On Approving the Regulation on the Activity of the Interbank Universal Retail Payment System "GlobUzCard"

This resolution loses its legal force based on the Resolution of the Board of the Central Bank of the Republic of Uzbekistan dated January 25, 2020, No. 2/7-1 "On Recognizing as Invalid the Resolution 'On Approving the Regulation on the Activity of the Interbank Universal Retail Payment System GlobUzCard'" (registration number 2884-1, dated February 5, 2020).

In accordance with the Laws of the Republic of Uzbekistan "On the Central Bank of the Republic of Uzbekistan", "On Banks and Banking Activity", "On Electronic Payments", the Resolution of the President of the Republic of Uzbekistan dated April 19, 2010, No. PQ-1325 "On Additional Measures to Encourage the Development of the Settlement System Using Bank Plastic Cards", and the Resolutions of the Cabinet of Ministers of the Republic of Uzbekistan dated September 24, 2004, No. 445 "On Further Development Measures of the Settlement System Based on Plastic Cards" and dated February 12, 2014, No. 27 "On Further Development and Coordination of the Cashless Settlement System Based on Bank Plastic Cards, and Implementation of Progressive Advantages Based on Standards, Rules, and Procedures of International Payment Systems", the Board of the Central Bank of the Republic of Uzbekistan resolves:

  1. Approve the Regulation on the Activity of the Interbank Universal Retail Payment System "GlobUzCard" in accordance with the Appendix.

  2. This resolution enters into force from the date of its official publication.

REGULATION

on the Activity of the Interbank Universal Retail Payment System "GlobUzCard"

This Regulation regulates the activity of the interbank universal retail payment system "GlobUzCard" in accordance with the Laws of the Republic of Uzbekistan "On the Central Bank of the Republic of Uzbekistan", "On Banks and Banking Activity", "On Electronic Payments", the Resolution of the President of the Republic of Uzbekistan dated April 19, 2010, No. PQ-1325 "On Additional Measures to Encourage the Development of the Settlement System Using Bank Plastic Cards", and the Resolutions of the Cabinet of Ministers of the Republic of Uzbekistan dated September 24, 2004, No. 445 "On Further Development Measures of the Settlement System Based on Plastic Cards" and dated February 12, 2014, No. 27 "On Further Development and Coordination of the Cashless Settlement System Based on Bank Plastic Cards, and Implementation of Progressive Advantages Based on Standards, Rules, and Procedures of International Payment Systems".

Chapter 1. General Provisions

  1. The following main concepts are used in this Regulation:

"GlobUzCard" interbank universal retail payment system (hereinafter referred to in the text as the "GlobUz" payment system) — a universal retail payment system operating based on software and technical solutions and relevant organizational and technical infrastructure, the main element of which is bank plastic cards, designed for carrying out cashless settlements in electronic form, and unifying issuing banks and banks serving sellers of goods (services, works), the Settlement Bank, and the Processing Center into a single system;

bank plastic cards (hereinafter referred to in the text as BPC) — localized and international bank plastic cards issued by a member of the "GlobUz" payment system, personalized, used as a means of payment, and providing the opportunity to carry out operations, including cashless settlements (payments) through an account, within the limits of funds in the cardholder's bank account and/or funds authorized by the bank, as well as to withdraw cash funds and bank credit;

terminal — equipment that enables carrying out cashless settlements using a BPC and forming slips for executed operations;

ATM — electromechanical equipment that allows the BPC holder to receive cash funds and receipts for executed operations in self-service mode, as well as to carry out basic and additional operations through the BPC, including crediting and debiting funds, obtaining information about the balance of the BPC and the state of the bank account balance, and changing passwords;

issuer — a bank that carries out the issuance of BPCs, owns property rights to the BPCs it has issued, assumes obligations before the holders and acquirers of these BPCs based on legislative requirements for cashless settlements in its own name, and also carries out functions of authorization of payment operations by BPC holders, transaction aggregation, and processing;

issuance — activity related to the production and presentation of BPCs for use;

acquiring — carrying out settlements with sellers of goods (services, works) for operations carried out through the BPC, as well as direct cash disbursement to the BPC holder via teller or ATM;

acquirer — a bank carrying out acquiring;

BPC holder — a client or a person authorized by the client who uses the BPC based on a contract with the issuer;

transaction — a payment order carried out by the BPC holder leading to the movement of funds in their bank account;

clearing — preparation of a set of documents containing full information on each financial operation carried out through the BPC, aggregation, and processing of financial operations;

regulatory information reference — information formed and collected in the form of electronic files, intended to ensure the correct functioning of the "GlobUz" payment system;

stop-list — a list of BPCs lost or temporarily or completely suspended from settlement operations by the bank, formed and constantly updated by the Processing Center;

master key — a key forming the leading branch of the "GlobUz" payment system, determining the belonging of the BPC to this system and ensuring the creation of a single technological field;

Processing Center — a legal entity engaged in collecting, processing, and distributing information between members of the "GlobUz" payment system, as well as providing technical service for issuance and acquiring carried out by members of the "GlobUz" payment system;

international payment system — a payment system operating in compliance with rules and principles mandatory for all participants in a single payment and informational-legal field of participants in operations carried out through bank plastic cards (Visa, MasterCard, Union Pay International, JCB, American Express, Diners Club, etc.);

Settlement Bank — a bank serving banks that are members of the "GlobUz" payment system regarding mutual financial settlements between banks for operations carried out using BPCs in transactions between banks that are members of the "GlobUz" payment system within the infrastructure of banks that are members of the "GlobUz" payment system.

  1. The following are considered members of the "GlobUz" payment system:

Banks that are issuers and acquirers of BPCs and have been accepted as members of the "GlobUz" payment system in the manner established by this Regulation;

The Settlement Bank;

The Processing Center.

  1. The following are considered users of the "GlobUz" payment system:

BPC holders;

Entities serving BPCs.

  1. Members of the "GlobUz" payment system:

A bank that is a member of the "GlobUz" payment system recognizes the BPC as a means of cashless settlement and guarantees the execution of settlement operations and transactions using the BPC in accordance with legislation;

The Settlement Bank guarantees the execution of mutual settlements between banks for operations carried out through BPCs based on information received from the Processing Center, in accordance with the service agreement concluded with members of the "GlobUz" payment system;

A bank that is a member of the "GlobUz" payment system, upon issuing the BPC to the BPC holder, guarantees the payment of all presented payment claims for operations carried out with this BPC by the acquirer. Such payments are made without acceptance;

A bank that is a member of the "GlobUz" payment system guarantees the acceptance of payments and the provision of cash funds (except for corporate BPCs) in the manner established by legislation to all holders of BPCs issued by other banks that are members of this system within its infrastructure;

The Processing Center undertakes to provide complete and timely information to the Settlement Bank and banks that are members of the "GlobUz" payment system regarding mutual settlements between members of the "GlobUz" payment system.

  1. The conditional sign of the "GlobUz" payment system is considered a common symbolic sign accepted by banks that are members of the "GlobUz" payment system, and this sign must be reflected in all objects where terminals are installed. BPCs issued by banks that are members of the "GlobUz" payment system must be accepted in all objects where terminals are installed.

  2. The Central Bank of the Republic of Uzbekistan ensures the interoperability of BPCs of the "GlobUz" payment system and other payment systems within the interbank retail payment system infrastructure.

Refusal to serve BPCs of other payment systems within the "GlobUz" payment system infrastructure (terminals, ATMs, info-kiosks, and other special equipment) is prohibited.

  1. Members of the "GlobUz" payment system are responsible for ensuring the use of BPCs equipped with internal protection tools that exclude the possibility of counterfeiting and meet the security requirements of the base technology, as well as for the use of encryption algorithms of the system's specific technological platform.

  2. Members of the "GlobUz" payment system must ensure that confidential information does not fall into the computer's random access memory in open form. Additional protection tools may be used to ensure information confidentiality. Management of the confidential key system of members of the "GlobUz" payment system is carried out in accordance with the requirements imposed on the security of information systems.

Chapter 2. Organization of the Activity of the Coordinating Council of the "GlobUz" Payment System

  1. The main goal of the Coordinating Council of the "GlobUz" payment system is to coordinate activities aimed at improving the monetary circulation system, developing the national cashless settlement system, reducing non-cash money turnover, creating favorable conditions for the population to make payments using BPCs, and improving service quality based on the introduction of advanced banking technologies.

  2. The Coordinating Council is the highest management body of the "GlobUz" payment system.

  3. The Coordinating Council includes the heads (and their deputies) of banks that are members of the "GlobUz" payment system, as well as the Association of Banks of Uzbekistan and the Processing Center.

  4. The Coordinating Council is headed by a Chairman. In the absence of the Chairman, his duties are performed by the Deputy Chairman.

  5. The Chairman of the Coordinating Council directs the activities of the Coordinating Council and is responsible for the performance of tasks assigned to it.

  6. If members of the Coordinating Council change jobs, newly appointed persons are included in their place.

  7. The Chairman and Deputy Chairman of the Coordinating Council are elected from among the members of the Coordinating Council for a term of two years. The Chairman of the Coordinating Council may resign from his powers early by notifying the Coordinating Council in writing at least two months in advance.

  8. The activities of the Coordinating Council are based on the principles of equality and collegiality in decision-making. Meetings of the Coordinating Council are held when necessary, but at least twice a year. A meeting of the Coordinating Council is considered quorate if at least two-thirds of its members participate.

  9. Decisions of the Coordinating Council are adopted by majority vote of the Coordinating Council members participating in the meeting. In case of a tie, the presiding officer's vote is decisive.

  10. Minutes of meetings of the Coordinating Council are formalized in the form of records, signed by the responsible secretary, and approved by the Chairman of the Coordinating Council.

  11. The position of responsible secretary of the Coordinating Council is occupied by the head of the Processing Center or one of his deputies ex officio.

  12. A member dissatisfied with a decision adopted by the Coordinating Council has the right to express their opinion in writing, and this document is attached to the meeting minutes.

  13. Organizational and technical support of Coordinating Council meetings is entrusted to the working body.

  14. Decisions of the Coordinating Council are sent to all members of the Coordinating Council for information and execution within five business days.

  15. Members of the Coordinating Council carry out their work activities on a public basis.

  16. The following are considered the main tasks of the Coordinating Council:

Study, implementation, and development of international payment systems for carrying out cashless settlements through BPCs;

Ensuring compliance with the efficiency, reliability, and security of the payment system;

Expanding the scope of influence of the payment system and integrating it with international financial institutions and international and national payment systems;

Carrying out transaction and clearing sessions of the payment system, forming interbank uniform requirements, rules, and interaction regulations for ensuring security, and developing and approving unified software and technical requirements for BPCs, terminals, ATMs, info-kiosks, special equipment used by banks, and software and technical equipment of banks that are members of the "GlobUz" payment system;

Developing proposals for improving normative and legal documents related to the introduction, development, and presentation of BPCs as a means of settlement;

Developing proposals for introducing new modern banking services carried out through BPCs;

Assisting in the development of the system for training and retraining employees of banks that are members of the "GlobUz" payment system working with this payment system.

  1. The Coordinating Council has the following rights:

Establish rules of interaction between payment system members, as well as adopt decisions on accepting banks into the "GlobUz" payment system or removing them from membership in the "GlobUz" payment system;

Resolve disputes arising during the operation of the "GlobUz" payment system, as well as adopt relevant decisions in case of force majeure circumstances;

Set tariffs for interbank transactions in agreement with the Central Bank of the Republic of Uzbekistan, as well as establish the maximum amount of intermediary fees for services provided to BPC holders by banks that are members of the "GlobUz" payment system;

Establish the maximum amount of service fees charged by banks for primary issuance of BPCs and other services carried out by the Processing Center;

Obtain analytical information from payment system members regarding cashless settlements carried out through BPCs;

Hear reports from the Processing Center.

  1. Ensuring the execution of decisions adopted by the Coordinating Council and effective organization of the activities of the Coordinating Council are considered obligations of the Coordinating Council.

Chapter 3. Working Body of the Coordinating Council

  1. The Processing Center is considered the working body of the Coordinating Council.

  2. The main task of the working body is to study international practice regarding cashless settlements, as well as to analyze problematic issues arising in the field of the "GlobUz" payment system and develop proposals for their improvement.

  3. The working body has the right to submit proposals to the Coordinating Council on the following issues:

Selection of certain software-hardware platforms and technical solutions for organizing and developing the "GlobUz" payment system;

Interaction between members of the "GlobUz" payment system, as well as inclusion of banks in or removal from the "GlobUz" payment system;

Resolution of disagreements and disputes arising during the operation of the "GlobUz" payment system and in force majeure situations;

Ensuring confidentiality and protection measures for information resources of the "GlobUz" payment system;

Developing proposals for amendments and additions to legislative acts regarding support for banks in the development, introduction, and dissemination of cashless settlements, including services provided using BPCs;

Obtaining necessary information from members of the "GlobUz" payment system to ensure the performance of tasks of the Coordinating Council and effective operation of the "GlobUz" payment system.

  1. Obligations of the working body:

Systematic monitoring of the timely and high-quality execution of Coordinating Council decisions;

Organization of preparation, accounting, and storage of Coordinating Council documents.

Chapter 4. Membership of Banks in the "GlobUz" Payment System

  1. Membership of banks in the "GlobUz" payment system is voluntary.

  2. To join the "GlobUz" payment system, a bank applies to the Coordinating Council. The application is accompanied by the following documents:

A copy of the license issued by the Central Bank of the Republic of Uzbekistan for carrying out banking operations;

Annual business plan for the introduction and development of BPCs.

  1. The working body examines the documents submitted by the bank, draws up a conclusion, and submits them to the Coordinating Council for adoption of a relevant decision.

  2. The Coordinating Council considers documents submitted by the bank for membership in the "GlobUz" payment system within 15 days and adopts a decision on acceptance or refusal of acceptance into the "GlobUz" payment system.

If a decision is adopted to refuse acceptance of the bank into the "GlobUz" payment system, the Coordinating Council notifies the bank in writing, substantiating the reasons for refusal.

  1. If a decision is adopted to accept the bank into the system, the Coordinating Council notifies the Settlement Bank and the Processing Center in writing within three business days.

  2. Based on the written notification received from the Coordinating Council, the Settlement Bank signs a service agreement with the bank accepted into the "GlobUz" payment system.

  3. Based on the written notification received from the Coordinating Council, the Processing Center signs a service agreement with the bank accepted into membership in the "GlobUz" payment system, provides authentication data to the bank for entering the Processing server, and includes the said bank in the "GlobUz" payment system.

  4. A bank that is a member of the "GlobUz" payment system fully assumes responsibility for the financial obligations of its branches.

  5. After receiving a notification from the Processing Center regarding the bank's readiness to operate in the "GlobUz" payment system, the Coordinating Council sends an official message to banks that are members of the system about the acceptance of the new bank as a system member and its connection to the system.

  6. The Processing Center forms a new system directory and distributes it to banks that are members of the system, as well as carries out configuration work for correct transmission of interbank transactions for the bank accepted into membership.

  7. Banks that are members of the "GlobUz" payment system have the following rights:

Participate in the management of the activity of the "GlobUz" payment system and the cashless settlement system based on BPCs;

Determine the amount of intermediary and service fees for operations carried out using BPCs within the framework of unified tariffs;

Establish contractual relationships with users of the "GlobUz" payment system.

  1. Obligations of banks that are members of the "GlobUz" payment system:

Take measures to ensure the execution of all responsibilities incumbent upon them necessary for the stable operation of the system, arising from the requirements of this Regulation and decisions of the Coordinating Council;

Ensure correct and timely performance of their functions and obligations before users and members of the "GlobUz" payment system;

Ensure compliance with encryption algorithms for information and data falling within the competence of each member of the "GlobUz" payment system, as well as timely exchange of information and data in accordance with this Regulation;

Ensure conformity of BPCs, terminals, info-kiosks, ATMs, and other relevant equipment used in the "GlobUz" payment system, as well as software on them, with international standards, security, and other requirements;

Timely detect and notify other members of the "GlobUz" payment system about interruptions and force majeure situations occurring in their infrastructure systems.

Chapter 5. Withdrawal of Member Banks from the "GlobUz" Payment System

  1. A bank that is a member of the "GlobUz" payment system is removed from the "GlobUz" payment system in the following cases:

Upon its own application;

Regular violation of the requirements of this Regulation, as well as legislative acts on cashless settlements;

Failure to fulfill its obligations to other members of the "GlobUz" payment system, the Settlement Bank, and the Processing Center;

Liquidation of the bank in the established manner.

  1. The bank voluntarily notifies the Coordinating Council in writing ninety days in advance of withdrawal from membership in the "GlobUz" payment system.

  2. A decision on the withdrawal of the bank from membership in the "GlobUz" payment system is adopted at a meeting of the Coordinating Council.

An approved copy of this resolution is sent to the bank being removed from membership in the "GlobUz" payment system and to system members within three business days from the date the decision is adopted.

  1. After receiving the decision of the Coordinating Council on withdrawal from membership in the "GlobUz" payment system:

The bank that performs settlements notifies in writing the bank issued from the "GlobUz" payment system about the termination of the service agreement concluded with it, and after all financial obligations are settled, the bank is removed from the database;

The Processing Center sends a written notice to the bank issued from the "GlobUz" payment system about the termination of the service agreement for services provided by the Processing Center, and simultaneously removes the bank from the single database.

Chapter 6. Activity of the Processing Center

  1. The duties of the Processing Center are performed by the Limited Liability Company Joint Venture "Yagona xalqaro protsessing markazi".

  2. Transactions and other related information carried out through the Bank Payment Card (BPK) are performed in encrypted form using special software.

  3. The interaction of the Processing Center with other members of the "GlobUz" payment system is carried out through information exchange. The right to exchange information with a member of the "GlobUz" payment system is granted after a service agreement is concluded with the Processing Center.

  4. In necessary cases, a courier may be used to deliver information via electronic carriers within specified deadlines. In this case, information must be personalized and encrypted.

  5. The main duties of the Processing Center:

  • ensuring uninterrupted round-the-clock processing of interbank transactions for all types of payment instruments;
  • performing the primary issuance of BPK;
  • organizing information exchange and clearing between members of the "GlobUz" payment system;
  • forming the registry of BPK of the "GlobUz" payment system;
  • registering members of the "GlobUz" payment system and forming their single database;
  • managing the main key organizing the system;
  • ensuring a high level of security of BPK, terminals, info-kiosks, ATMs, and other relevant equipment, as well as information of payment system members, to prevent fraud and forgery;
  • organizing information exchange between members of the "GlobUz" payment system and international payment systems;
  • servicing the common stop-list and normative information reference book for members of the "GlobUz" payment system;
  • ensuring the confidentiality mode of encrypted data and the operational safety of the "GlobUz" payment system;
  • ensuring the use of technical means of the "GlobUz" payment system, monitoring their operation, and development;
  • creating conditions for the development and implementation of BPK projects;
  • creating, monitoring, improving, and managing the single database of the "GlobUz" payment system;
  • providing opinions on the introduction, implementation, and use of products being introduced on the basis of BPK and equipment serving BPK in the "GlobUz" payment system;
  • conducting marketing research;
  • conducting training seminars on the development and improvement of the settlement system carried out through BPK.
  1. The Processing Center has the following rights:
  • to suspend the issuer's operations regarding BPK based on the decision of the Coordinating Council or the written request of the Settlement Performing Bank;
  • to receive payment in the established amount for services provided by the Processing Center.
  1. The following are considered the obligations of the Processing Center:
  • creating necessary conditions and opportunities for members of the "GlobUz" payment system to carry out operations through BPK;
  • ensuring the storage and confidentiality of the main key;
  • ensuring necessary conditions for the timely exchange of information between members of the "GlobUz" payment system and international payment systems;
  • temporarily suspending the operations of the issuer in the "GlobUz" payment system who is not fulfilling its obligations under the service agreement concluded between the bank that is a member of the "GlobUz" payment system and the Settlement Performing Bank, based on the notification received from the Settlement Performing Bank;
  • if a decision is made on the liquidation of a bank that is a member of the "GlobUz" payment system, without delay, starting from the next banking day after the day the special decision of the liquidation commission is received, to suspend all operations of this bank regarding BPK;
  • ensuring the continuity of "GlobUz" payment system services;
  • ensuring information protection and security measures;
  • ensuring the protection and storage of information regarding operations of members of the "GlobUz" payment system, taking security measures;
  • maintaining the registry of BPK issuers;
  • ensuring the timely testing of the software of the system serving BPK and relevant equipment.

Chapter 7. Interaction with International Payment Systems and Settlements in Foreign Currency

  1. The "GlobUz" payment system establishes interaction with international payment systems to ensure the conduct of operations on the basis of BPK in foreign currency in the Republic of Uzbekistan, as well as the conduct of operations outside the Republic of Uzbekistan through BPK issued within the "GlobUz" payment system.

  2. The Limited Liability Company Joint Venture "Yagona xalqaro protsessing markazi" performs the functions of information clearing for operations conducted within the territory of the Republic of Uzbekistan on the basis of BPK in foreign currency of international payment systems with which interaction has been established, as well as processing functions for all operations conducted through BPK issued within the "GlobUz" payment system.

  3. Clearing of settlements for operations conducted outside the Republic of Uzbekistan through BPK issued within the "GlobUz" payment system is carried out within the framework of mutual agreements concluded by commercial banks of the Republic of Uzbekistan, which have the status of a principal participant of international payment systems, with international payment systems.

  4. The bank carrying out settlement clearing for operations conducted within the territory of the Republic of Uzbekistan on the basis of BPK in foreign currency of international payment systems with which interaction has been established is determined by the Coordinating Council.

Chapter 8. Settlements in National Currency

  1. In the "GlobUz" payment system, the Settlement Clearing Center of the Central Bank of the Republic of Uzbekistan performs the functions of the Settlement Performing Bank in national currency. The Information Center of the Central Bank of the Republic of Uzbekistan ensures the provision of technical, software, and operational services to the Settlement Clearing Center.

  2. The Settlement Performing Bank provides services regarding mutual financial settlements for operations and transactions carried out through BPK with banks that are members of the "GlobUz" payment system, based on agreements concluded with them.

  3. The interaction between the Settlement Performing Bank and the Processing Center is organized on the basis of a bilateral agreement.

  4. The main duty of the Settlement Performing Bank is to organize a system of mutual relations for rapid information exchange with the Processing Center and to ensure the timely implementation of mutual financial settlements between banks that are members of the "GlobUz" payment system.

  5. The Settlement Performing Bank has the following rights:

  • to receive the established intermediary fee for services provided;
  • to demand compliance with the requirements of this Regulation and mutual settlement discipline from members of the "GlobUz" payment system.
  1. The Settlement Performing Bank may unilaterally suspend the settlement operations of a bank that is not fulfilling its obligations under the service agreement and notify the Processing Center about this.

  2. The obligations of the Settlement Performing Bank:

  • to transmit information received from the Processing Center regarding mutual settlements in the system, transactions carried out, and payments, and to ensure the timely updating and exchange of normative information reference books;
  • to monitor the availability of sufficient funds in the bank's representative account for the bank to carry out settlement operations for interbank transactions;
  • to timely submit a notification to the Processing Center to suspend all operations of these banks carried out through BPK if the banks fail to fulfill obligations specified in the agreement.
  1. A member of the "GlobUz" payment system carries out settlements for interbank operations performed through BPK based on an agreement on a representative account concluded with the Settlement Performing Bank.

  2. Settlements for interbank operations carried out through BPK are performed by the Settlement Performing Bank on each banking day. The Processing Center calculates the net settlement position for each bank based on multilateral settlements.

  3. A bank that is a member of the "GlobUz" payment system independently establishes the procedure for settling internal bank operations carried out through BPK.

Chapter 9. Ensuring Information Protection in the "GlobUz" Payment System and Protection of Information Constituting Bank Secrets

  1. Ensuring the security of confidential information processed in the "GlobUz" payment system is carried out in accordance with the requirements of the Regulation on the Procedure for Ensuring and Organizing the Security of Confidential Information in Information Objects of the Republic of Uzbekistan, approved by Resolution No. 295 of the Cabinet of Ministers of the Republic of Uzbekistan dated October 16, 2015.

  2. To ensure the security of information regarding operations carried out through BPK in the "GlobUz" payment system, information may be protected. The management of information is carried out by the Processing Center.

  3. Members of the "GlobUz" payment system are not entitled to disclose information and other information constituting bank secrets that became known to them through the performance of their duties, or to use them for the benefit of third parties, except in cases provided for by legislation.

  4. It is prohibited for employees of banks that are members of the "GlobUz" payment system, the Settlement Performing Bank, and the Processing Center, as well as members of the Coordinating Council and its working body, to disclose information constituting bank secrets that were entrusted to them or became known to them in the course of performing their official duties, as well as to use them for personal purposes or for the benefit of third parties, or to provide third parties with the opportunity to use them directly or indirectly, including by violating the storage procedure.

  5. Members of the Coordinating Council and its working body are not entitled to disclose information constituting bank secrets that became known to them during their period of activity in these bodies after their activity in these bodies is terminated, as well as employees of the Settlement Performing Bank and the Processing Center after their employment agreements are terminated.

  6. Transactions carried out through the "GlobUz" payment system are kept secret in encrypted form based on special software. In cases provided for by legislation, the provision of information constituting bank secrets is carried out by banks that are owners of such information based on a written request of authorized bodies.

  7. Transactions carried out through BPK and other related information are performed in encrypted form using special software tools. Information regarding operations carried out through BPK by members of the "GlobUz" payment system and the payment system must be stored in the manner established by legislation.

Chapter 10. Final Provisions

  1. Persons guilty of violating the requirements of this Regulation are held liable in the manner established by legislation.

  2. This Regulation is agreed upon with the Association of Banks of Uzbekistan.
