On Measures for Fundamental Improvement of Urbanization Processes

The Decree establishes a new housing policy to activate urbanization by leveraging mortgage lending and private investment, while guaranteeing private ownership rights for land plots under residential and non-residential buildings. It mandates the privatization of these land plots through state service centers or the Unified Interactive State Services Portal, with the Cabinet of Ministers required to submit a draft law on this matter within two months and approve tiered payment amounts by June 1, 2019. The Ministry of Economic Development and Poverty Reduction is tasked with developing a 2030 Urbanization Development Concept by July 1, 2019, and the Central Bank must introduce a new lending system by April 1, 2019, that abolishes the mandatory requirement for borrowers to register at the lending bank.

On Measures for Fundamental Improvement of Urbanization Processes

Within the framework of ongoing structural reforms, the urbanization process has not been taken into account to the appropriate extent as a leading factor in increasing the well-being of the urban population and sustainable development, alongside the implementation of major strategic investment projects. As a result, a downward trend in the level of urbanization has been observed in recent years, and the number of urban populated areas has increased from only 1,065 to 1,071.

Despite the measures taken to transform large rural populated areas into urban-type settlements, the current level of urbanization does not meet modern requirements for the comprehensive development of cities and lags significantly behind global trends. In this regard, the level of urbanization remains unstable.

  1. The following are established as the main directions for the fundamental improvement of urbanization processes in the country:
  • activation of urbanization processes based on the implementation of an absolutely new housing policy, including the provision of special measures to support investments aimed at constructing affordable housing for low- and middle-income families, using mechanisms for engineering, transport and social infrastructure provision, mortgage lending, and attracting financial resources of business entities;

  • guaranteeing the right of physical and legal persons to exercise ownership rights over land plots under residential and non-residential buildings and structures, and creating conditions for bringing land plots into civil circulation;

  • creating conditions for the free movement of the population from rural areas to cities by improving the system of administrative regulation of migration processes;

  • assisting in ensuring full and effective employment of the population of these cities by ensuring the well-being of the population of large cities and expanding the use of economic and industrial resources, as well as organizing and strengthening the system of technoparks based on higher education institutions and research institutes in the regions;

  • wide introduction of advanced international experience in managing medium-sized cities, including district centers, taking into account the use of the advantages of agglomerations, primarily by increasing the income of the population and creating sustainable jobs in the industrial, service and sectors;

  • expanding the network of satellite cities adjacent to large cities and having convenient transport links, while reducing the territories of industrial and other zones in the central part of large cities and expanding the territories of socio-business zones.

  1. The following procedure is established, according to which:
  • legal and physical persons have the right to privatize the relevant land plots in accordance with the legislation on the basis of permanent use (ownership), lease, or lifetime ownership rights inherited;

  • the privatization of the specified land plots is carried out on the basis of applications from physical and legal persons through State Service Centers or the Unified Interactive State Services Portal;

  • privatized land plots are objects of private property and civil circulation, the right of private ownership to which is inviolable and is protected by the state in accordance with the Law of the Republic of Uzbekistan "On Protection of Private Property and Guarantees of Property Owners' Rights";

  • the privatization of land plots is carried out only if the right to them is registered in the state register and the purchase price of the land plot to be privatized is paid in the amounts determined by the Cabinet of Ministers. The Cabinet of Ministers of the Republic of Uzbekistan:

  • within two months, submit to the Legislative Chamber of the Oliy Majlis of the Republic of Uzbekistan the draft Law of the Republic of Uzbekistan "On Privatization of Land Plots Not Intended for Agriculture";

  • adopt a government decision establishing the amounts of tiered payments for land plots to be privatized, as well as the procedure for their payment, by June 1, 2019. See previous edition.
  1. The Ministry of Economic Development and Poverty Reduction of the Republic of Uzbekistan, together with interested ministries and departments, and also involving local and foreign experts, shall submit to the President of the Republic of Uzbekistan a draft decree on the approval of the Concept of Development of Urbanization in the Republic of Uzbekistan until July 1, 2019, in the established order, which envisages the organization of new cities and satellite cities, including through the construction of complex housing, by July 1, 2019.   • long-term planning of the pace, stages and results of industrialization policy, analysis of long-term demographic trends in cities and villages, and calculation of the demographic capacity of cities and their need for labor force under conditions of rapid industrialization;

  • identification of "growth poles", selection of management centers, coordination of policies in the fields of education, labor market formation, internal and external migration;

  • development of a comprehensive program of measures to encourage the movement of the labor force from villages to cities, which envisages the establishment of a number of institutional and organizational measures aimed at training and retraining the rural population in new industrial specialties;

  • management of the formation of city agglomerations, taking into account the construction of satellite cities that cover social, engineering-communicational and road-transport infrastructure, based on the introduction of advanced, energy-saving, ecologically clean technologies and materials;

  • regulation of the comprehensive development of the system of urban population settlement, taking into world practice, and the formation of an effective ratio of small, medium, large and major cities.   1. The Ministry of Economic Development and Poverty Reduction of the Republic of Uzbekistan, together with the Ministry of Construction, "UzbekgorodstroyLITI" CJSC, "TashkentGorplanLITI" CJSC and "QishloqQurilishloyiha" LLC, shall ensure the inventory of populated areas adjacent to large cities for the purpose of identifying natural and economic potential, and on the basis of the results of the work carried out, form a list of populated areas to be transformed into satellite cities in the medium term, taking into account the implementation of a systematic urbanization process by November 1, 2019, and the comprehensive settlement of new industrial enterprises with social and production infrastructure objects.   2. The State Committee of the Republic of Uzbekistan on Statistics and the Agency shall ensure the improvement of accounting of the urban population and statistical reporting, based on the results of the planned census work and the methodology for calculating the level of urbanization according to international requirements.   3. The Ministry of Construction of the Republic of Uzbekistan, together with the Agency, the Cabinet of Ministers of the Karakalpakstan Republic, regional and Tashkent city Khokimiyats, and interested departments, shall submit in the established order a draft decree of the President of the Republic of Uzbekistan on the approval of the main forecast parameters of state programs for complex housing construction for 2020 - 2025 by June 1, 2019, which shall envisage:

  • conducting an inventory with the subsequent transfer to the Fund of vacant land plots, territories of residential buildings unsuitable for living, as well as unused or inefficiently used buildings and structures, for their subsequent infrastructural development and sale;

  • gradual approval of existing state programs for housing construction being implemented in accordance with previously adopted decisions of the President and Government of the Republic of Uzbekistan, directing freed funds within the framework of state programs for complex housing construction to the construction of relevant housing;

  • financing state programs for complex housing construction with appropriate sources of funding, construction material resources, and the capacity of contracting construction organizations;

  • establishing a mandatory requirement to equip and supply a certain part of the buildings and structures being constructed only with alternative energy sources. [ OKOZ:

It is established that vacant land plots, territories of residential buildings unsuitable for living, as well as unused or inefficiently used buildings and structures transferred to the Fund are considered privatized and may be sold to builders in the future in the established order.   1. It is established that the Agency:
  • together with the State Committee of the Republic of Uzbekistan on Land Resources, Geodesy, Cartography and State Cadastre, identifies land plots not intended for agriculture in accordance with the master plans of relevant territories and populated areas for the implementation of the Concept;

  • together with interested ministries and departments, ensures control over the placement of necessary engineering, transport and social infrastructure on land plots specified within the framework of the Concept. [ OKOZ:

  1. The "Roadmap" for ensuring the regulation of urbanization in the Republic of Uzbekistan is approved in accordance with the Appendix.

The Cabinet of Ministers shall regularly submit information on the implementation status of this "Roadmap" to the departments of the Advisor to the President of the Republic of Uzbekistan on Coordinating Legal Support of Reforms and Law Enforcement Activities every quarter.

  1. The Central Bank of the Republic of Uzbekistan, together with commercial banks, shall develop and introduce a new lending system by April 1, 2019, which abolishes the requirement for mandatory registration at the place of applying to the bank for business, consumer, mortgage and other loans.   2. The Ministry of Economic Development and Poverty Reduction of the Republic of Uzbekistan, together with interested ministries and departments, shall ensure a deep study of the indicators of the most important international ratings and indicators in the field of urbanization, their formation methodologies, and submit proposals for improving the position of the Republic of Uzbekistan in the specified ratings, by attracting independent consultants and experts on a contractual basis, technical assistance funds and grants within three months.   3. The Ministry of Economy and Industry of the Republic of Uzbekistan and the Ministry of Justice shall, within two months, submit to the Cabinet of Ministers:

  • a draft government decision on the establishment of the Activity of the Urbanization Development Fund under the Ministry of Economy and Industry of the Republic of Uzbekistan, including the sources of formation of its funds and the procedure for their use;

  • proposals on amendments and additions to legislative acts arising from this Decree.

  1. It is recommended that the National Television and Radio Broadcasting Company of Uzbekistan, the Press and Information Agency of Uzbekistan, and mass media widely cover the essence of this Decree and the implementation of the measures established therein.

  2. Control over the implementation of this Decree is entrusted to the Prime Minister of the Republic of Uzbekistan A.N. Aripov, the Head of the Administration of the President of the Republic of Uzbekistan Z.Sh. Nizomiddinov, and the First Deputy Advisor to the President of the Republic of Uzbekistan B.M. Mavlonov.
