This Administrative Regulation (hereinafter referred to as the Regulation) establishes the procedure for providing the state service for conducting qualification exams, formalizing, suspending, and canceling qualification certificates for the issuance of certain types of qualification certificates to individuals (hereinafter referred to as applicants). The applicant applies to the State Service Center in person or registers on YIDHP to use the state service electronically. A fee is collected in the amount specified in Clause 5 of the Passports for consideration of the questionnaire. A discount of 75 percent of the specified fee is applied to members of families included in the "state-supported family" category of the Social Registry. When the applicant applies in person to the Center for Public Services, their application is filled out by a Center employee and, after confirmation by the applicant, is sent electronically to the authorized body within ten minutes, along with the documents specified in Clause 4 of the Passports.   2. Category of applicants: Individual

  3. Authorized body(ies) issuing the qualification certificate: Committee for Industrial, Radiation and Nuclear Safety under the Cabinet of Ministers

  5. Amount of fee charged for issuing the qualification certificate: 1 base calculation amount. A fee of 1 base calculation amount is also charged for extending the validity period of the expert certificate.

  7. Requirements and conditions for the qualification certificate To undergo certification as an expert, the applicant must meet the following mandatory requirements: have higher education, in which case documents confirming higher education obtained in foreign countries

is taken into account if recognized in the established order;

  • have at least 5 years of work experience corresponding to the specialty of the certification area (or objects of expertise) for which the candidate intends to undergo certification;
  • have a certificate confirming the completion of a training course for preparing experts, provided that the time elapsed from the completion of studies to the submission of documents does not exceed 1 year.

Validity period of the qualification certificate 5 years

Note: The candidate must have completed a training course for preparing experts in the certification area for which they intend to undergo certification. Candidates are prepared through contract-based training in a training course of at least 40 hours at the State Institution "KontekhnazoratOquv" under the Committee of the Cabinet of Ministers of the Republic of Uzbekistan for Industrial, Radiation and Nuclear Safety, and the curricula of this course are approved by the authorized body. In this regard, the amount of payments to be made for expenses related to the preparation of experts is determined by the contracting parties, taking into account the duration and form of the relevant training course. Each individual holding an expert certificate must undergo professional development courses with a volume of not less than 20 hours, approved by the authorized body, at least once every 3 years starting from the year the expert certificate was obtained. After fully completing the training courses for preparing experts and/or upgrading their qualifications, candidates are subjected to testing. Testing may be conducted in written, test, or oral form, and its procedure is determined by the authorized body. Those who fail the test are allowed to retake it once. Those who fail the retake study again in the training course on a contract basis. A certificate is issued to those who pass the test by the State Institution "KontekhnazoratOquv". Depending on the formation of certification groups, based on the candidate's application, certification is conducted at least once every 2 months in the premises of the authorized body under the control of the certification commission. The candidate undergoes certification as an expert in the form of computer-based tests and practical tests. A candidate who has correctly answered not less than 80 percent of the questions in the test exams undergoes the practical exam, which is the final part of the qualification exam, within 10 days from the date the test was conducted. During the practical exam, members of the certification commission ask the candidate questions on their knowledge of legislative acts and normative-technical documents, identification and declaration of hazardous production facilities, practical knowledge of industrial safety expertise work, as well as questions regarding the functions and obligations of an expert. During the practical exam, the candidate is asked at least 5 questions, and a candidate who has correctly answered not less than 80 percent of the questions is considered to have passed the certification as an expert. Test questions are compiled consisting of at least 50 questions related to the identification and declaration of hazardous production facilities, performing work on industrial safety expertise, as well as corresponding to the specialty of the certification area (or objects of expertise) for which the candidate intends to undergo certification, and the total duration of the test is 50 minutes. To extend the validity period of the expert certificate and expand the certification area, the owner of the expert certificate undergoes re-certification. The application for re-certification due to the expiration of the validity period of the expert certificate must be submitted at least 1 month before the expiration of the validity period of the expert certificate. Candidates who fail one of the stages of certification are given the opportunity to retake this stage.

The qualification exam is conducted at least once every two months in groups formed of no fewer than 15 candidates. The qualification exam is conducted by an examination commission consisting of 9 people. The qualification exam is conducted in 2 stages: Stage 1 — computer-based tests; Stage 2 — demonstration exam (only for candidates participating in the qualification exam for the first time). It is not allowed to conduct both stages of the qualification exam on the same day. A candidate who fails one of the stages of the qualification exam is given the opportunity to retake that stage. In this case, the Working Body notifies the candidate via mail or electronic communication means of the date, time, and place of the repeated qualification exam at least 3 working days before its conduct. Tests consist of 75 questions covering all sections of the study programs. Test questions are presented in the language indicated in the candidate's application (Uzbek or Russian). If the candidate's final result based on correct answers is 70 percent or higher, they are considered to have successfully passed the qualification exam. Candidates with positive test results are allowed to proceed to the second stage and are notified of the place, date, and time of the exam at least 3 working days before its conduct. The demonstration exam is conducted based on practical tasks developed on the basis of professional standards and study programs. During the demonstration exam, members of the examination commission have the right to ask additional questions related to practical tasks. The demonstration exam is evaluated by majority vote of the examination commission. A candidate who fails the exam has the right to retake the second stage upon the recommendation of the examination commission. In this case, the Working Body notifies the candidate via mail or electronic communication means of the date, time, and place of the repeated demonstration exam at least three working days before its conduct. The second stage of the qualification exam is conducted in the language indicated in the candidate's application. The candidate is given 120 minutes for the first stage of the qualification exam and 60 minutes for the second stage. A candidate who fails to answer all questions within the specified time during the qualification exam is considered to have not taken the qualification exam. The qualification exam is conducted for candidates to obtain a qualification category in accordance with the procedure specified in this chapter. To obtain a qualification category, candidates must have a document confirming completion of advanced training courses at educational institutions, a qualification certificate and badge issued by the Working Body, as well as the necessary work experience for the following periods: For Category II — from 3 to 6 years; For Category I — from 6 to 9 years; For Higher Category — above 9 years. Requirements and conditions for the qualification certificate The applicant must meet the following requirements: a) Higher technical education with at least 3 years of work experience in their specialty, or higher technical education or scientific degree obtained in foreign countries (if recognized in the Republic of Uzbekistan in the established order);

  • availability of at least 3 years of work experience as a specialist of the occupational health and safety service or an organization carrying out activities in the field of occupational health and safety, or the Sanitary and Epidemiological Welfare and Public Health Service after graduating from a higher education institution;
  • availability of at least 3 years of work experience in the last 10 years as a chief engineer, chief mechanic, chief energy engineer, or head of a production unit (department) with higher non-technical education obtained in the Republic of Uzbekistan or in foreign countries (if recognized in the Republic of Uzbekistan in the established order); b) Completion of advanced training courses with a duration of no less than 72 academic hours, provided that no more than 1 year has passed from the date of completion of training to the date of submitting documents for the qualification exam.* Each applicant holding a qualification certificate is required to undergo advanced training courses in the field of occupational health and safety with a duration of no less than 72 academic hours, approved by the Ministry of Reduction of Poverty and Employment, the Ministry of Health, and the Ministry of Higher Education, Science and Innovation, every 3 years from the year the qualification certificate was issued.

Validity period of the qualification certificate 5 years 9. Note: Advanced training in the field of occupational health and safety is carried out by professional participants of the labor market for services in the field of occupational health and safety, entered into the Unified Register of Professional Participants of the Labor Market for Services in the Field of Occupational Health and Safety, as well as by the Institute of Labor Market Research under the Ministry of Reduction of Poverty and Employment or the Republican Courses for Advanced Training of Labor Authority Employees. The qualification exam is conducted at least once every two months at the premises of the competent authority under the supervision of the Working Body, based on the applications of candidates, depending on the formation of groups. Employees of the competent authority, as well as representatives of the Committee on Sanitary and Epidemiological Welfare and Public Health, the Main Directorate of Fire Safety under the Ministry of Emergency Situations, the Inspection of Control in Electrical Engineering under the Ministry of Energy, and the Regional Directorates of the Inspection for Control of Mining, Geology, and Industrial Safety under the Ministry of Mining and Geology are involved in the activities of the Working Body. The test consists of at least 75 questions reflecting all sections of the study program, and the total duration of the exam is 45 minutes. A candidate who gives correct answers to no less than 70 percent of the questions is considered to have passed the qualification exam.

Note: Training for candidates wishing to obtain the Qualification Attestate for Corporate Managers To increase candidates' knowledge in the field of corporate governance, the Higher School of Business and Entrepreneurship continuously develops and improves a short-term (not less than one week) special training program, including online, embodying the latest modern knowledge in this field. This program is also taught in the subject of "Corporate Governance" in the specialties of "Business Management", "Capital Market and Stock Exchange Operations", and "Small Business and Private Entrepreneurship ("Business Innovations and Entrepreneurship") of the Master's degree. Training of candidates for obtaining the Qualification Attestate and issuing certificates based on study results is carried out by the Higher School of Business and Entrepreneurship in the established order. Candidates take a test at the end of the training course and, if they answer 55 percent of the total questions correctly, they receive the corresponding certificate in the established order. This certificate grants the right to claim the Qualification Attestate. If a candidate fails the test, they have the right to retake the final test two more times free of charge.

Persons who have completed training courses under the Corporate Governance Special Program of the Higher School of Business and Entrepreneurship and hold a certificate of completion, as well as students of the Higher School who have mastered the corporate governance subject at a level of 86 points and above in the master's programs "Business Management", "Capital Market and Exchange Operations", and "Small Business and Private Entrepreneurship (Business Innovations and Entrepreneurship)", have the right to apply.

Applications from participants of these training courses and master's students may be submitted within one year after the teaching of this subject.

Heads or deputy heads of state bodies, with the exception of the Agency for State Asset Management, may be elected as members of the supervisory boards of enterprises with state participation if they hold a corporate governance qualification certificate.

The requirement to hold a corporate governance qualification certificate does not apply to candidates nominated as independent members of the supervisory board with state participation, who have relevant work experience in the respective industry, including foreign persons.

Persons who have completed training courses under the Corporate Governance Special Program of the Higher School of Business and Entrepreneurship and hold a certificate of completion, as well as students of the Higher School who have mastered the corporate governance subject at a level of 86 points and above in the master's programs "Business Management", "Capital Market and Exchange Operations", and "Small Business and Private Entrepreneurship (Business Innovations and Entrepreneurship)", have the right to apply.

Applications from participants of these training courses and master's students may be submitted within one year after the teaching of this subject.

An interview is conducted with candidates for the corporate governance qualification certificate.

An interview is conducted if there are 20 or more applications.

The interview is conducted individually for each applicant for up to 20 minutes to determine the applicant's:

ability to understand the essence of corporate governance, its principles, and the ability to evaluate and diagnose corporate governance;

level of knowledge regarding the powers, duties, and obligations of the supervisory board, its initiative in decision-making, world experience in this area, and compliance with legislative norms.

Commission members ask questions to each applicant entering the individual interview. Questions are given based on the directions of the training course program conducted at the Higher School of Business and Entrepreneurship.

Interview results are evaluated based on the following criteria:

providing answers based on evidence that fully reveals the essence of the given question;

demonstrating deep and systematic knowledge on the questions;

free use of the concept and terminology of corporate governance.

Applicants who failed the interview or did not attend may submit repeated applications to the commission no more than 3 times within one year from the date of completion of the training courses under the Corporate Governance Special Program, as well as within one year from the date of obtaining the master's diploma after completing two years (full-time and part-time) of study in the master's programs "Business Management", "Capital Market and Exchange Operations", and "Small Business and Private Entrepreneurship (Business Innovations and Entrepreneurship)".

Complaints about the interview results are submitted to the chairman of the appeals commission within 3 working days from the date the results are announced.

The validity period of the qualification certificate is 5 years and is not extended. After the expiration of the term, obtaining a new certificate is carried out on general grounds.

must have higher education in one of the following specialties: finance-economics or jurisprudence, with a document confirming the acquisition of a scientific degree or a certificate of the competent state authority on the recognition of a foreign scientific degree document;

must have at least two years of work experience in the last 10 years in organizations engaged in professional activities in the securities market, stock exchanges, fund departments of other exchanges, or in state management bodies in the directions indicated above, with a document confirming higher education in finance-economics or jurisprudence, or a certificate of the competent state authority on the recognition of a foreign scientific degree document.

Alternatively, a securities market specialist holding a Category I qualification certificate:

must have higher education;

must have at least five years of work experience in the last 10 years in organizations engaged in professional activities in the securities market, stock exchanges, fund departments of other exchanges, or in state management bodies in the directions indicated above.

b) The following persons must pass certification to obtain the qualification certificate of a securities market specialist *:

heads of executive bodies of professional participants of the securities market, heads of the central depository and its structural divisions, heads of executive bodies of stock exchanges and their structural divisions, and heads of fund departments of currency exchanges;

specialists of professional participants of the securities market, the central depository's departments conducting operations related to securities, stock exchanges, and fund departments of currency exchanges, who participate in conducting operations with securities, provide services, and/or perform work in the securities market.

c) Professional participants of the securities market, stock exchanges, and fund departments of currency exchanges must have no fewer than two employees holding a qualification certificate.*

d) The head of the central depository of securities and its structural divisions, executive bodies of other professional participants, the executive body of the stock exchange and its structural divisions, and the fund department of other exchanges must meet the qualification requirements established for securities market specialists holding a Category I qualification certificate.*

e) A controller of a professional participant, stock exchange, or fund department of another exchange holding a Category I or II qualification certificate *:

must have higher education in one of the following specialties: finance-economics or jurisprudence, with a document confirming the acquisition of a scientific degree or a certificate of the competent state authority on the recognition of a foreign scientific degree document;

or must have at least two years of work experience in the last ten years in organizations engaged in professional activities in the securities market, stock exchanges, fund departments of other exchanges, or in the fields of economic, financial, and legal activities, information technology, or in state management bodies in the directions indicated above.

Note:

These Passport requirements apply to individuals with higher education who are applying for or working in professional participation in the securities market, the Central Depository of Securities (hereinafter — Central Depository), stock exchanges, and fund departments of currency exchanges.

Category I qualification certificate — a qualification category issued to individuals and required for holding the positions of head of the executive body of a professional participant of the securities market, head of the central depository and its structural divisions, head of the executive body of a stock exchange and its structural divisions, and head of the fund department of currency exchanges;

Category II qualification certificate — a qualification category issued to individuals and required for working as a specialist in professional participants of the securities market, departments of the central depository conducting operations related to securities, stock exchanges, and fund departments of currency exchanges.

The following persons may obtain a Category II qualification certificate without passing certification conducted by the competent authority and without paying the established fee as an exception:

graduates of higher education institutions holding a privileged diploma of higher education in the field of finance-economics or jurisprudence (if more than three years have passed since the day the diploma confirming higher education was issued);

individuals who, within the last five years, have obtained at least a first-level international certificate in the field of financial analysis and investments issued by the CFA Institute (Chartered Financial Analyst) international organization, or a certificate in the fields of currency and money markets, risk management, and financial analysis issued by ACI — The Financial Markets Association international organization, or an international certificate in the fields of finance, accounting, and audit issued by the ACCA (Association of Chartered Certified Accountants) international organization, or at least the Applied Knowledge level of the Financial Risk Manager FRM certificate.

Certification for the issuance of qualification certificates is conducted by the competent authority on the first Monday of each month. If this day falls on a holiday or if there is no opportunity to conduct certification (re-certification) on this day due to technical reasons, certification (re-certification) is conducted on another Monday of that month.

Applicants for a Category I qualification certificate undergo certification in two stages through a test exam.

The test exam consists of 90 questions in total.

The first stage includes 60 questions aimed at determining the applicant's general level of knowledge and skills in conducting operations with securities. Applicants are given 60 minutes to answer, and they must answer at least 45 questions correctly in the first stage.

The second stage includes 30 special questions aimed at determining the applicant's management abilities and moral worldview. Applicants are given 30 minutes to answer, and they must answer at least 22 questions correctly in the second stage.

For obtaining a Category II qualification certificate, applicants are required to successfully pass only the first stage of the test exam.

must have at least five years of work experience (including on a contract basis) or pedagogical experience in the fields of insurance, mathematics, statistics, or informatization in the last ten years.*

Note:

An examination commission is established by the competent authority for organizing and conducting the qualification exam. The examination commission consists of a chairman, deputy chairman, secretary, and at least three members.

The work of the examination commission is documented by a protocol. The protocol is approved by the chairman of the examination commission and signed by all participating members.

The composition of the examination commission includes employees of the competent authority and specialists in the fields of actuarial calculations and insurance. The composition of the examination commission is drawn up separately for each qualification exam.

The examination commission is considered competent if two-thirds of its members, as well as the chairman or deputy chairman, participate.

The qualification exam is conducted at least once every 3 months, based on the formation of a group of at least three people.

The qualification exam is conducted in two stages.

When extending the validity period of the qualification certificate, the applicant takes the re-qualification exam.

test exam (computer-based for 3 academic hours). After the test exam ends, its results are announced immediately. Based on its results, the applicant is permitted to take the written and oral exam;

written and oral exam based on exam tickets (3 academic hours are given for solving problems and preparing oral answers).

Conducting both stages of the qualification exam on the same day is not permitted.

Test questions consist of 40 theoretical questions in the following educational directions:

actuarial mathematics (10 questions);

statistics and probability theory (10 questions);

insurance business and risk theory (10 questions);

investment activity and financial management (10 questions).

One point is awarded for each correct answer.

The sum of accumulated points must be not less than 30 points for the test exam results to be considered positive.

If the test exam results are considered negative (accumulated points less than 30), the applicant is not allowed to take the exam.

The exam ticket consists of 4 theoretical questions and 4 practical problems in the following educational directions:

actuarial mathematics;

statistics and probability theory;

insurance business and risk theory;

investment activity and financial management.

Each theoretical question and practical problem in the exam ticket is evaluated on a 5-point system.

An applicant who has accumulated at least 30 points according to the exam ticket is considered to have successfully passed the qualification exam.

  • Requirements and conditions considered as gross violations.

  • Gross violations serving as grounds for the cancellation of the Actuarial Qualification Certificate include:

the establishment of a case where the actuary provides information obtained during the provision of actuarial services to third parties without the consent of the customer of the actuarial services, except in cases provided for by legislative documents;

the establishment of a case where the actuary provides this document to another person for the purpose of using it to provide actuarial services in their own name.

A person whose Actuarial Qualification Certificate has been canceled is not allowed to take the qualification exam to re-obtain the Actuarial Qualification Certificate for three years from the moment the court decision on its cancellation for gross violations during the validity period of this certificate enters into legal force.

4 times the Base Calculation Amount (BCA) for certification (additional certification) of candidates for patent attorneys and patent attorneys.

The total amount of payments is distributed as follows:

10 percent — to the personal account of the State Service Development Fund of the Ministry of Justice;

11.75 percent — to the special account of the "Center for Management of Electronic Government Projects" state institution under the Ministry of Digital Technologies at the Treasury Committee of the Ministry of Economy and Finance (including 0.5 percent for confirmation through the unified billing system);

the remaining funds — to the personal account of the Fund for the Development of Intellectual Property of the Ministry of Justice.

Note:

The Patent Attorney must apply at least two months before the expiration of the validity period of the certificate.

The qualification examination is conducted within a period not exceeding two months from the date the notification of admission to the examination is sent to the candidate or patent attorney.

The questions for the qualification examination are prepared in the following areas:

  • general rules concerning intellectual property rights;
  • legislation of the Republic of Uzbekistan concerning industrial property;
  • international treaties of the Republic of Uzbekistan in the field of industrial property.

For a candidate or patent attorney taking an interview in two or more specializations, one additional question is given for each additional specialization.

The specialization of patent attorneys is determined according to the following objects of intellectual property:

  • trademarks, service marks, indications of source and geographical indications;
  • inventions and utility models;
  • industrial designs;
  • plant breeding achievements;
  • topologies of integrated circuits.

Thirty minutes are allocated to the candidate or patent attorney for preparing to answer the questions.

For a candidate or patent attorney taking an interview in two or more specializations, 10 minutes are allocated for preparing to answer questions for each additional specialization.

If a candidate or patent attorney takes the examination in two or more specializations, a single decision is made regarding the overall results of the interview for all specializations.

Appeals by candidates or patent attorneys against the decision of the qualification commission to the appeal commission are carried out in the procedure established by the Regulation on Patent Attorneys, approved by Resolution No. 298 of the Cabinet of Ministers of the Republic of Uzbekistan dated July 1, 2003.

Admission of a candidate or patent attorney to the qualification examination is denied in the following cases:

  • if the person is not a citizen of the Republic of Uzbekistan permanently residing on the territory of the Republic of Uzbekistan;
  • if the person is an employee of the Ministry of Justice and its system organizations;
  • if incorrect or distorted information is entered into the application.

If the certification process is refused, including if a candidate or patent representative is disqualified from the exam, they may apply within six months from the date the exam was held.

  3. Requirements and Conditions for the Qualification Certificate: a) The applicant must be a member of a public association of psychologists (an individual may be a member of only one public association of psychologists at a time); b) Possession of higher education in the field of psychology or in another field of education, along with completion of retraining courses in psychology; c) Each psychologist holding a qualification certificate must undergo professional development programs approved by the competent authority or complete professional development courses of at least 60 hours at centers for professional development of psychologists every three years after obtaining the certificate; d) Permanent residency in the Republic of Uzbekistan; e) Providing information to the person seeking psychological assistance regarding the form and type of psychological assistance and other necessary information; f) Treating the person seeking psychological assistance with human dignity, respecting their honor, dignity, and professional reputation; g) Not disclosing professional secrets and personal information obtained during the provision of psychological assistance, in accordance with legislative requirements*; h) Complying with contract requirements when psychological assistance is provided on a paid basis; i) Complying with standards for the provision of psychological assistance and requirements of the Code of Ethics for Psychologists; j) Not using prohibited methods and means of providing psychological assistance, including not using physical or mental violence*; k) Respecting freedom of conscience and legislative requirements regarding religious organizations during the provision of psychological assistance, including not teaching religious doctrines, not propagating religious beliefs and ideas, not distributing materials of a religious nature, and not giving preference to or discriminating against any religion*; l) Not encouraging the commission of offenses or crimes, suicide, participation in gambling and other games of chance, or other forms of anti-social behavior*; m) Providing psychological assistance to minors only with the consent of their legal representatives. Psychological assistance may be provided to persons under the age of fourteen without the consent of their legal representatives in cases where pressure and violence against them are identified, as well as in emergency situations, critical incidents, or accidents; n) Presenting the qualification certificate upon the request of the person seeking psychological assistance or their legal representative, and providing a copy of the document indicating the form, type, and other information about the psychological assistance.

  4. Validity Period of the Qualification Certificate: 5 years

  6. Documents confirming higher education obtained in foreign countries submitted by the applicant are taken into account if they are recognized in the Republic of Uzbekistan in the established manner.

  7. Individuals with higher education in the field of psychology have the right to provide all types of psychological assistance.

  8. Individuals with higher education in fields other than psychology who have completed retraining courses in psychology have the right to provide only psychological counseling and psychological training.

  9. The duration of retraining programs is determined based on the number of subjects included in the study plan and their workload, and must not be less than 16 weeks (576 hours).

  10. The qualification exam is conducted at least once a month at the premises of the competent authority under the supervision of the exam commission, based on applicants' requests, depending on the formation of groups.

  11. The composition of the exam commission and the questions are approved by the Chairman of the Public Association of Psychologists. The exam commission includes employees of the Public Association of Psychologists, management members, and professors and teachers of higher education institutions holding PhD or DSc degrees in the field of psychology.

  12. The exam is conducted in two stages:

  • In the first stage, a test consisting of 75 questions in the field of psychology is conducted, and the total exam duration is 60 minutes. An applicant who answers at least 75 percent of the questions correctly is considered to have passed to the next stage of the qualification exam;
  • In the second stage, individual interviews are conducted with applicants. The applicant must answer 5 questions within 20 minutes.
  1. Interview results are evaluated based on the following criteria:
  • Level of understanding of permitted methods and means of providing psychological assistance for practical application and professional ethical principles set forth in the psychologist's code of ethics;
  • Skill in providing effective psychological assistance using permitted methods and means;
  • Level of consideration of the client's health, gender, age, nationality, religion, profession, values, and specific circumstances of life events during the provision of psychological assistance;
  • Level of ability to use psychodiagnostic methods and tools in providing psychological assistance;
  • Level of knowledge of the standard for providing psychological assistance.
  1. The qualification exam is conducted in the state language or Russian language, at the applicant's choice.
  2. It is not permitted to conduct both stages of the qualification exam on the same day. Both stages of the exam must be conducted within a total of five working days.
  3. A person disqualified from the qualification exam may reapply three months after the date the exam was held.
  4. An application for re-issuance of the qualification certificate due to expiration of its validity period must be submitted at least one month before the expiration of the certificate's validity period.

  2. Category of Applicants: Individual

  3. Competent Authority(ies) Issuing the Qualification Certificate: Institute for Competence Development under the Ministry of Construction and Housing and Communal Services

  4. Information Required to Obtain the Qualification Certificate: a) Application: The application must include the following information:

  • Surname, first name, and patronymic (if changed, information regarding the change must be provided);
  • Passport (ID card) series and number;
  • Individual Identification Number of the Individual (IIN);
  • Place of residence;
  • Email address (if available) and phone number;
  • Study course specialization;
  • Language of instruction;
  • Study region;
  • Test-taking region. b) The following documents must be attached:
  • Document confirming higher education. The applicant's higher education diploma and information regarding work experience are obtained independently by the competent authority through the interdepartmental integration platform of the "Electronic Government" system.
  1. Fee Charged for Taking the Test and Obtaining the Certificate: Twice the Base Calculation Amount. The collected fee is distributed as follows:
  • 30 percent to the account of the Agency for Assessment of Knowledge and Skills;
  • 20 percent to the personal account of the Republican Center for Development of Information and Communication Technologies under the Ministry of Construction and Housing and Communal Services;
  • 50 percent to the account of the Institute for Competence Development (hereinafter referred to as the "Institute").
  1. Processing Period for Applications: 1 working day

  2. Requirements and Conditions for the Qualification Certificate The applicant must have a diploma confirming higher education in the fields of urban planning and housing and communal services (for leadership of management bodies of multi-apartment buildings — higher or secondary special education) and at least 3 years of work experience in the relevant field.

  3. Validity Period of the Qualification Certificate 3 years

  4. Notes The Certificate is a state-standard document issued to a specialist who has completed the educational program at the Institute or its regional branches (hereinafter referred to as "educational institutions") and successfully passed the test, confirming the right to develop urban planning documents, conduct expertise of urban planning documents, carry out internal, authorship, technical, and state control over objects under construction, and perform control measurements on objects handed over for operation. The Certificate is issued to specialists who have completed the educational course according to programs at educational institutions and answered 56 percent or more of the questions correctly in the test conducted in the established manner. Applicants are required to study according to the program and obtain a certificate within one year from the date of appointment to the position requiring the certificate. If the applicant does not obtain the relevant certificate in the established manner within one year, their employment contract is terminated in the established manner. Applicants wishing to study in the course must choose one of the specializations of the training course organized for specialists in urban planning and housing and communal services (including those conducting project management and technical control, including control over specializations, authorship control by project organizations, chief engineers and chief architects of project organizations, internal control by contracting organizations, specialists performing control measurements, experts of expert organizations, heads of management bodies of multi-apartment buildings, district (city) and regional architects, inspectors of regional inspections for control in the field of construction and housing and communal services), submit an application, and are selected after verification of their higher education in the field of urban planning activities and at least 3 years of work experience in the relevant field. A contract is concluded for the admission of applicants who have passed the selection for study, and the established payment for study is made. The amount of payment for training under the program is determined independently by the Institute. Educational institutions send an electronic notification to the applicant at least three days before the start of educational activities (via email, mobile application, or social networks). Applicants are permitted to participate in educational activities (study) with or without release from their workplace. Applicants pay the fee established by the Agency for Assessment of Knowledge and Skills (hereinafter referred to as the "Agency") for participation in the test conducted by the Agency during the educational process. After completion of the program-based study, the educational institution submits a request to the Agency to test the applicants' acquired knowledge. Applicants included in the list submitted to the Agency via the request must participate in tests within three months from the date of completion of study. Applicants who fail to pass the test and wish to upgrade their category are given the opportunity to retake the test within three months by paying a fee equal to twice the Base Calculation Amount. In this case, the highest indicator in the test results of the applicant retaking the test is taken into account. Applicants who do not participate in tests conducted during this period are considered to have failed the test. The Agency ensures the conduct of the test within five working days from the date of receipt of the request. Test items are developed by the Agency in a manner ensuring confidentiality and are systematically updated. In developing test items, the program and legislative acts in the field of urban planning activities in force are used. Applicants are checked and admitted upon presentation of the original of a document confirming their identity (biometric passport, passport for travel abroad, identification ID card, driver's license of the new sample, etc.). Applicants who did not come or were late for the test are permitted to participate in the next tests within three months. The test is conducted on a computer with the participation of commission members and observers approved by the Agency. The number of test items corresponds to 50 items according to the specialization indicated in the applicants' request. The applicant is given two hours to take the test. It is prohibited to bring any mobile communication devices and cheat sheets into the room where the test is conducted, and to communicate with other applicants. Applicants who violate these requirements are disqualified from the test and considered to have failed. A protocol is drawn up for applicants disqualified from the test (the applied measure applies only to this specific test). The results of the test are generated on the computer at the time the test ends. If the applicant disagrees with the test results, they have the right to file a complaint with the Agency regarding the test results at the time the results are announced on the computer. A commission consisting of 5 or 7 members is formed annually by joint order of the heads of the Agency and the Institute to consider complaints. The commission considers the complaint within one week. The applicant is notified in writing or electronically of the commission's decision. Based on the results of the complaint consideration, one of the following decisions is made:

  • To leave the test results unchanged and reject the satisfaction of the complaint;
  • To change the test results and satisfy the complaint. If the evidence presented by the applicant is not confirmed, a decision is made to reject the satisfaction of the complaint. If the evidence presented by the applicant is found to be justified, the test results are changed by commission decision. Repeated complaints are not considered. Applicants may file a complaint with the court against the commission's decision in the manner established by legislative acts. Test items in the test must correspond to the specialization and object hazard categories indicated in the applicants' request. For 50 test items:
  • An applicant who answers 28 to 35 items correctly (56 to 70 percent) is granted the right to develop architecture-urban planning documents of construction objects, conduct expertise of urban planning documents, perform technical control, control the quality of construction and installation works, and perform control measurements for Category II construction objects according to hazard level;
  • An applicant who answers 36 to 42 items correctly (71 to 85 percent) is granted the right for Category III construction objects;
  • An applicant who answers 43 to 50 items correctly (86 to 100 percent) is granted the right for Category IV construction objects. The Ministry of Construction and Housing and Communal Services maintains an electronic registry of certified specialists in the fields of urban planning and housing and communal services. The following information is recorded in the registry: a) Surname, first name, patronymic, postal address, email address (if available), phone number of the certified specialist; b) Individual Identification Number of the Individual (IIN); c) Certificate number, date of issue, and validity period; d) Certified specialists:
  • By regions (regions and districts);
  • By sectors (architecture, engineering, construction, and housing and communal services);
  • By specializations (project-search, contracting, technical control and architecture, expertise, state control, control measurements). Information about the expiration of the certificate's validity period and its removal from the registry is also entered into the registry. The procedure for maintaining the registry is established by the Ministry of Construction and Housing and Communal Services. The following are grounds for suspending the validity of the certificate:
  • If it is established that the applicant intentionally filled in incorrect information specified in this passport to obtain the certificate;
  • Upon the entry into legal force of a court decision recognizing the certificate holder as legally incapacitated or partially legally incapacitated, or a court sentence depriving them of liberty;
  • Upon the entry into legal force of a court decision in a criminal case initiated against the certificate holder for abuse of official powers;
  • Due to the death of the certificate holder. The validity of the certificate is terminated from the date of adoption of the order on suspending its validity, and the right of the certified specialist to engage in urban planning activities is suspended. The specialist may file a complaint with the court against the order of the Ministry of Construction and Housing and Communal Services on suspending the validity of the certificate in the manner established by legislative acts.
