These entities are prohibited from operating without authorization, and any false claims of regulation by the Commission constitute criminal offenses subject to prosecution. SECURITIES COMMISSION OF THE BAHAMAS PUBLIC NOTICE No. 3 of 2023 28 August 2023 RE: ENTITIES NOT REGULATED BY THE SECURITIES COMMISSION OF THE BAHAMAS This NOTICE is issued by the Securities Commission of The Bahamas (the Commission) pursuant to its authority under the Securities Industry Act, 2011, the Investment Funds Act, 2019, the Financial and Corporate Service Providers Act, 2020, and the Digital Assets and Registered Exchanges Act, 2020 (the Acts). It has come to the attention of the Commission that the entities listed below may be conducting activities (or purporting to conduct activities), in or from within The Bahamas, that are either registrable/licensable or illegal under one or more of the Acts. The Commission hereby advises the public that none of these entities or their agents/representatives are registered with/licensed by the Commission. Additionally, none of the listed entities have applied to be registered/licensed by the Commission. Therefore, any registrable/licensable activity conducted, in or from within The Bahamas, by these entities and their agents/representatives is in violation of one or more of the Acts. Each website also makes the false statement that the entity is authorized and/or regulated by the Securities Commission of The Bahamas. By thisfalse claim, each entity, its agents and representatives commit an offence and are liable for criminal prosecution and/or regulatory sanctions under one or more of the Acts. WARNING Individuals currently (or desirous of) conducting business with the aforementioned entities or their agents/representatives, should be cognizant that they are doing so with entities and/or their agents who are not authorized or regulated by the Commission. Members of the public should exercise extreme caution when considering to conduct securities and/or digital asset trading activities with the aforementioned entities or their agents/representatives.
Listings of the Commission’s registrants and licensees that are authorized to engage in activities regulated by any of the Acts, in or from within The Bahamas, are located on the Commission’s website at https://www.scb.gov.bs/registrant-licensee-search/. Before engaging in business with any entity who claims or purports to be authorized and/or regulated by the Commission, you are advised to consult, in the first instance, this publicly available listing.
