On Measures for the Rapid Development of the Jewelry Industry in the Republic of Uzbekistan

Consistent efforts are being made in the country to restore and develop the local jewelry industry. The opportunity for producers to use precious metals has created the possibility of expanding the volume of locally produced jewelry products.

At the same time, the presence of systemic deficiencies in the sector is hindering the active attraction of investments, the modernization and establishment of capacities engaged in the production of high-quality jewelry products, and the expansion of exports of these products, negatively affecting the development of the industry.

In order to expand the production of high-quality and competitive jewelry products, actively attract foreign investment to the sector, comprehensively support local manufacturers in the preparation of competitive and quality jewelry items, and also create favorable conditions for the rapid development of the republic's jewelry industry: [OKON: 1. 09.00.00.00 Entrepreneurship and Economic Activity / 09.08.00.00 Purity Work.   1. The proposals of the Ministry of Economy and Industry of the Republic of Uzbekistan, the State Customs Committee, and the "Uzbekzargar sanoati" Association regarding the introduction of the following procedure starting from July 1, 2019, are approved:

Licensed local manufacturers producing jewelry items are granted the right to independently determine the purity of their own manufactured jewelry and other items made from precious metals and precious stones (hereinafter referred to as jewelry items) and apply purity mark traces in the prescribed form, provided that they stamp the manufacturer's registered personal trademark on the item, without mandatory application of the state purity mark.

In this regard, local manufacturers selling jewelry items that violate the marking and purity marking procedure and do not conform to the specified form are included in the registry of dishonest business entities in the jewelry industry, and measures of influence established by legislation, including suspension of the validity of a license or other permitting documents, are applied to them;

Individual entrepreneurs licensed for the production of jewelry items have the right to independently sell their manufactured products in retail, as well as the right to purchase from the population pieces of precious metals, precious stones, and items made from them for the purpose of manufacturing;

Legal entities with no state share in the charter capital or with a state share of less than 50 percent, as well as individual entrepreneurs, independently establish the procedure for spending, accounting, and storing precious metals and precious stones in production; See previous edition.

Physical persons are permitted to take out ready-made jewelry items made of silver weighing up to 200 grams and gold and other precious metals weighing up to 65 grams outside the customs territory of the Republic of Uzbekistan without filling out a passenger customs declaration; items exceeding these quantities are permitted to be taken out based on a passenger customs declaration; (The sixth sub-paragraph of paragraph 1 was edited by the Decree of the President of the Republic of Uzbekistan dated July 23, 2024 No. PF-104 — , 25.07.2024 y., 06/24/104/0551-no)

Retail trade of jewelry items is not considered an object of fee for the right to engage in retail trade of certain types of goods;

Business entities may mine precious and semi-precious stones within the framework of gold prospecting activities to supply jewelry manufacturers; See previous edition.

The rights and obligations envisaged by legislation, as well as the privileges and preferences established for members of the association, are applied to individual entrepreneurs who are members of the "Uzbekzargar sanoati" association.   1. Commercial banks and jewelry manufacturers are granted the following rights:

To purchase precious metals (gold and silver) in the form of measuring plates, as well as granules weighing 5 grams and more (recalculated to the net weight of precious metals) in national currency based on the morning fixing of the London Metal Exchange from "Navoiy MMC" DC and "Almalyk MMC" JSC;

To sell purchased precious metals to other jewelry manufacturers.

Taking into account the need to ensure the possibility of implementing this clause, the "Uzstandart" Agency, together with the "Uzbekzargar sanoati" Association, "Navoiy MMC" DC, and "Almalyk MMC" JSC, shall develop and approve the State Standard for measuring plates and granules of precious metals (gold and silver) within one month.   1. The Association of Banks of Uzbekistan, together with commercial banks, shall expand the practice of issuing short-term revolving (replenishable) credits for jewelry manufacturers to purchase precious metals.

  2. By July 1, 2022:

Turnover of precious metals and locally produced jewelry items shall be exempted from value-added tax and excise tax;

Precious and semi-precious stones imported into the Republic of Uzbekistan according to lists formed in the prescribed manner shall be exempted from customs payments (except for customs duties).

Deputy Prime Minister of the Republic of Uzbekistan - Minister of Finance Zh.A. Kuchkarov shall include the tax benefits envisaged in this clause in the new edition of the Draft Tax Code of the Republic of Uzbekistan. See previous edition.   1. The Comprehensive Program of Measures for the Development of the Jewelry Industry in the Republic of Uzbekistan for 2019–2023 is approved in accordance with Appendix 1.

  2. The Cabinet of Ministers of the Karakalpakstan Republic, Khokimiyats of regions and Tashkent city, together with the Ministry of Economy and Industry of the Republic of Uzbekistan and the "Uzbekzargar sanoati" Association, shall organize at least two modern jewelry trade-production centers in each region, and at least ten in Tashkent city, by the end of 2020. These centers must include a full process from the production of ready-made jewelry items to their sale, involving business entities.

The Cabinet of Ministers of the Republic of Uzbekistan shall, within two months, approve the schedule for organizing modern jewelry trade-production centers, indicating specific initiators, location addresses, financing sources, and volumes of jewelry production (sale), as well as adopt a government resolution providing for other necessary organizational measures for the organization of these centers.

The State Property Management Agency under the President of the Republic of Uzbekistan and the Ministry of Higher and Secondary Special Education, within one month, shall transfer objects to the "Uzbekzargar sanoati" Association for the organization of activities of jewelry trade-production centers in accordance with Appendix 2.

  1. Consent is given to the proposal of the "Uzbekzargar sanoati" Association, the Ministry of Economy and Industry of the Republic of Uzbekistan, and the Ministry of Finance regarding the establishment of a Jewelry Industry Development Fund (hereinafter referred to as the Fund) under the "Uzbekzargar sanoati" Association without forming a legal entity.   1. The following are designated as sources for forming the Fund's funds:

Funds in the amount of 5 billion soums from the State Budget of the Republic of Uzbekistan in 2019, and ensuring the necessary funds in 2020-2021 through receipts of no less than 50 percent of the fee for retail sales of gold jewelry when the State Budget of the Republic of Uzbekistan is formed;

Grants from international financial institutions and foreign government financial organizations;

  1. It is established that the funds of the Fund shall be used for the following:

Comprehensive support for jewelry manufacturers, including financing the development of pre-project and project documentation for promising investment projects;

Establishment of public control to prevent the sale of low-quality, counterfeit jewelry items in the consumer market, as well as their illegal circulation;

Organization of training centers for the preparation, retraining, and skills improvement of specialists in the jewelry industry;

Assistance in promoting local jewelry brands, including organizing jewelry exhibitions and fairs in the country and abroad, and ensuring broad participation of local manufacturers in such events;

Organization of branches (mini-laboratories) for analyzing and controlling the purity of precious metals and jewelry items carried out by business entities, under self-financing conditions;

Attraction of foreign consultants and experts in the jewelry industry, preparation, retraining, and skills improvement of members and employees of the "Uzbekzargar sanoati" Association;

  1. The State Purity Determination Chamber of the Precious Metals Agency under the Central Bank of the Republic of Uzbekistan (hereinafter referred to as the Purity Determination Chamber) is transferred to the jurisdiction of the Ministry of Finance of the Republic of Uzbekistan.

The Cabinet of Ministers of the Republic of Uzbekistan shall, within one month, adopt a government resolution on organizing the activities of the Purity Determination Chamber.   1. Business entities are granted the right, based on a license issued by the authorized state body, to engage in refining activity, including the following rights:

Participation in exchange trades for the purchase and sale of precious metals;

Purchase of precious metals from the population, including precious metals mined by gold prospecting methods, jewelry items, pieces, and waste generated during their production;

Opening branches for the purchase and sale of precious metals, including opening them in the territories of our country. See previous edition.

Starting from September 1, 2024, refining enterprises that are members of the "Uzbekzargar sanoati" Association are granted the right to purchase precious metals from "Almalyk MMC" JSC and "Navoiy MMC" AC directly under contracts with 100% advance payment, and subsequently sell them to jewelry manufacturers after bringing them to convenient forms and quantities.   1. It is established that wealth in the form of pieces of precious metals directed to state revenue, as well as wealth in the form of items made from precious metals, semi-precious and precious stones, and pearls, ownerless wealth, treasures, as well as wealth freely handed over to state revenue by owners (excluding archaeological and museum items or museum collections and items of cultural value) shall be sold to interested participants of the jewelry industry under the condition of prior full payment in the following manner:

Precious metals — at the morning fixing price of the London Metal Exchange and the exchange rate of the Central Bank of the Republic of Uzbekistan on the date of recording the payment receipt;

Semi-precious and precious stones, as well as pearls — based on valuation carried out in the prescribed manner by valuation organizations, with respective expenses covered by buyers.   1. The Ministry of Higher and Secondary Special Education of the Republic of Uzbekistan, based on the orders of the "Uzbekzargar sanoati" Association, shall ensure the preparation of personnel for the jewelry industry, as well as specialists in the jewelry industry at vocational colleges, by organizing separate groups in the direction of "Jewelry Design" at Tashkent State Technical University starting from the 2019/2020 academic year.   1. Starting from 2020, the practice of holding the annual international exhibition-trade "Uzbek Jewellery Fair" of modern equipment, technologies, and items of the jewelry industry shall be introduced, involving representatives of the jewelry industries of foreign countries, foreign investors, experts, and specialists.

The "Uzbekzargar sanoati" Association, together with the Ministry of Investment and Foreign Trade and the Ministry of Economy and Industry, shall submit a draft government resolution to the Cabinet of Ministers of the Republic of Uzbekistan within one month regarding the organization and holding of the exhibition-trade, taking into account the simplified procedure for the sale of jewelry items by legal entities and individual entrepreneurs at the organized exhibitions.

  1. The State Tax Committee, together with the Supreme Court, the Prosecutor General's Office, and the Ministry of Justice, shall, within one month, develop a draft normative-legal document providing for liability for violating the prescribed procedure for determining and applying purity marks, as well as for selling unmarked jewelry items, and submit it to the Cabinet of Ministers of the Republic of Uzbekistan, which provides for the following:

Financial penalty in the form of a fine of 50 percent of the value of the jewelry item, without confiscating the jewelry item, if the violation is committed for the first time;

Financial penalty in the form of confiscation of the jewelry item or a fine of 100 percent of its value, if this violation is repeated within one year.

  1. The Cabinet of Ministers of the Republic of Uzbekistan shall ensure the revision of the draft Law "On Precious Metals and Precious Stones" with direct effect within two months and provide for the following in it:

Complex legal regulation of relations in the sphere of circulation of precious metals and precious stones;

Improvement of the system for determining and applying purity marks to jewelry items, as well as procedures for controlling their quality, including using the state-private partnership mechanism;

Clear delimitation of the powers and responsibility of state bodies and other participants in the sphere of circulation of precious metals and precious stones;

Creation of favorable conditions and improvement of the competitive environment for attracting investments to the sector, including foreign investments.

  1. The State Tax Committee of the Republic of Uzbekistan, together with the Department for Combating Economic Crimes under the Prosecutor General's Office, the State Customs Committee, the Purity Determination Chamber, the "Uzbekzargar sanoati" Association, and other interested departments, shall, within one month, develop and approve a comprehensive plan of joint actions to curb illegal circulation of jewelry items, including preventing the retail sale of fake items that are improperly marked and lack purity marks.

  2. The "Uzbekzargar sanoati" Association, together with the National Television and Radio Broadcasting Company of the Republic of Uzbekistan and the Ministry of Economy and Industry, shall, within one month, conduct extensive explanatory work regarding the favorable opportunities created in the jewelry industry, the essence and content of adopted legislative acts.

  3. The State Committee for Geology and Mineral Resources of the Republic of Uzbekistan:

Within two months, survey existing deposits of precious and semi-precious stones in the republic for carrying out mining activities by gold prospecting methods;

Implement projects for the exploration of precious and semi-precious stones, taking into account their suitability for industrial needs of jewelry and decorative goods within the framework of the annual program for developing the mineral raw material base and recycling.

  1. The Ministry of Economy and Industry, together with the Ministry of Finance and the Antimonopoly Committee, shall, within two months, submit proposals to the Cabinet of Ministers of the Republic of Uzbekistan regarding the organization of a commodity exchange specialized for concluding contracts related to metals, based on studying international experience.

  2. The Cabinet of Ministers of the Republic of Uzbekistan, together with the Central Bank, shall, within two months, submit proposals on further increasing the efficiency of the activities of the Precious Metals Agency under the Central Bank, taking into account that some functions and powers of this agency regarding the regulation of the jewelry industry have been transferred to the Purity Determination Chamber. Annex 3 to the Decree of the President of the Republic of Uzbekistan No. PF-5721 dated May 18, 2019

Changes and additions to be made to certain documents of the President of the Republic of Uzbekistan

  • See previous edition. (Paragraph 1 lost its force based on the Decree of the President of the Republic of Uzbekistan No. PF-6066 dated September 22, 2020 — National Database of Legislation, 23.09.2020, 06/20/6066/1317)
  1. Paragraph 3 and the third line of the note of Annex 21 (Limited rates of local fees) of the Decision of the President of the Republic of Uzbekistan No. PQ-4086 dated December 26, 2018 "On the Forecast of Main Macroeconomic Indicators of the Republic of Uzbekistan for 2019, Parameters of the State Budget and Budget Projections for 2020-2021" shall be deleted.

  2. In the Decision of the President of the Republic of Uzbekistan No. PQ-3451 dated December 29, 2017 "On Measures to Simplify the Procedure for Exporting Goods Intended for Exhibition Events in Foreign Countries":

a) Paragraph 1 shall be stated in the following edition:

"1. Entrepreneurial entities are permitted to export goods intended for exhibition at exhibitions and fairs held in foreign countries with a value up to five thousand US dollars in equivalent, and for jewelry items up to fifty thousand US dollars in equivalent, without concluding an export contract and without formalizing a customs cargo declaration, in accordance with the cargo documents of the goods, excluding the goods listed in the annex to the Decision of the President of the Republic of Uzbekistan No. PQ-3351 dated November 3, 2017 'On Further Liberalization of Foreign Trade Activities and Support for Entrepreneurial Entities';

b) Paragraph 31 shall be supplemented with the following content:

"31. Entrepreneurial entities shall be held responsible for the return of unsold goods from exhibitions and fairs held in foreign countries, as well as for the full receipt of funds received from sales."

  1. Paragraph 2 of the Russian language text of the Decision of the President of the Republic of Uzbekistan No. PQ-3199 dated August 10, 2017 "On Measures for State Support for the Jewelry Industry" shall be stated in the following edition:

"2. It is established that the production of jewelry and other items made of precious metals (hereinafter referred to as jewelry items) by legal entities and individual entrepreneurs is carried out based on a license issued by the State Assay Chamber."
