Regulations on the Establishment and Operation of Private Universities and Colleges

(108) Article 1: In order to implement Article 33 of the Law on the Establishment of the Supreme Council of the Cultural Revolution, the following regulations are hereby issued:

Article 2: Private universities and colleges are institutions established by legal entities or individuals, with the aim of providing higher education and conducting research, under the supervision and oversight of the Ministry of Science, Research and Technology, and in accordance with the laws and regulations of the country.

Article 3: The establishment of private universities and colleges is subject to the approval of the Supreme Council of the Cultural Revolution, upon the recommendation of the Ministry of Science, Research and Technology, and in accordance with the country's needs and educational planning.

Article 4: The establishment of private universities and colleges must be in accordance with the standards and criteria determined by the Supreme Council of the Cultural Revolution and the Ministry of Science, Research and Technology.

Article 5: The establishment of private universities and colleges requires the submission of a proposal to the Ministry of Science, Research and Technology, which must include the following information:

1. The name and type of the legal entity or individual establishing the institution.
2. The location and area of the proposed institution.
3. The fields of study and research to be offered.
4. The financial resources and budget plan for the establishment and operation of the institution.
5. The qualifications and experience of the proposed management and academic staff.
6. The proposed academic calendar and educational programs.
7. The proposed organizational structure and administrative system.
8. The proposed quality assurance and evaluation system.
9. The proposed plan for the development and expansion of the institution.
10. Any other information required by the Ministry of Science, Research and Technology.

Article 6: The Ministry of Science, Research and Technology shall review the proposal submitted in accordance with Article 5 and, if it meets the standards and criteria determined by the Supreme Council of the Cultural Revolution, it shall submit the proposal to the Supreme Council of the Cultural Revolution for approval. If the proposal does not meet the standards and criteria, the Ministry of Science, Research and Technology shall notify the proposer of the reasons for rejection and may request the submission of a revised proposal.

The Supreme Council of the Cultural Revolution shall review the proposal submitted by the Ministry of Science, Research and Technology and, if it approves the proposal, it shall issue a license for the establishment of the private university or college. If the Supreme Council of the Cultural Revolution does not approve the proposal, it shall notify the Ministry of Science, Research and Technology of the reasons for rejection.

The license for the establishment of a private university or college shall be valid for a period of five years from the date of issuance. The licensee may apply for an extension of the license before the expiration of the validity period.

The licensee shall commence the operation of the private university or college within two years from the date of issuance of the license. If the licensee fails to commence the operation within the specified period, the license shall be revoked.

Article 7: The operation of private universities and colleges shall be subject to the supervision and oversight of the Ministry of Science, Research and Technology. The Ministry of Science, Research and Technology shall monitor the performance of private universities and colleges in accordance with the standards and criteria determined by the Supreme Council of the Cultural Revolution.

The Ministry of Science, Research and Technology may conduct periodic or special inspections of private universities and colleges to ensure compliance with the laws and regulations and the standards and criteria determined by the Supreme Council of the Cultural Revolution. If the Ministry of Science, Research and Technology finds that a private university or college is not in compliance with the laws and regulations or the standards and criteria, it may issue warnings, impose fines, suspend the admission of students, or revoke the license of the private university or college.

Article 8: The Supreme Council of the Cultural Revolution may, at any time, review the performance of private universities and colleges and, if it finds that a private university or college is not in compliance with the laws and regulations or the standards and criteria, it may issue directives to the Ministry of Science, Research and Technology to take necessary measures.

The Ministry of Science, Research and Technology shall implement the directives issued by the Supreme Council of the Cultural Revolution.

Article 9: The provisions of these regulations shall apply to all private universities and colleges established in accordance with the laws and regulations of the country.

Article 10: These regulations shall enter into force from the date of their publication in the Official Gazette.

Note 5: The Supreme Council of the Cultural Revolution shall review the performance of private universities and colleges and, if it finds that a private university or college is not in compliance with the laws and regulations or the standards and criteria, it may issue directives to the Ministry of Science, Research and Technology to take necessary measures.

Note 6: The Ministry of Science, Research and Technology shall implement the directives issued by the Supreme Council of the Cultural Revolution.

Note 7: The provisions of these regulations shall apply to all private universities and colleges established in accordance with the laws and regulations of the country.

Note 8: These regulations shall enter into force from the date of their publication in the Official Gazette.

Note 1: The provisions of these regulations shall apply to private universities and colleges established before the entry into force of these regulations. Such institutions shall be required to comply with the standards and criteria determined by the Supreme Council of the Cultural Revolution within a period of two years from the date of entry into force of these regulations.

Note 2: The Ministry of Science, Research and Technology shall issue detailed regulations for the implementation of these regulations within a period of six months from the date of entry into force of these regulations.

Note 3: The Supreme Council of the Cultural Revolution may, at any time, amend these regulations or issue new regulations regarding the establishment and operation of private universities and colleges.

Note 4: The Ministry of Science, Research and Technology shall monitor the implementation of these regulations and report to the Supreme Council of the Cultural Revolution on a regular basis.
