Resolution modifying the general provisions applicable to stock exchanges

The resolution amends Articles 11 and 14 of the general provisions applicable to stock exchanges to establish a six-month compliance period from the date of a new concession grant. It adds transitional provisions setting specific deadlines for stock exchanges to fulfill contract and system connectivity obligations: until February 28, 2018, for connections between stock exchanges, and until March 23, 2018, for connections with brokerage houses. The resolution entered into force the day after its publication in the Official Gazette on December 18, 2017.

RESOLUTION modifying the general provisions applicable to stock exchanges

At the margin, a seal with the National Coat of Arms, which says: United Mexican States.- Ministry of Finance and Public Credit.- National Banking and Securities Commission.

The National Banking and Securities Commission, based on Articles 252 and 252 Bis, first paragraph of the Securities Market Law, as well as 4, fractions XXXVI and XXXVIII, and 16, fraction I of the Law of the National Banking and Securities Commission, and

CONSIDERING

That it is appropriate to clarify the deadline that stock exchanges have to facilitate compliance regarding notices and other communications that they must make with brokerage houses and among themselves through their computer systems, as well as to extend the deadline for them to carry out the signing of contracts with brokerage houses and with other stock exchanges, has resolved to issue the

following:

RESOLUTION MODIFYING THE GENERAL PROVISIONS APPLICABLE TO

STOCK EXCHANGES

FIRST.- Article 11, last paragraph, is REFORMED, and Article 14 is ADDED, with a last paragraph, to the "General Provisions Applicable to Stock Exchanges," published in the Official Gazette of the Federation on May 15, 2017, to read as follows:

" Article 11.-

...

Stock exchanges will have a period of six months from the publication of the granting of a new concession to organize and operate as such, to comply with what is provided in this article. "

" Article 14.-

...

Stock exchanges will have a period of six months from the publication of the granting of a new concession to organize and operate as such, to comply with what is provided in the first and second paragraphs of this article. "

SECOND.- Article THIRD TRANSITORY, fraction III, is REFORMED, and fractions VIII and IX are ADDED to Article THIRD TRANSITORY, of the "General Provisions Applicable to Stock Exchanges" published in the Official Gazette of the Federation on May 15, 2017, to read as follows:

Six months for compliance with Articles 14, third and fourth paragraphs, of Chapter I of Title Two and 35 of Chapter I of Title Six of these provisions.

Until February 28, 2018, to comply with Article 14, first and second paragraphs, of Chapter I of Title Two of these provisions, regarding the signing of contracts and the efficient communication and connection of computer systems carried out between stock exchanges.

IX.

Until March 23, 2018, to comply with Article 14, first and second paragraphs, of Chapter I of Title Two of these Provisions, regarding the signing of contracts and the efficient communication and connection of computer systems carried out by stock exchanges with brokerage houses.

TRANSITORY

SOLE.- This Resolution will enter into force the day following its publication in the Official Gazette of the Federation.
