Resolution issuing the official format for credit institutions to exchange information under Article 115 of the Credit Institutions Law

This Resolution establishes the official digital format, designated as "Anexo A_62ª Octies," that credit institutions must use to exchange information with foreign financial entities. Credit institutions are responsible for ensuring the quality and characteristics of the information transmitted via agreed electronic means. The Resolution entered into force on the business day following its publication in the Official Gazette, with the digital format made available on the Financial Intelligence Unit's website the following business day.

RESOLUTION issuing the official format for credit institutions to carry out the exchange of information in terms of what is provided in the first paragraph of the 62nd Octies of the General Provisions referred to in Article 115 of the Credit Institutions Law

PABLO GÓMEZ ÁLVAREZ, Head of the Financial Intelligence Unit of the Ministry of

Treasury and Public Credit, based on the provisions of Articles 52, penultimate and last paragraphs, 115 and 115

Bis of the Credit Institutions Law, 61st and 62nd Octies of the General Provisions referred to in

Article 115 of the Credit Institutions Law, Article 4 of the Federal Administrative Procedure Law as well as Article 10, fractions I and VI of the Internal Regulations of the Ministry of Treasury and

Public Credit and,

CONSIDERING

That, in terms of the 62nd Octies of the General Provisions referred to in Article 115

of the Credit Institutions Law, the Ministry of Treasury and Public Credit must issue the official

format for credit institutions to exchange information regarding their clients and users with

foreign financial entities, in accordance with the terms and specifications set forth in the cited

disposition.

That, once the opinion of the National Banking and Securities Commission has been heard, issued via letter

VSPP/220-79923/2024 dated April 24, 2024, I have deemed it appropriate to issue the following:

RESOLUTION ISSUING THE OFFICIAL FORMAT FOR CREDIT INSTITUTIONS TO CARRY OUT THE EXCHANGE OF INFORMATION IN TERMS OF WHAT IS PROVIDED

IN THE FIRST PARAGRAPH OF THE 62ND OCTIES OF THE GENERAL PROVISIONS

REFERRED TO IN ARTICLE 115 OF THE CREDIT INSTITUTIONS LAW

Article 1. -

This Resolution aims to issue the official format, in terms of what is provided

in the first paragraph of the 62nd Octies of the General Provisions referred to in Article 115

of the Credit Institutions Law.

Article 2. -

The Entities shall carry out the exchange of information referred to in Article 1

above through electronic means agreed upon with the foreign entity or financial institution

in question and through the digital format that can be found as " Anexo A_62ª Octies " on the

Internet portal corresponding to the official website of the Financial Intelligence Unit, accessible via the

web link https://www.gob.mx/uif/documentos/layouts .

Article 3. -

The Entities shall be responsible for ensuring that the information is sent to the foreign entity or financial institution

in question, in terms of this Resolution, as well as that it meets the quality

and required characteristics.

Article 4. -

For the purposes of this Resolution, as well as its " Anexo A_62ª Octies ", the

definitions provided in the 2nd of the General Provisions referred to in Article 115 of the

Credit Institutions Law, published in the Official Gazette on April 20, 2009, and their

respective modifications, shall apply.

TRANSITORY PROVISIONS

FIRST. - This Resolution shall enter into force on the business day following its publication in the

Official Gazette.

SECOND. - On the business day following the entry into force of this Resolution, the Ministry, through

the Financial Intelligence Unit, shall make known the digital format referred to in Article 2,

by publishing it on the Internet portal of said administrative unit.
