Regulation of the Board of Commissioners of the Financial Services Authority Number 3 of 2026 concerning the Organization of Digital Financial Asset Trading Including Crypto Assets
Abstract: This Regulation of the Board of Commissioners of the Financial Services Authority (PADK OJK) is drafted in conjunction with the implementation of the Financial Services Authority Regulation Number 23 of 2025 concerning Amendments to the Financial Services Authority Regulation Number 27 of 2024 concerning the Organization of Digital Financial Asset Trading Including Crypto Assets. Consequently, further regulations are required regarding implementation provisions and procedures for submitting reports on the results of evaluations of Digital Financial Assets in the Digital Financial Asset Register, monthly reports, management's self-assessment reports on risk management, annual activity reports of Digital Financial Asset Trading Organizers, incidental reports, and requests related to report submissions.
The legal basis for this Regulation of the Board of Commissioners of the Financial Services Authority is: Law Number 21 of 2011 as amended by Law Number 4 of 2023; Law Number 4 of 2023; POJK Number 27 of 2024; and POJK Number 23 of 2025.
This PADK OJK regulates reporting related to the Organization of Digital Financial Asset Trading Including Crypto Assets, including but not limited to: I. General Provisions; II. Submission of reports on the results of evaluations of Digital Financial Assets in the Digital Financial Asset Register; III. Submission of Reports by Digital Financial Asset Trading Organizers, 1. Periodic: a. Monthly, b. Quarterly, c. Annual, 2. Incidental; IV. Mechanisms and Procedures for Submitting reports on the results of evaluations of Digital Financial Assets in the Digital Financial Asset Register; V. Notification of Clearing, Guaranteeing, and Settlement Activities Regarding Digital Financial Asset Derivative Transactions by Clearing, Guaranteeing, and Settlement Institutions.
Notes: This Regulation of the Board of Commissioners of the Financial Services Authority takes effect on September 1, 2026. This Regulation of the Board of Commissioners of the Financial Services Authority was established on June 30, 2026.
Upon the implementation of this Regulation of the Board of Commissioners, the following provisions: a. Roman numeral VI items 1 through 5 and Appendix V of Financial Services Authority Circular Letter Number 20/SEOJK.07/2024 concerning the Organization of Digital Financial Asset Trading Including Crypto Assets are revoked and declared invalid, effective as of July 1, 2026; and b. Roman numeral VI items 6 through 7, and Appendix VIII letter A of Financial Services Authority Circular Letter Number 20/SEOJK.07/2024 concerning the Organization of Digital Financial Asset Trading Including Crypto Assets are revoked and declared invalid, effective as of January 1, 2027.
Upon the implementation of this Regulation of the Board of Commissioners, the Financial Services Authority Circular Letter Number 20/SEOJK.07/2024 concerning the Organization of Digital Financial Asset Trading Including Crypto Assets is revoked and declared invalid, except for provisions as referred to in Article 2.
