BOARD OF DIRECTORS RESOLUTION NO. 142/2009 SUBJECT: INTERNATIONAL OPERATIONS MANAGEMENT - APPROVES TABLE OF COMMISSIONS FOR SERVICES AND TABLE OF FINES OF THE CENTRAL BANK OF BOLIVIA FOR THE 2010 MANAGEMENT PERIOD.
VIEWED: The Law 1670 of October 31, 1995, of the Central Bank of Bolivia (BCB). The Statute of the BCB approved by Board of Directors Resolution No. 128/2005 of October 21, 2005, and subsequent modifications. The Board of Directors Resolution No. 146/2008 of December 16, 2008, which approves the Table of Commissions for Services and the Table of Fines of the BCB for the 2009 management period. The Reports of the International Operations Management GOI No. 023/2009 of December 2, 2009. The Report of the Legal Affairs Management SANO No. 390/2009 of December 4, 2009.
CONSIDERING: That according to article 54, subsection n) of Law No. 1670, it is the responsibility of the Board of Directors to formulate policies regarding the internal management of the BCB, supervising their execution. That according to article 11, numeral 45) of the BCB Statute, the Board of Directors has among its powers the authority to set annually the table of commissions to be charged for the services it provides.
That the International Operations Management, according to Report GOI Nos. 023/2009, states that the commissions charged by the BCB for the provision of banking and financial services are intended to cover their respective operating costs; therefore, it is necessary to periodically adjust these commissions to align them with current market conditions. That as expressed in Report SANO No. 390/2009, in the opinion of the Legal Affairs Management, there is no legal impediment for the Board of Directors to consider the approval of the Service Commission Tables and the Fines Table of the BCB for the 2010 management period.
THEREFORE, THE BOARD OF DIRECTORS OF THE CENTRAL BANK OF BOLIVIA RESOLVES:
Article 1.- Approve the Table of Commissions for Services and the Table of Fines of the Central Bank of Bolivia for the 2010 management period, which forms part of this Resolution as an annex, and which will enter into force starting January 4, 2010.
Article 2.- Starting January 4, 2010, Board of Directors Resolution No. 146/2008 and all provisions contrary to this Resolution are hereby repealed.
Article 3.- The Presidency and General Management are charged with the execution and compliance of this Resolution.
