On Measures to Ensure Reliable Protection of Private Property, Small Business and Private Entrepreneurship and to Eliminate Obstacles to Their Rapid Development

The Decree approves a program to protect private property and small business by increasing criminal liability for illegal interference and strengthening protection guarantees. It establishes that economic courts may suspend enforcement of regulatory body decisions upon complaint, mandates seizure of property only by court order for tax/customs violations, and grants sole proprietors the right to hire up to three employees under a fixed tax rate. Additionally, it creates unified 'one-stop-shop' centers for state services and directs the Prosecutor General to organize a 24/7 hotline for reporting violations.

On Measures to Ensure Reliable Protection of Private Property, Small Business and Private Entrepreneurship and to Eliminate Obstacles to Their Rapid Development

  1. The Program of Measures to Ensure Reliable Protection of Private Property, Small Business and Private Entrepreneurship and to Eliminate Obstacles to Their Rapid Development is approved in accordance with the Appendix, taking into account the following:

increasing the liability of officials of state, law enforcement, and supervisory bodies for illegal interference in entrepreneurial activity and hindering it, and violation of the rights of private property owners, up to criminal liability;

strengthening guarantees for the protection of private property and continuing the process of liberalizing administrative and criminal legislation regulating entrepreneurial activity;

further simplification of all types of registration, permitting and licensing procedures, as well as procedures related to the implementation of foreign economic activity;

creating the necessary conditions and opportunities for the rapid development of private property and private entrepreneurship, expanding the use of their material and credit resources, and improving the business environment.

Personal responsibility for the timely and high-quality implementation of the measures included in the Program is assigned to the responsible executors — the heads of the relevant ministries, departments, courts, law enforcement and supervisory bodies, and local state authority bodies. the activities of economic operators in relation to initiated criminal cases are carried out with the mandatory participation of lawyers engaged by the economic operator (except in cases where the economic operator refuses this right);

a criminal case is not initiated against a person who has committed for the first time a crime provided for in Article 184 of the Criminal Code of the Republic of Uzbekistan (evading payment of taxes or other mandatory payments), and who has fully compensated the damage caused to the state, and paid penalties and other types of financial sanctions within 30 days from the moment the crime was detected; such a person is released from liability. strengthens control over the implementation in practice of the norms adopted regarding guarantees of freedom of entrepreneurial activity, ensures the increase of mandatory liability, up to criminal liability, for officials of authorized supervisory, law enforcement, and authorized state bodies for violating the rights and legitimate interests of entrepreneurship entities;

by July 1, 2015, in cooperation with the Ministry of Information Technologies and Communications of the Republic of Uzbekistan, organizes a system for round-the-clock reception of appeals regarding unfounded interference by state, law enforcement, and supervisory bodies in the activities of small business and private entrepreneurship entities, hindering entrepreneurial activity, and violation of property owners' rights, based on the Unified Call Center of JSC "Uzbektelecom" and the "hotline" database of the Prosecutor General's Office, and takes legal measures against persons guilty of violating the legislation on guarantees of freedom of entrepreneurial activity.
