On Measures to Improve the Quality of Development and Implementation of Projects in the Field of Information and Communication Technologies within the "Electronic Government" System

The President of Uzbekistan approves a regulation establishing the "Center for Management of Electronic Government Projects" as the central body for the comprehensive expert review, approval, and post-implementation monitoring of ICT projects. The Center is mandated to review project passports and concepts within 7 and 15 working days respectively, determine project priorities based on strategic alignment and social-economic efficiency, and conduct mandatory expert reviews of technical specifications and tender documents for projects funded by the state budget or international financial institutions. A fee of 0.5% of the project's limited value (excluding VAT) is levied for these reviews, and systems lacking positive conclusions from the Ministry of Digital Technologies and the Cyber Security Center are prohibited from being put into operation or integrated into the "Digital Government" system.

In order to create effective and transparent mechanisms for the development and implementation of projects in the field of information and communication technologies within the "Electronic Government" system, to ensure the high-quality expertise of projects in this field, project and technical documentation, and in accordance with the Decree of the President of the Republic of Uzbekistan dated January 10, 2019, No. PF-5624 "On Further Improvement of the Activities of the National Agency for Project Management under the President of the Republic of Uzbekistan":

The Regulation on the procedure for the development and implementation of projects for the creation and introduction of interdepartmental and departmental information systems, databases, software products, and other projects in the field of information and communication technologies within the framework of the "Electronic Government" system and the development of the digital economy is approved according to the Appendix.

The scope of activities of the state institution "Center for Management of Electronic Government Projects" (hereinafter referred to as the Center) applies to state and economic management bodies, economic entities with a state share in the authorized capital of 50 percent and above, as well as to all projects implemented within the framework of the social and economic development programs of the Republic of Uzbekistan. The financing of the development, implementation, and support of projects from the state budget of the Republic of Uzbekistan, state target funds, funds of non-grant technical assistance (grants), and preferential loans of international financial institutions and foreign government financial organizations is carried out in agreement with the Center;

Starting from June 1, 2019, regardless of the value, the technical specifications and tender documents of projects are submitted to the Center for expertise, provided that the limited value of the project is determined based on preliminary calculations concluding the study of the average market level of price indicators. In this regard, the technical specifications and tender documents of projects are not coordinated and do not undergo expertise in the Ministry of Economy and Industry of the Republic of Uzbekistan;

permission is granted for the registration and introduction into practice of information systems and databases developed as a result of the implementation of projects in the "Unified Registry of Information Systems and Resources of Digital Government", after obtaining positive conclusions from the Ministry of Digital Technologies and the State Unitary Enterprise "Cyber Security Center" regarding the compliance of their technical specifications and information security requirements;

a fee is collected for the expertise of the technical specification or tender documents of the project in the amount of 0.5 percent of the limited value of the project (for tender documents — from the sum of each lot), excluding value-added tax, but not more than 100 times the base calculation amount. in performing assigned tasks, the Center cooperates with state and non-governmental organizations, including project institutes, engineering and consulting companies, educational and scientific institutions, as well as international, foreign, and local organizations.

  1. The Center is exempt from payment of all types of taxes and mandatory payments except for the unified social payment until January 1, 2022. The released funds are to be directed purposefully to strengthening the material and technical base, as well as to the material incentive of employees.

  1. The Agency shall ensure the equipping of the Center with furniture, computer equipment, communication tools, and other necessary material and technical resources within one month to effectively perform the assigned tasks.

  2. The Agency, together with interested ministries and departments, shall submit proposals within two months regarding changes and additions to legislative acts arising from this decree.

  3. Control over the implementation of this decree is entrusted to the Prime Minister of the Republic of Uzbekistan A.N. Aripov and the Head of the Administration of the President of the Republic of Uzbekistan Z.Sh. Nizomiddinov.

REGULATION

on the procedure for the development and implementation of projects for the creation and introduction of interdepartmental and departmental information systems, databases, software products, and other projects in the field of information and communication technologies within the framework of the "Electronic Government" system and the development of the digital economy

CHAPTER 1. General Provisions

  1. This Regulation establishes the procedure for the comprehensive expertise, approval, as well as coordination of implementation and post-implementation monitoring of interdepartmental and departmental information systems, databases, software products, and other projects (hereinafter referred to as projects) in the field of information and communication technologies implemented by state and economic management bodies, and economic entities with a state share in the authorized capital of 50 percent and above, within the framework of the "Electronic Government" system and the development of the digital economy, as well as the State Development Programs for the Development of the Republic of Uzbekistan.

  2. The following main concepts are used in this Regulation:

order — a document of a specified form containing the goals and objectives of the project, as well as its main parameters, and the grounds for the necessity of its implementation;

website — a specialized website on the Internet network that ensures the submission and posting of documents by initiators (customers), as well as the posting of information on the results of expertise of tender and technical documents;

project passport — a technical document of a specified form describing the volume and needs for funds necessary for the implementation of the project, the scope of organizational measures necessary for the implementation of the project, the preliminary assessment of efficiency in indicators expressed in dimensions, the expected results of the implementation of the project, and its main parameters;

project concept — a technical document developed in accordance with regulatory documents in the field of information and communication technologies, containing justified ways of developing the object of informatization, ensuring the step-by-step and systematic resolution of the tasks of the project initiator (customer);

technical specification — a technical document developed in accordance with regulatory documents in the field of information and communication technologies, specifying the requirements for decisions to be made during the development, implementation, and acceptance of the project;

technical documents — a set of documents (passport, concept, technical specification) used in the design, creation, and introduction (operation) of interdepartmental and departmental information systems, databases, information resources, software products, and other projects in the field of information and communication technologies;

tender documents — a collection of documents containing primary information about the organization and procedure of conducting the tender, as well as the qualification, technical, price, and other characteristics of the goods (works, services) put up for tender;

post-monitoring (post-implementation monitoring) — a set of measures for assessing the compliance of project parameters with its goals and objectives within a specified period after the completion of the project implementation;

electronic registry of projects (hereinafter referred to as the Registry) — an information resource created to ensure reliable information, control, accounting, efficient distribution and use of financial resources, and the implementation of a unified state policy and a unified technological approach in the formation and financing of projects.

  1. The development and introduction of projects, as well as the implementation of tasks related to their implementation, are carried out in the manner established by legislative acts.

  1. The development and introduction of projects are carried out in accordance with the scheme in Appendix 1 to this Regulation.

CHAPTER 2. Procedure for Coordinating the Project Passport and Concept

  1. Submission of the order to the Center is carried out by the initiator (customer) by mail or electronic communication, including through the website, with the attachment of the project passport in the form specified in Appendix 2 to this Regulation.

  2. The project passport is developed based on the preliminary inspection of the object of informatization and includes the following information:

the goals and objectives of the project;

general characteristics and parameters of the project;

expected results of the project;

estimated time for the implementation of the project;

preliminary assessment of efficiency in indicators expressed in dimensions;

initial value of the project and necessary organizational measures.

  1. The project passport is reviewed by the Center within seven working days from the date of receipt, taking into account the following requirements:

compliance with the goals and objectives of the unified state policy within the framework of the "Electronic Government" system and the development of the digital economy;

possibility of fulfilling the assigned tasks;

the impact of the implementation of the project on state information security;

compliance of the project with current standards and regulatory documents in the field of information and communication technologies.

  1. Based on the results of the review of the project passport, the Center sends a notification to the initiator (customer) in written or electronic form, including through the website, containing the following content:

a) about the appropriateness of implementing the project and conducting further detailed studies;

b) about recommendations for reworking, including postponing the deadlines for implementing the project;

c) about the inappropriateness of implementing the project, with substantiated reasons.

  1. If a notification is received about the appropriateness of implementing the project, the initiator (customer) develops a draft project concept and sends it to the Center for review and coordination by mail or electronic communication, including through the website.

  2. The initiator (customer) has the right to submit the project passport and concept to the Center simultaneously for review.

  3. No fee is charged for the review and coordination of the project passport and concept.

  4. The project concept provides for:

determination of the goals and objectives of the project;

study of advanced, including foreign, experience;

determination of further development directions of the project;

evaluation of resources necessary for the implementation and monitoring of the project, including ensuring information security;

determination of the initial value of the implementation of the project;

sources of financing the project;

evaluation of the expected efficiency from the implementation of the project;

evaluation of risks in the implementation of the project;

use of unified technological approaches;

determination of measures for the implementation of the project;

results of work on streamlining business processes within the framework of the implementation of projects;

prospects for the development and modernization of the project;

determination of estimated deadlines for the implementation of the project;

determination of the terms and procedure for evaluating the quality of acceptance of the project;

formation of important efficiency indicators of the implemented project, in particular social and economic indicators;

preliminary assessment of the project, justification of financial costs and revenues, alternative schemes and sources of financing, taking into account the impact of inflation on the implementation of the project, as well as evaluation of the financial efficiency and model of the implementation of the project.

  1. The project concept may be developed independently by the initiator (customer) or with the involvement of relevant organizations.

  2. The project concept is reviewed by the Center within fifteen working days from the date of its receipt, and in necessary cases, together with interested ministries and departments, including the Ministry of Digital Technologies and Communications of the Republic of Uzbekistan, the State Inspection for Control in the Field of Informatization and Telecommunications of the Republic of Uzbekistan, the Assistance Center, and the State Unitary Integrator for the Creation and Support of State Information Systems (hereinafter referred to as interested ministries and departments).

Interested ministries and departments send the relevant conclusion on the project concept to the Center within seven working days from the date of receipt of the concept.

  1. If there are objections to the draft concept or if the draft concept does not fully comply with clause 12 of this Regulation, the Center sends a notification to the initiator (customer) that the project concept needs to be reworked.

  2. The initiator (customer) submits the reworked documents on the project concept to the Center within fifteen working days from the date of receipt of the notification, together with a reference on the remarks.

  3. If objections are eliminated by the initiator (customer), the project concept is reviewed again within ten working days at the latest.

  4. When reviewing the reworked concept of the project, it is not permitted to give the initiator (customer) new grounds for objections, except for objections related to additional documents submitted within the framework of eliminating previously given deficiencies.

  5. The Center reviews the project concept on the following grounds:

its proper formalization and the availability of all necessary documents;

compliance with the project passport;

efficiency of organizational and functional parts;

possibilities of fulfilling the tasks assigned to the project and the proposed solution options;

necessity of reorganization and optimization of functional and operational processes;

compliance with current legislative acts of the Republic of Uzbekistan;

ensuring the implementation of a unified policy within the framework of the "Electronic Government" system and the development of the digital economy;

ensuring the application of a unified technological approach to the implementation of the project;

ensuring information security;

determination of the priority level of the project;

compliance of the project concept with clause 12 of this Regulation.

  1. Based on the results of the review of the project concept, taking into account the conclusions of interested ministries and departments, the Center sends a notification to the initiator (customer) in written or electronic form, including through the website, that the project has been entered into the Registry and its priority level has been determined.

  2. The priority of projects is determined by the Center taking into account the following:

compliance with the concept of development of the "Electronic Government" system and the Strategy for the Development of the National Digital Economy ("Digital Uzbekistan — 2030");

indicators of the analysis of social and economic efficiency, as well as the expected results of the implementation of the project;

compliance with the principles and main directions of the development of the "Electronic Government" system and the digital economy;

the application of a unified technological approach in the implementation, introduction, development, and further improvement of information and communication technologies within the framework of the "Electronic Government" system and the development of the digital economy;

execution of a state function or provision of a state service relevant to the interests of the majority of citizens, broad social layers of the population and (or) subjects of entrepreneurship;

the number of electronic services intended to be provided to the population and subjects of entrepreneurship as a result of the implementation of the project;

the number and volume of procedures and time reduced due to the implementation of the project;

the use of local developments in the field of software products and information systems;

attraction of credit funds of international financial institutions and (or) foreign government financial organizations;

the level of readiness of the project for implementation;

the amount of post-launch operation costs.

  1. The decision to recognize the project as a priority serves as the basis for future mandatory work for the implementation of the project, including the preparation of a technical specification and/or tender documents, and for the implementation of the project in the manner established by legislative acts.

  2. If the project is recognized as a priority, the initiator (customer) ensures the implementation of measures for the development of a technical specification and/or tender documents in the manner established by regulatory documents in the field of information and communication technologies.

  3. The initiator (customer) is not entitled to refuse the implementation of the project recognized as a priority.

CHAPTER 3. Expertise of the Technical Specification and/or Tender Documents

  1. The development of the technical specification and/or tender documents is carried out in accordance with the current legislation of the Republic of Uzbekistan.

The technical specification and/or tender documents may be developed independently by the initiator (customer) or with the involvement of relevant organizations.

  1. The technical specification and/or tender documents are submitted to the Center for expertise by mail or electronic communication, including through the website, in the form specified in Appendix 3 to this Regulation, with a completed order.

  2. The technical specification and/or tender documents are reviewed by the Center within thirty days from the date of their receipt, and in necessary cases, together with interested ministries and departments. Interested ministries and departments send their relevant conclusions to the Center within ten days.

Here, the Center, together with the Prosecutor General's Office of the Republic of Uzbekistan, conducts an expert review of the technical specifications for the design, creation, and modernization of information systems and resources of republican and local executive authority bodies, state institutions and enterprises, as well as joint-stock companies with a state share in the charter capital (charter capital) of 50 percent or more, for the presence of the "digital control" function.   • compliance with the project concept;

  • use of "Electronic Government" unique identifiers;

  • ability to generate open data sets;

  • ability to integrate with the interdepartmental integration platform of the "Electronic Government" system to ensure the provision of electronic state services based on the "single window" principle;

  • ability to further expand existing information systems, databases, information resources, software products, including hardware and software tools, by increasing new components, etc.;

  • ability to implement other organizational and technical measures within the framework of the "Electronic Government" system and the digital economy.

  1. The Center conducts an expert review of tender documents regarding the following:
  • compliance with the requirements of this Regulation;

  • their uniform application, excluding the possibility of different interpretations of names and terms;

  • compliance with the requirements established by legislation for tender participants (presence of a license, work experience, financial status, technical equipment, and other qualification requirements depending on the specific object of state procurement);

  • fairness and substantiation of technical and financial evaluation criteria;

  • elimination of reasons for which a positive conclusion was not issued when tender documents were resubmitted.

During the expert review of tender documents and/or the technical specification, other issues may also be considered, depending on the specific characteristics of the goods (works, services) being purchased, to ensure a complete and comprehensive review of the tender documents and/or technical specification.

  1. Taking into account the conclusions of interested ministries and departments, the Center sends a written or electronic expert conclusion (positive or regarding the need for revision) on the tender document and/or technical specification to the initiator (customer) via the website, including in the form specified in Appendix 4 of this Regulation.

  2. If a conclusion is issued regarding the need to revise the project, the initiator (customer) submits the revised technical specification and/or tender documents to the Center for repeated review together with a report on comments. No payment is collected for repeated review.

  3. The technical specification and/or tender document are reviewed repeatedly within a period not exceeding ten working days from the date of resubmission of the technical specification.

  4. When reviewing the revised technical specification and/or tender documents, the initiator (customer) is not allowed to raise objections on new grounds, except for objections related to additional documents submitted within the framework of eliminating previously stated deficiencies.

Chapter 4. Coordination and Launch of Project Implementation

  1. Project implementation is carried out in the manner established by legislation. See previous edition.

  2. The Center carries out work to ensure the effective, high-quality, and timely execution of the project during the coordination of project implementation.   3. The launch of the project is carried out by the acceptance commission of the initiator (customer), in which representatives of the Center must be included, and, if necessary, representatives of interested ministries and departments may be included.

  4. The acceptance commission prepares a conclusion on the compliance of the implemented project with the technical specification, as well as an acceptance-transfer certificate for the information systems developed, purchased, and commissioned within the framework of project implementation.

Chapter 5. Post-monitoring of the Project (Post-project Monitoring)

  1. Post-monitoring of the project is carried out by the Center for twelve months starting from the time the acceptance-transfer certificate is signed by the acceptance commission.

  2. Based on the results of post-monitoring and assessing the achievement of key performance indicators, one of the following decisions may be adopted:

a) the key performance indicators indicated in the project concept were achieved;

b) the project did not fully achieve key performance indicators, and its modernization is necessary;

c) the project did not achieve key performance indicators, and it is necessary to carry out organizational and technical measures for detailed analysis and elimination of deficiencies.

  1. Grounds for decommissioning the project include:

a) expiration of the project usage period, if such a period is established by normative legal acts;

b) inefficiency of project usage, including low efficiency of technical means and software, changes in legal regulation, adoption of management decisions, and the presence of other changes hindering project usage;

c) financial and economic inefficiency of project usage. See previous edition.

  1. If one or more reasons specified in Paragraph 40 of this Regulation exist, the Center submits a proposal to the Ministry of Information Technologies and Communication Development of the Republic of Uzbekistan regarding the decommissioning of the project. In this case, the Ministry considers the proposal in the established manner and, upon finding several reasons such as financial and economic inefficiency or inefficiency of project usage, including low efficiency of technical means and software, adopts a relevant decision on decommissioning the project.

The decision of the Ministry of Information Technologies and Communication Development of the Republic of Uzbekistan may be appealed to the court by the initiator (customer). Chapter 6. Final Provisions

  1. For the purpose of high-quality performance of assigned tasks, the Center has the right to request additional information and materials necessary for reviewing and expert examination of technical specifications and/or tender documents from the initiator (customer), as well as to attract specialists on a contractual basis from state and non-governmental organizations, project institutes, engineering and consulting companies, scientific and educational institutions, as well as international, foreign, and national organizations.

  2. Officials of the Center are responsible for coordinating the project passport and concept, conducting expert reviews of the technical and/or tender documents of the project, coordinating project implementation, and post-monitoring, and ensuring impartiality in these activities.

  3. The initiator (customer) is responsible for:

  • development of technical and/or tender documents in compliance with the requirements of this Regulation and other legislative acts of the Republic of Uzbekistan;

  • timely, high-quality, and reliable submission of documents, information, and data;

  • timely and high-quality implementation of the project;

  • ensuring information security;

  • compliance with the procedure and requirements of this Regulation and other legislative acts in the development and implementation of projects.
