-resident individuals are opened based on the Personal Identification Number (PIN). 17 1 . For opening deposits and metal accounts in national and foreign currencies in the name of a minor under fourteen years old, an application for opening an account must be submitted by one of the parents or their substitute (legal representative). The original or electronic form provided through the Single Interactive State Services Portal of the Republic of Uzbekistan and/or the "Social Card" mobile application of the minor's identity document (birth certificate) and the original or electronic form provided through the Single Interactive State Services Portal of the Republic of Uzbekistan and/or the "Social Card" mobile application of the identity document of one of the parents or their substitute (legal representative) (biometric passport or identification ID card or driver's license of the new sample) must be submitted.
In cases where the personal identification number (PIN) of the individual is not indicated in the identity document of the minor, information about the individual's personal identification number must also be submitted.
17 2 . Minors aged from fourteen to eighteen years may independently open the accounts specified in paragraph 17 1 of this Instruction. In this case, these individuals personally submit an application to the bank for opening an account and the original or electronic form provided through the Single Interactive State Services Portal of the Republic of Uzbekistan and/or the "Social Card" mobile application of their identity document (birth certificate, biometric passport or identification ID card or driver's license of the new sample), except in cases of digital identification of customers.
The bank account contract for minor individuals must stipulate that the bank informs one of the parents or their substitutes (legal representatives) about suspicious operations related to their underage children.
17 3 . Deposit accounts may be opened in the name of an interested child for the purpose of accumulating pensions, allowances, alimony, and other payments payable to orphaned or deprived children of parental care raised (placed) in orphanages, Children's Houses, "Muruvvat" children's boarding houses, branches of the "SOS - Uzbekistan Children Villages" association, small-sized children's homes, foster families, and other fully state-supported institutions or other organizations, upon appeal from the "Human" Social Services Center.
Deposit accounts may be opened in the name of an interested child for pensions, allowances, and alimony payable to a child placed in "Muruvvat" children's boarding houses who is not an orphan or deprived of parental care, upon appeal by one of the parents or their substitutes (legal representatives). The use of funds accumulated in the account is determined by the contract for opening the account. When a bank account is opened for a resident individual through digital identification, submission of a document certifying the individual's identity is not required, and documents serving as the basis for opening the bank account are stored in electronic form.
Legal entities and individual entrepreneurs submit an application for opening secondary, savings and time deposit, and metal accounts at the servicing bank. This application may also be submitted in electronic form.
Legal entities and individual entrepreneurs must submit the documents envisaged for opening the main account when opening secondary, savings and time deposit, and metal accounts at other banks.
Reorganized legal entities submit the documents specified in this chapter of this Instruction for opening main and secondary accounts.
Special purpose accounts to which enforcement proceedings cannot be applied, in accordance with legislation, are opened based on the application of economic operators and in accordance with the relevant resolution of the Cabinet of Ministers of the Republic of Uzbekistan. See previous edition.
When a bank opens a representation account at the Central Bank or another bank, and also when an organization authorized to open representation accounts opens a representation account at the Central Bank, a contract is concluded between them regarding mutual representation relations. Chapter 3. Procedure for Maintaining Bank Accounts
The sheet with specimen signatures must contain the following:
the name (surname, name, patronymic) of the customer;
the surname, name, patronymic of persons granted signature authority and their personally affixed signatures;
in cases where legislation requires the presence of a seal for legal entities — the impression of the seal.
Other information may also be included in the sheet with specimen signatures in accordance with the bank's internal documents. See previous edition.
Banks may identify resident individuals indicated in the sheet with specimen signatures through digital identification when remotely opening bank accounts for legal entities whose founders are residents of the Republic of Uzbekistan, individual entrepreneurs, and legal entities that are residents of IT-Park but have a non-resident founder. Signature specimens must be affixed by the bank customer themselves. A facsimile signature of a disabled person may be used only if the disabled person does not have the opportunity to sign documents with their own hand due to physical disabilities.
Signatures of persons granted signature authority are affixed with the participation of a bank employee, except in cases of remote opening of bank accounts.
If one of the persons authorized by the head temporarily changes, a supplementary sheet with the specimen signature of the temporarily authorized person and the validity period is submitted. This supplementary sheet is signed and sealed by the head (sealing is not required for subjects of entrepreneurial activity).
An impression of the main seal of the legal entity or the seal of the legal entity's branch or representative office must be affixed to the sheet with specimen signatures. Use of seals for separate purposes ("For Packages", "For Permits", "For Office", "For Information", "For Certificates", etc.) unrelated to payment documents is not permitted.
When the seal is replaced or lost, a deadline is given by the bank's authorized employee for preparing the seal based on the petition signed by persons with first and second signature rights. This deadline may not exceed thirty calendar days. At the same time, the bank's authorized employee (chief accountant or their deputy) determines the procedure for processing payment documents without a seal, allowing documents to be submitted without a seal impression depending on the situation.
The requirements of this paragraph do not apply to subjects of entrepreneurial activity.
The owner of the bank account must notify the servicing bank in writing or electronically within five working days of any change in their address.
Resident legal entities that are not business entities and budget-funded organizations, representative offices and branches of resident legal entities, and non-resident legal entities must submit copies of amendments and additions made to their founding documents (founding agreement, charter) to the bank within three working days if the information specified in the founding documents (founders, members, or other information) changes.
Operations on a bank account may be suspended only by order of the bank account owner or by decision of an official, investigator, or investigator of the body conducting pre-trial investigation, or according to a court ruling, as well as in other cases envisaged by legislation. In such cases, funds are frozen only up to the amount specified in the decision or ruling.
Suspension of operations on accounts of subjects of entrepreneurial activity at banks is carried out in court order, except in cases envisaged by legislation.
Requests for temporary suspension of withdrawal operations from all bank accounts are formed only by the bank that opened the main deposit account, in cases envisaged by legislation.
Customers may obtain information about all their bank accounts opened at other banks through the bank where they opened their main account.
In accordance with the requirements of the Law of the Republic of Uzbekistan "On Insolvency", procedures for pre-bankruptcy sanation, external management, and liquidation are applied to debtor legal entities and individual entrepreneurs, and accordingly, the status of a special account for pre-bankruptcy sanation or a single account for settlement with creditors is assigned to their main account.
The procedure for using a special account for pre-bankruptcy sanation or a single account for settlement with creditors, based on the requirements of this law, is regulated by legislative acts.
Chapter 4. Procedure for Transferring the Main Account to Another Bank and Closing Bank Accounts
The customer returns checkbooks and payment terminals (if available) to the bank, submits an application for transferring the main account to another bank, and submits a payment order for transferring the balance of funds in the main account to account 29801 — "Settlements with Customers" at the bank where the main account is being opened.
The bank transferring the main account to another bank forms a request to BDMAAB for transferring the main account to another bank after executing the customer's payment order for transferring the balance of funds to account 29801 — "Settlements with Customers". This request remains active for three working days. If the main account is not opened within this period, the bank closing the main account re-forms the request.
After funds are credited to account 29801 — "Settlements with Customers" at the bank where the main account is being opened, a new main account is opened. In this case, funds in account 29801 — "Settlements with Customers" are transferred to the main account by the bank via a memorandum order, and account 29801 — "Settlements with Customers" is closed.
When the customer's main account is transferred to another bank, their secondary accounts are not closed, and all information outside the control key of the main account remains unchanged.
After incoming payments and execution documents related to the transferred main account are registered, they are returned indicating the name of the bank (branch) where the new main account was opened.
In this case, no application is required to close these accounts.
Bank accounts may also be closed if the contract is terminated through the court.
Entrepreneurial subjects that have entered a state of inactivity without carrying out financial and economic activity, as recorded by the registering authority, are considered to have terminated their contract from the day they are removed from the state register.
Closure of bank accounts of entrepreneurial subjects undergoing voluntary liquidation and/or not carrying out financial and economic activity is carried out in accordance with Resolution No. 704 dated August 21, 2019 of the Cabinet of Ministers of the Republic of Uzbekistan "On Approval of Regulations on the Procedure for Voluntary Liquidation of Entrepreneurial Subjects and Suspension of Their Activities and Removal of Entrepreneurial Subjects Not Carrying Out Financial and Economic Activity from the State Register".
Closure of bank accounts of non-governmental non-profit organizations during their liquidation is carried out in accordance with the Regulation on the Procedure for Liquidation of Non-Governmental Non-Profit Organizations approved by Resolution No. 5 dated January 15, 2015 of the Cabinet of Ministers of the Republic of Uzbekistan.
For closure of activities of economic operators not envisaged in paragraphs 43 and 44 of this Instruction, and cessation of activity of individual entrepreneurs, they must apply to the servicing bank with an application and return unused checks and payment terminals (if available). Before closing the main account of these subjects, all secondary accounts opened for them are closed based on their application.
Before closing the main account of these subjects, the existence of tax debt is checked through the interdepartmental integration platform of the "Electronic Government" system. If tax debt exists, closing the main account is not permitted.
If there are debts under contracts entered into the Unified Electronic Information System for Foreign Trade Operations of economic operators, the main account is closed in the prescribed manner after such debts are written off in accordance with Resolution No. 216 dated April 14, 2021 of the Cabinet of Ministers of the Republic of Uzbekistan "On Approval of the Regulation on the Procedure for Writing Off Hopeless Debts from the Unified Electronic Information System for Foreign Trade Operations".
The bank account is closed after the remaining balance of funds, free from all submitted claims of the customer, is transferred to another account based on the instruction of the customer (liquidator).
