Regulation No. 002/2023 Amending and Completing the Foreign Exchange Regulation of March 25, 2014

This regulation exempts the Central Bank of Congo from foreign exchange control by the Congolese Control Office when importing banknotes, security documents, and related production inputs such as software, equipment, and chemicals. REGULATION NO. 002/2023 AMENDING AND COMPLETING THE FOREIGN EXCHANGE REGULATION OF MARCH 25, 2014

The Central Bank of Congo,

Having regard to the Organic Law No. 18/027 of December 13, 2018 on the organization and functioning of the Central Bank of Congo, particularly Article 69;

Having regard to the Ordinance-Law No. 67/272 of June 23, 1967 on the regulatory powers of the National Bank of Congo in matters of Foreign Exchange Regulation, as amended and supplemented to date, particularly Articles 1 and following;

Having regard to the Foreign Exchange Regulation in the Democratic Republic of Congo, particularly Article 30;

Considering the need to preserve the manufacturing secrets of banknotes and other security documents and to ensure a regular supply of software, equipment, and inputs;

Enacts the following provisions:

Article 1:

This Regulation aims to establish the specific regime applicable to the importation by the Central Bank of Congo of banknotes and other security documents, as well as the software, equipment, and inputs used for their production.

Article 2:

By way of derogation from Article 30 of the Foreign Exchange Regulation of March 25, 2014, as amended and supplemented to date, the imports of the goods referred to in Article 1 above by the Central Bank of Congo are exempt from control by the Congolese Control Office or its agent. These are:

  1. banknotes and other security documents;
  2. paper;
  3. printing plates;
  4. printing inks;
  5. smart cards;
  6. spare parts;
  7. chemical products;
  8. computers and peripherals;
  9. film developers and cleaners;
  10. washing waters;
  11. software and equipment (machines, computers, peripherals, and other devices);
  12. various consumables and any other input contributing to the production of banknotes and other security documents.

Article 3:

This Regulation repeals all prior provisions contrary to it and enters into force on the date of its signature.
