Procedures for the Use of Supporting Professions in the Financial Services Sector

This Regulation of the Board of Commissioners of the Financial Services Authority (OJK) establishes procedures for the use of supporting professions in the financial services sector, implementing OJK Regulation Number 5 of 2025. COPY REGULATION OF THE BOARD OF COMMISSIONERS OF THE FINANCIAL SERVICES AUTHORITY OF THE REPUBLIC OF INDONESIA NUMBER 44/PADK.01/2025 CONCERNING PROCEDURES FOR THE USE OF SUPPORTING PROFESSIONS IN THE FINANCIAL SERVICES SECTOR BY THE GRACE OF GOD ALMIGHTY THE MEMBER OF THE BOARD OF COMMISSIONERS OF THE FINANCIAL SERVICES AUTHORITY, Considering: that to implement the provisions of Article 4 paragraph (5), Article 11, and Article 18 paragraph (3) of Financial Services Authority Regulation Number 5 of 2025 concerning Supporting Professions in the Financial Services Sector, it is necessary to stipulate the Regulation of the Member of the Board of Commissioners of the Financial Services Authority concerning Procedures for the Use of Supporting Professions in the Financial Services Sector; Recalling: 1. Law Number 21 of 2011 concerning the Financial Services Authority (State Gazette of the Republic of Indonesia Year 2011 Number 111, Supplement to the State Gazette of the Republic of Indonesia Number 5253) as amended by Law Number 4 of 2023 concerning the Development and Strengthening of the Financial Sector (State Gazette of the Republic of Indonesia Year 2023 Number 4, Supplement to the State Gazette of the Republic of Indonesia Number 6845); 2. Financial Services Authority Regulation Number 5 of 2025 concerning Supporting Professions in the Financial Services Sector (State Gazette of the Republic of Indonesia Year 2025 Number 10, Supplement to the State Gazette of the Republic of Indonesia Number 140); DECIDES: Stipulates: THE REGULATION OF THE MEMBER OF THE BOARD OF COMMISSIONERS OF THE FINANCIAL SERVICES AUTHORITY CONCERNING PROCEDURES FOR THE USE OF SUPPORTING PROFESSIONS IN THE FINANCIAL SERVICES SECTOR. Article 1 The provisions regarding the procedures for the use of supporting professions in the financial services sector as stipulated in: a. Appendix I which contains provisions for the administrative management of supporting professions in the financial services sector, professional education programs and continuous professional programs, submission of periodic activity reports of supporting professions in the financial services sector, and restrictions on service provision; and b. Appendix II which contains the format for submitting applications, notifications, and statements related to the administrative management activities of Supporting Professions in the integrated licensing and registration system

APPENDIX I REGULATION OF THE MEMBER OF THE BOARD OF COMMISSIONERS OF THE FINANCIAL SERVICES AUTHORITY OF THE REPUBLIC OF INDONESIA NUMBER 44/PADK.01/2025 CONCERNING PROCEDURES FOR THE USE OF SUPPORTING PROFESSIONS IN THE FINANCIAL SERVICES SECTOR

  • 2 - CHAPTER I DEFINITIONS AND SCOPE
  1. Definitions a. Financial Services Sector is the banking sector, capital market, financial derivatives, carbon exchange, insurance, guarantee, pension funds, financing institutions, venture capital companies, microfinance institutions, other financial services institutions, financial sector technology innovation, digital financial assets and crypto assets, which are regulated and supervised by the Financial Services Authority. b. Party is a party carrying out activities in the Financial Services Sector that is regulated and supervised by the Financial Services Authority, including financial services institutions and/or individuals or legal entities carrying out activities in the Financial Services Sector. c. Supporting Profession of the Financial Services Sector, hereinafter referred to as Supporting Profession, is a professional actor in the Financial Services Sector who provides professional services to various industries in the Financial Services Sector to support the effectiveness of the Financial Services Sector. d. Public Accountant is a person who has obtained a license to provide services as referred to in the Law concerning public accountants. e. Actuary is a public actuary who has obtained a license from the minister who administers government affairs in the field of finance to provide actuarial services to the public. f. Actuarial Consultant is an Actuary who works at an actuarial consulting firm. g. Legal Consultant is a legal expert who provides legal opinions to a Party. h. Valuation is the process of work to provide a written opinion on the economic value of an appraisal object in accordance with valuation standards. i. Public Appraiser is a person who has competence in carrying out Valuation activities and has obtained a license from the minister who administers government affairs in the field of finance. j. Notary is a Notary as referred to in the Law concerning the office of notary. k. Substitute Notary is a person temporarily appointed as a Notary to replace a Notary who is on leave, sick, or temporarily unable to perform their duties as a Notary Substitute as referred to in the Law concerning the office of Notary. l. Professional Education Program is an education program for Supporting Professions in order to meet competency and knowledge requirements in the Financial Services Sector, either as a requirement for initial registration with the Financial Services Authority, or for requirements for adding the scope of service provision in the Financial Services Sector. m. Continuous Professional Education, hereinafter referred to as CPE, is a continuous professional education and/or training for Supporting Professions aimed at maintaining competence. n. Professional Association is a professional organization that oversees financial services sector professionals.
  • 3 - o. Minister is the minister who oversees the ministry designated as the supervisor and overseer of Supporting Professions. p. Legal Consulting Firm, hereinafter abbreviated as LCF, is a civil partnership or firm that serves as a platform for Legal Consultants in carrying out their activities. q. Public Appraisal Services Firm, hereinafter abbreviated as PASF, is a business entity in the form of a partnership that has obtained a business license from the minister who administers government affairs in the field of finance as a platform for Public Appraisers in carrying out Valuation activities. r. Public Accounting Firm is a business entity established based on the provisions of laws and regulations and has obtained a business license in accordance with the Law concerning Public Accountants. s. State Official is a state official as referred to in the Law concerning state civil apparatus.
  1. To be able to provide services in the Financial Services Sector, a Supporting Profession must: a. have obtained a license or other equivalent form of license from the ministry, institution, and/or supervisory authority of the relevant Supporting Profession; and b. have been registered with the Financial Services Authority and recorded as active in the list of Supporting Professions at the Financial Services Authority.
  2. The use of Supporting Professions registered with the Financial Services Authority is carried out for services required by the provisions of laws and regulations in the Financial Services Sector and/or written instructions from the Financial Services Authority.
  3. The provision of services in the Financial Services Sector as referred to in point 2 is declared from the date of signing of the assignment agreement in the Financial Services Sector by the Supporting Profession and the Party and/or the letter of appointment by the Party to the Supporting Profession to provide services in the Financial Services Sector, for example: a. Appointment of a Public Accountant or Public Accounting Firm decided by the General Meeting of Shareholders; or b. Employment agreement between the Party and the Legal Consultant.
  • 4 - CHAPTER II USE OF SUPPORTING PROFESSIONS I. MANAGEMENT OF SUPPORTING PROFESSION ADMINISTRATION
  1. Activities in the administrative management of Supporting Professions registered with the Financial Services Authority include: a. registration of Supporting Professions; b. addition and reduction of the scope of service provision in the Financial Services Sector; c. addition and reduction of the scope of Valuation activities; d. submission of leave applications; e. notification of temporary inactivity in the event of appointment and/or designation as a State Official; f. registration of Substitute Notaries; g. reactivation from temporary inactive status; h. changes to Supporting Profession data and/or information; and i. resignation.
  2. Activities in the administrative management of Supporting Professions as referred to in point 1 are carried out as follows: a. Registration of Supporting Professions Applications for registration of Supporting Professions are submitted to the Financial Services Authority through the Financial Services Authority's integrated licensing and registration system by:
  1. filling out the registration application by including 1 (one) or more choices of Financial Services Sector in accordance with the format as stipulated in Appendix II CHAPTER I Part A which is an inseparable part of this Regulation of the Member of the Board of Commissioners of the Financial Services Authority; and
  2. uploading the following registration requirement documents: a) proof of license from the Minister or other equivalent form of license from the competent authority that is still valid; (1) for Public Accountants and/or Public Accounting Firms, upload proof of license from the minister who administers government affairs in the field of finance; (2) for Actuarial Consultants, upload proof of license as an Actuary from the minister who administers government affairs in the field of finance; (3) for Public Appraisers, upload proof of license as a Public Appraiser from the minister who administers government affairs in the field of finance, namely: (a) in the event that the Public Appraiser will operate in the capital market, financial derivatives, and carbon exchange sectors, the uploaded proof of license is proof of license with the classification of property Valuation services and/or business Valuation; (b) in the event that the Public Appraiser will operate in sectors other than the capital market, financial derivatives, and carbon exchange, the uploaded proof of license is proof of license in accordance with the Valuation services performed,
  • 5 - (4) For Notaries, upload the appointment decree and oath of office as a Notary from the minister who administers government affairs in the field of law; (5) For Legal Consultants, upload the appointment decree as an advocate from the competent authority in accordance with the Law concerning advocates; b) Proof of membership in a Professional Association; Professional Associations in the Financial Services Sector are associations that have been recognized by: (1) Law; (2) ministries, institutions, and/or supervisory authorities of Supporting Professions; and/or (3) the Financial Services Authority, for other professions whose licenses are issued by the Financial Services Authority. c) Latest curriculum vitae in accordance with the format as stipulated in Appendix II CHAPTER VII which is an inseparable part of this Regulation of the Member of the Board of Commissioners of the Financial Services Authority, which contains: (1) personal data; (2) professional assignment history; and (3) work experience history, for a maximum period of the last 3 (three) years in accordance with the scope of Supporting Profession services, along with the position in such work; d) Identity Card; e) Latest color passport photo with a size of 4x6 cm; f) Professional Education Program certificate issued by the Professional Education Program organizer in accordance with the chosen Financial Services Sector, obtained no later than 2 (two) years from the date of issuance of the Professional Education Program certificate; g) Supporting Profession registration statement signed on sufficient stamp duty as stipulated in Appendix II CHAPTER I Part C which is an inseparable part of this Regulation of the Member of the Board of Commissioners of the Financial Services Authority, stating that: (1) has never been subject to administrative sanctions in the form of license revocation, approval cancellation, and/or registration cancellation from the Financial Services Authority or previous authority; (2) has never been convicted of a criminal offense in the financial services sector; (3) is not listed in the list of non-performing loans and/or financing; (4) has never been and/or proven to be a party, either alone or with others, involved in money laundering including its predicate offenses, terrorism financing and proliferation financing of weapons of mass destruction and/or convicted of money laundering, terrorism financing, and

  • 6 - proliferation financing of weapons of mass destruction; and (5) does not hold multiple positions: (a) in another Supporting Profession firm; (b) as another Supporting Profession registered with the Financial Services Authority; and/or (c) as a holder of another position, which is prohibited by laws and regulations or codes of ethics from being held concurrently by the same person. Examples of provisions for holding multiple positions in another Supporting Profession firm that are prohibited by laws and regulations or codes of ethics from being held concurrently by the same person include: (a) if Legal Consultant A works in Legal Consulting Firm ABC, then Legal Consultant A cannot hold multiple positions in Legal Consulting Firm DEF; or (b) if Public Appraiser B works in Public Appraisal Services Firm GHI, then Public Appraiser B cannot hold multiple positions in Public Appraisal Services Firm JKL; (6) is not included as a party prohibited from being a main party in accordance with the Financial Services Authority Regulation concerning re-assessment for main parties of financial services institutions; (7) acts independently, objectively, and professionally in carrying out their duties; (8) maintains the confidentiality of data and information obtained in providing services to the Party in accordance with the provisions of laws and regulations; and (9) possesses and applies professional standards, quality control standards (quality management), and professional codes of ethics in the implementation of service provision as regulated in laws and regulations; and h) screenshot proof of registration in the reporting system application for the implementation of anti-money laundering and prevention of terrorism financing programs organized by the Financial Transaction Reports and Analysis Center, if the Supporting Profession is a reporting party as stipulated in the provisions of laws and regulations concerning the implementation of anti-money laundering and prevention of terrorism financing programs.

  1. For Legal Consultants who carry out activities in the capital market, financial derivatives, and carbon exchange sectors, in addition to filling out the registration application to the Financial Services Authority as referred to in point 1) and uploading the registration requirement documents as referred to in point 2), upload additional documents related to the LCF as follows: a) photocopy of the LCF establishment deed along with the latest amendments; b) photocopy of the taxpayer identification number in the name of the LCF; c) cooperation agreement between the Legal Consultant and a Legal Consultant who is a partner in another LCF regarding the transfer of responsibility if the Legal Consultant concerned is unable to perform their duties, for LCFs that only have 1 (one) Legal Consultant partner; d) LCF organizational chart showing the leadership, partner structure, middle supervisors, and executive staff; and e) statement with stamp duty signed by the leading partner of the LCF stating: (1) the LCF will carry out activities in accordance with the provisions of laws and regulations in the capital market, financial derivatives, and carbon exchange sectors and other regulations; (2) the leading partner of the LCF is responsible for the implementation of the quality control system (quality management) in the LCF concerned; and (3) the LCF is willing to undergo examination by the Financial Services Authority regarding the implementation of its work and the quality control system (quality management) in the LCF concerned, as stipulated in Appendix II CHAPTER I Part D which is an inseparable part of this Regulation of the Member of the Board of Commissioners of the Financial Services Authority.
  2. For Public Appraisers who carry out activities in the capital market, financial derivatives, and carbon exchange sectors, in addition to filling out the registration application to the Financial Services Authority as referred to in point 1) and uploading the registration requirement documents as referred to in point 2), upload additional documents as follows: a) recommendation letter from the Professional Association stating that the Public Appraiser has met the requirements set by the Professional Association and is deemed eligible to carry out activities in the capital market, financial derivatives, and carbon exchange in accordance with the scope of Valuation activities owned. In providing a recommendation letter to Public Appraisers in the capital market, financial derivatives, and carbon exchange sectors, the Public Appraiser Professional Association considers: (1) the Public Appraiser concerned has experience involved in the Valuation process for capital market, financial derivatives, and carbon exchange purposes for at least 3 (three) assignments in the last 3 (three) years; or (2) the Public Appraiser concerned has participated in professional education in the field of capital market, financial derivatives, and carbon exchange organized by the Professional Association within the last 24 (twenty-four) months. b) documents related to the PASF:
  • 8 - (1) photocopy of the PASF establishment deed along with the latest amendments; (2) photocopy of the business license from the minister who administers government affairs in the field of finance; (3) photocopy of the registered certificate of the leading partner as a Supporting Profession in the capital market, financial derivatives, and carbon exchange; (4) photocopy of the agreement with a Public Appraiser who has the same scope of Valuation activities from another PASF regarding the transfer of responsibility if the Public Appraiser of the PASF concerned is unable to perform their duties, in the event that the PASF concerned does not have 2 (two) Public Appraisers with the same scope of Valuation activities; (5) PASF organizational chart showing: (a) the structure of partners, middle supervisors, and executive staff, along with the names occupying these positions; and (b) in carrying out Valuation, the Public Appraiser applies at least 2 (two) levels of control, in the form of a Public Appraiser responsible for signing reports, and a middle supervisor who supervises the executive staff; (6) cooperation agreement documents with foreign PASFs or foreign appraisal organizations, if the PASF cooperates with foreign PASFs or foreign appraisal organizations; (7) photocopy of the PASF's taxpayer identification number; and (8) statement with stamp duty signed by the leading partner of the PASF, stating: (a) the PASF will carry out activities in accordance with the provisions of laws and regulations; (b) the leading partner of the PASF is responsible for the implementation of the quality control system (quality management) in the PASF concerned; and (c) the PASF is willing to undergo examination by the Financial Services Authority regarding the implementation of Valuation work and the quality control system (quality management) in the PASF concerned, as stipulated in Appendix II CHAPTER I Part E which is an inseparable part of this Regulation of the Member of the Board of Commissioners of the Financial Services Authority.
  1. In participating in professional education in the field of capital market, financial derivatives, and carbon exchange as referred to in point 4) letter a) point (2), the Public Appraiser must meet a certain number of professional credit units determined by the Professional Association. In determining the certain number of professional credit units, the Professional Association may first coordinate with the Financial Services Authority. b. Addition of Scope of Service Provision for Supporting Professions
  2. Public Appraiser a) The scope of service provision for Public Appraisers is: (1) capital market, financial derivatives, and carbon exchange sectors; and (2) sectors other than capital market, financial derivatives, and carbon exchange. b) Public Appraisers registered with the Financial Services Authority may submit an application for approval to add the scope of service provision in the Financial Services Sector at the Financial Services Authority by filling out the application for addition of scope of service provision. c) In the event that a Public Appraiser is first registered with the Financial Services Authority in sectors other than the capital market, financial derivatives, and carbon exchange, the addition of the scope of service provision in the capital market, financial derivatives, and carbon exchange sectors is carried out by submitting an application in accordance with the format as stipulated in Appendix II CHAPTER II Part B which is an inseparable part of this Regulation of the Member of the Board of Commissioners of the Financial Services Authority and uploading the following documents: (1) Professional Education Program certificate in the capital market, financial derivatives, and carbon exchange sectors obtained within the last 2 (two) years calculated from the date of issuance of the certificate; and (2) additional documents as referred to in letter a point 4). d) In the event that a Public Appraiser is first registered with the Financial Services Authority in the capital market, financial derivatives, and carbon exchange sectors, the addition of the scope of service provision in sectors other than the capital market, financial derivatives, and carbon exchange is carried out by submitting an application in accordance with the format as stipulated in Appendix II CHAPTER II Part A which is an inseparable part of this Regulation of the Member of the Board of Commissioners of the Financial Services Authority and uploading at least the following documents: (1) Professional Education Program certificate in sectors other than the capital market, financial derivatives, and carbon exchange obtained within the last 2 (two) years calculated from the date of issuance of the certificate; and (2) a valid public appraiser license from the minister who administers government affairs in the field of finance in accordance with the Valuation activities carried out in the Financial Services Sector. e) Examples of the application of adding the scope of service provision for Public Appraisers: (1) Public Appraiser A was first registered with the Financial Services Authority in the capital market, financial derivatives, and carbon exchange sectors with a Public Appraiser license related to property Valuation activities from the ministry that administers government affairs in the field of finance. (2) Public Appraiser A submits an application for addition of scope of service provision to the Financial Services Authority to carry out activities in the Banking sector with a Property Appraiser license in accordance with the scope of Valuation activities from the ministry that administers government affairs in the field of finance. (3) To add the scope of service provision to the Banking sector, Public Appraiser A must fulfill the Professional Education Program with a certain number of professional credit units in sectors other than the capital market, financial derivatives, and carbon exchange as regulated in this Regulation of the Member of the Board of Commissioners of the Financial Services Authority. (4) In the event that the application for addition of scope of service provision in sectors other than the capital market, financial derivatives, and carbon exchange is approved, Public Appraiser A may carry out activities in sectors other than the capital market, financial derivatives, and carbon exchange.
  3. Public Accountant The provisions regarding the scope of service provision and the addition of the scope of service provision for Public Accountants are implemented in accordance with the Regulation of the Member of the Board of Commissioners of the Financial Services Authority concerning procedures for the use of Public Accountant and Public Accounting Firm services in service activities
