Resolution modifying the General Provisions applicable to credit institutions

The National Banking and Securities Commission modifies the General Provisions applicable to credit institutions by derogating regulatory reports A-0815, A-0816, and A-0819 from Series R08. It substitutes the Series R08 index and content to consolidate information into a single report, A-0811, which captures traditional deposits and interbank loans. The resolution updates the reporting format for report A-0811 by replacing specific interest rate columns with "REFERENCE RATE" and "RATE" columns. These changes enter into force the day following publication in the Official Gazette of the Federation.

RESOLUTION modifying the General Provisions applicable to credit institutions

A seal with the National Coat of Arms, which reads: United Mexican States.- Treasury.- Ministry of Treasury and Public Credit.- National Banking and Securities Commission, is placed at the margin.

The National Banking and Securities Commission, based on Articles 96 Bis, first paragraph; 98 Bis and 99, first paragraph of the Credit Institutions Law, as well as 4, fractions II, III, V, XXXVI and XXXVIII; 14, 16, fraction I of the National Banking and Securities Commission Law, and

CONSIDERING

That, with the purpose of providing credit institutions with better elements, the modification of the capture format for the regulatory report A-0811 of Series R08 of the "General Provisions applicable to credit institutions" is established, eliminating the columns corresponding to the Rates (Interbank Equilibrium Interest Rate - TIIE, Average Percentage Cost - CPP and London Interbank Offered Rate, in English - LIBOR), substituting them with the columns "REFERENCE RATE" and "RATE", which will be applicable both to deposit products and to interbank loans and those formalized with other entities in national currency, with the objective of updating and strengthening the reference schemes used in financial operations, and

That, in order to avoid duplication of information and optimize reporting processes, it is necessary to repeal the reports related to deposit and interbank and other entity operations, stratified by maturity terms applicable only to development banking, consolidating the information into a single report applicable to credit institutions to simplify the current regulation, improve administrative efficiency and guarantee transparency in information processes, in accordance with the principles established in the applicable regulatory framework, has resolved to issue the following:

CREDIT INSTITUTIONS

SINGLE. - The regulatory reports "A-0815 Interbank and other entity loans, stratified by maturity terms", "A-0816 Immediate payability deposits and interbank and other entity loans, stratified by amounts" and "A-0819 Integral deposit stratified by amounts" are DEROGATED from Article 207, Series R08 "Deposit", and Series R08 "Deposit" is SUBSTITUTED in its index and content, both of Annex 36 of the "General Provisions applicable to credit institutions" published in the Official Gazette of the Federation on December 2, 2005 and modified through various resolutions published in the aforementioned dissemination medium, to read as follows:

Traditional deposit and interbank and other entity loans

This report requests end-of-month deposit balances. These balances are divided into total balance, principal and accrued unpaid interest. The report must be presented in national currency, foreign currency, VSM, UMA and UDIS valued in pesos.

For the completion of report A-0811 Traditional deposit and interbank and other entity loans, the following aspects must be taken into consideration:

The report refers to the balances and interest of the institution's deposits. The information requested in the report must also be identified by: national currency, foreign currency, VSM, UMA and UDIS valued in pesos.

In the report there are concepts that only apply to Development Banking institutions; these are marked with BD. For those concepts that apply equally to both types of institutions, they are not differentiated.

In this regulatory report, the institution's figures without consolidation are requested. The balances reported at the end of the month in this report must match the balances of the items and concepts corresponding to report A-0111 Minimum catalog by currency type, that is, in national currency, foreign currency, VSM, UMA and UDIS valued in pesos.

Data referring to balances and amounts must be presented in national currency, foreign currency, VSM, UMA and UDIS valued in pesos, using the exchange rate indicated in the current accounting criteria. These amounts and balances must be presented in pesos, with two decimal places, without commas. For example: $20,585.70 would be 20585.70.

Institutions will report the information indicated in this series, which must comply with the validations and quality standards indicated by the National Banking and Securities Commission (Commission), which in its case, adjusts to the characteristics and specifications for filling out and sending information presented in the support guides, which are published and updated in the Interinstitutional Information Transfer System (SITI) or in that which the Commission makes known in its case. Once the validations and quality standards are met, the SITI will generate an electronic receipt.

The information must be sent only once and will be received assuming it meets all characteristics and specifications, for which it cannot be modified and must be consistent with the various reports in which the same information is included with a different level of integration, therefore, if it does not meet the required quality and characteristics or has been presented incompletely, the obligation to present it will be considered unfulfilled and, consequently, the corresponding sanctions will be imposed in accordance with the legal provisions that apply.
