Resolution modifying the General Provisions applicable to the activities of Savings and Loan Cooperative Societies

RESOLUTION that modifies the General Provisions applicable to the activities of savings and loan cooperative societies.

The National Banking and Securities Commission, based on what is provided by articles 11, section VII of the Law to Regulate the Activities of Savings and Loan Cooperative Societies, as well as 4, sections XXXVI and XXXVIII and 16, section I of the Law of the National Banking and Securities Commission, and

CONSIDERING

That it is deemed convenient that persons who intend to carry out or continue carrying out operations as savings and loan cooperative societies with operation levels I to IV, accompany the corresponding authorization request with the valid certification that the compliance officer to be appointed as such must hold in terms of the Law of the National Banking and Securities Commission, in order to contribute to the prevention, detection, and reporting of acts, omissions, or operations that could fall under the circumstances of articles 139 Quater or 400 Bis of the Federal Penal Code, has resolved to issue the following:

RESOLUTION THAT MODIFIES THE GENERAL PROVISIONS APPLICABLE TO THE ACTIVITIES OF SAVINGS AND LOAN COOPERATIVE SOCIETIES

SOLE.- Article 2, fraction X of the "General Provisions applicable to the activities of savings and loan cooperative societies," published in the Official Gazette of the Federation on June 4, 2012 and modified through Resolutions published in said dissemination medium on January 9, 2015, January 7, 2016, April 4, and July 24, 2017, is ADDED, to read as follows:

"Article 2.- . . . I. to IX. . . . X. Copy of the document issued by the Commission, stating the valid certification of the compliance officer to be appointed as such in terms of the "General Provisions for the certification of independent external auditors, compliance officers, and other professionals in matters of prevention of operations with proceeds of illicit origin and financing of terrorism," published in the Official Gazette of the Federation on October 2, 2014 and its respective modifications. . . . "

TRANSITORY PROVISIONS

FIRST.- This Resolution shall enter into force the day following its publication in the Official Gazette of the Federation.

SECOND.- Procedures and processes initiated prior to the entry into force of this Resolution will continue to be governed until their final resolution in accordance with the provisions applicable at their inception.
