In accordance with the Civil Code of the Republic of Uzbekistan, the Ministry of Defense of the Republic of Uzbekistan and the Board of the Central Bank resolve:

  1. Approve the Regulation on the Procedure for Transferring Part of the Monetary Allowance of Conscripted Military Personnel of the Ministry of Defense of the Republic of Uzbekistan to Savings Accounts Opened in the Joint-Stock Commercial Halk Bank of the Republic of Uzbekistan, attached hereto.

  2. This resolution enters into force from the date of its official publication.

On the Procedure for Transferring Part of the Monetary Allowance of Conscripted Military Personnel of the Ministry of Defense of the Republic of Uzbekistan to Savings Accounts Opened in the Joint-Stock Commercial Halk Bank of the Republic of Uzbekistan

This Regulation establishes the procedure for transferring part of the monetary allowance of conscripted military personnel of the Ministry of Defense of the Republic of Uzbekistan to savings accounts of the Joint-Stock Commercial Halk Bank of the Republic of Uzbekistan, in accordance with the Civil Code of the Republic of Uzbekistan.

Chapter 1. General Provisions

  1. The following terms are used in this Regulation:

conscript — a person who is required to be drafted for military service and is registered with district (city) draft offices;

military serviceman — a person performing actual military service by draft in ranks of ordinary soldiers;

military unit — a subdivision of the Ministry of Defense where a conscripted military personnel performs actual military service by draft (including institutions and subdivisions operating on economic accounting); [See previous edition].

monetary allowance of a military serviceman — all types of monetary payments (bonuses) paid by the state, regardless of the sources of financing (republican budget, funds in the special account "Mobilization Call Reserve Funds" of the Ministry of Economy and Finance, and other sources not prohibited by legislative acts), in connection with the performance of military service (fulfillment of service duties) according to norms and procedures established by legislative acts; [The fifth paragraph of item 1 was edited by Order No. 18-mh dated August 13, 2024 of the Minister of Justice of the Republic of Uzbekistan (registration number 3552, dated 15.08.2024) — , dated 19.08.2024, No. 10/24/3552/0630]

savings account — a savings deposit account opened for conscripts for a term of 12 months;

AT Halk Bank — Joint-Stock Commercial Halk Bank of the Republic of Uzbekistan.

Chapter 2. Opening and Closing of Savings Accounts

  1. District (city) departments of defense affairs allocate a separate room to responsible employees of the branch of AT Halk Bank to organize the opening of a savings account for the conscript.

District (city) departments of defense affairs ensure that the conscript arrives at the draft point two days before departure to the military unit to open a savings account.

The formalization and signing of bank deposit contracts between the conscript and AT Halk Bank are organized directly by the branches of AT Halk Bank at the relevant department of defense affairs at the place of the conscript's draft.

The conscript submits an application and passport to open a savings account. When opening a savings account, no initial funds are deposited by the conscript, and no intermediary fees are charged by AT Halk Bank.

  1. The savings booklet is a document issued by AT Halk Bank that confirms in writing the operations performed on the deposit and guarantees the obligations assumed on the deposit.

  2. The cover of the savings booklet must indicate the full name and logo (trademark) of AT Halk Bank; the inside cover must indicate the series and number of the savings booklet; the first page of the inside must indicate the series and number of the savings booklet, the name of the branch of AT Halk Bank, its address (postal address), the surname, first name, and patronymic of the depositor, a 20-digit personal account number, the currency type, the type of deposit (name, annual interest rate, term, and other terms), the surname, first name, and patronymic of the controller, chief accountant, and branch manager, their signatures, and a place for the branch seal.

  3. The amount of the interest rate on the savings account is set by AT Halk Bank in accordance with the Law of the Republic of Uzbekistan "On Banks and Banking Activity."

By January 10 of each year, as well as with each change in the deposit interest rate, AT Halk Bank notifies the Ministry of Defense of the Republic of Uzbekistan in writing about this.

  1. The conscript must keep the bank deposit contract concluded with AT Halk Bank, the savings booklet, and their copies during the period of conscripted military service.

  2. The heads of district (city) departments of defense affairs personally verify that a savings account has been opened for each conscript, that a bank deposit contract has been concluded with AT Halk Bank, that copies thereof are available, and conduct explanatory work on the procedure for paying monetary allowances among conscripts before sending them to their places of service.

  3. A military serviceman may not close the savings account until being released to the reserve.

After a military serviceman is released to the reserve (reserves), based on his application, the funds in the savings account and the interest due are transferred to a plastic card opened in the name of the deposit owner at AT Halk Bank in the prescribed manner. In this case, no fees are charged for opening plastic cards.

It is strictly prohibited to transfer the deposit amount to plastic cards of other persons, as well as to plastic cards opened by the deposit owner in other banks. [See previous edition].

  1. In cases where a military serviceman is granted leave in accordance with legislative acts due to the serious illness or death of a close relative, the funds in the savings account or part thereof may be withdrawn by the military serviceman to a plastic card in advance. Chapter 3. Transfer of Part of the Monetary Allowance of a Military Serviceman to a Savings Account

  1. The percentage amount of the monetary allowance of a military serviceman to be transferred to the savings account is determined by the order of the Minister of Defense of the Republic of Uzbekistan.

  2. Upon arrival at the military unit, the military serviceman submits a statement in the prescribed manner to the command of the military unit regarding the transfer of part of the monetary allowance to his savings account and the payment of the remaining amount in cash.

  3. The military serviceman attaches copies of the bank deposit contract and the savings booklet to his statement.

  4. Based on the results of reviewing the statements of military servicemen, the commander of the military unit issues an order indicating the rank, surname, first name, and patronymic (without abbreviations) of the military serviceman, the amount of money to be transferred to the savings account, the name of the bank branch where the savings account was opened, and the savings account numbers.

  5. The command of the military unit is prohibited from transferring the funds of military servicemen to savings accounts opened in banks other than AT Halk Bank.

  6. For the purpose of preserving information and ensuring confidentiality, civilian employees of all military units performing military service open account numbers at the branches of AT Halk Bank to serve plastic cards.

No fees are charged by AT Halk Bank branches for opening plastic cards for civilian employees of military units. [See previous edition].

  1. Based on the order of the commander of the military unit, the economy and finance body of the military unit transfers a payment order to the branch of AT Halk Bank at the location of the military unit by the 10th of each month for the payment of salaries of civilian employees and part of the monetary allowance of military servicemen. A registry (indicating the MFO of the AT Halk Bank branch, surname, first name, and patronymic (without abbreviations), 20-digit personal account number, amount of money to be transferred, and date) is attached to the payment order.

The registry sent by the military unit to the AT Halk Bank branch does not indicate the ranks of either civilian employees or military servicemen. It is strictly prohibited to create and submit separate registries for civilian employees and military servicemen. The total amount of money is indicated on each page of the registry; each page of the registry is signed by the commander of the military unit and the head of the economy and finance body of the military unit and certified with the seal of the military unit.   1. Based on the registries submitted by the military unit, the branches of AT Halk Bank ensure the transfer of the corresponding amounts of money to the accounts indicated in the registry within three banking days. [See previous edition].

The economy and finance body of the military unit records notes on the transfer of funds to savings accounts based on the registry and copies from the savings account of the military serviceman at the branch of AT Halk Bank into the copies of the savings booklets of the military servicemen each month.   1. In cases where discrepancies are identified between the registry submitted by the military unit and the accounting information of the branches of AT Halk Bank, the transferred funds are returned by the branches of AT Halk Bank to the military unit that carried out the transfer of funds without delay, but not later than two banking days (indicating the surname, first name, and patronymic (without abbreviations), the amount of money to be transferred, and the reasons for return). The economy and finance body of the military unit checks the completeness of the funds returned by the branches of AT Halk Bank and the correspondence of the amount of money to the submitted registry. After identified deficiencies are eliminated within the period until the end of the month, the amount of money is transferred to the branch of AT Halk Bank at the location of the military unit.   1. A fine is collected from the owner of the savings booklet or plastic card in accordance with the tariffs of AT Halk Bank for their loss.

  2. The maintenance of savings accounts opened at AT Halk Bank for the transfer of monetary allowances of military servicemen is carried out in accordance with the Instructions on the Procedure for Conducting Deposit Operations by Banks of the Republic of Uzbekistan (registration number 2711, August 26, 2015).

Chapter 4. Final Provisions

  1. Responsibility for organizing the timely conclusion of bank deposit contracts and the availability of copies of bank deposit contracts and savings booklets lies with the heads of district (city) departments of defense affairs; responsibility for the timely and full transfer of funds to the account numbers of the branches of AT Halk Bank and preventing the transfer of funds to other banks lies with the command of the military unit.

  2. Responsibility for the correct maintenance of savings accounts, the full calculation of interest, and the timely performance of operations on them lies with the heads of the branches of AT Halk Bank.

  3. In accordance with the request sent by the Ministry of Defense of the Republic of Uzbekistan to AT Halk Bank and with the permission of the Board of AT Halk Bank, the Control and Inspection Directorate of the Ministry of Defense of the Republic of Uzbekistan may conduct inspections of operations performed on savings accounts at the branches of AT Halk Bank within the established period.   4. Once every quarter, by the 15th of the next reporting month, a reconciliation is carried out by the branch of AT Halk Bank and the economy and finance body of the military unit regarding the funds transferred for deposit into savings accounts, and an appropriate act is drawn up.   5. This Regulation has been agreed upon with the Ministry of Finance of the Republic of Uzbekistan and AT Halk Bank.
