PERU Ministry of Economy and Finance SMV Superintendency of Securities Market DECADE OF PERSONS WITH DISABILITIES IN PERU - YEAR OF THE CONSOLIDATION OF THE GRAU SEA 1 Resolution of the General Intendancy SMV No. 002-2016-SMV/11.2 Lima, October 25, 2016 The General Intendant for Compliance with Conducts HAVING SEEN: Files Nos. 2015035680, 2016009862 and 2016031962 referring to administrative sanctioning procedures initiated against Empresa Agraria Azucarera Andahuasi S.A.A.; WHEREAS: That, Article 149 of the General Administrative Procedure Law, Law No. 27444, establishes that the authority responsible for the instruction, on its own initiative or at the request of the interested parties, shall order, by means of an unappealable resolution, the accumulation of ongoing procedures that are related; That, likewise, the seventh paragraph of Article 12 of the Sanctions Regulations, approved by CONASEV Resolution No. 055-2001- EF/94.10, establishes that the General Intendancies for Compliance, on their own initiative or at the request of the interested parties, may order, by means of an unappealable resolution, the accumulation of ongoing sanctioning procedures that are related; That, in the administrative sanctioning procedures contained in files Nos. 2015035680, 2016009862 and 2016031962, the authority responsible for the instruction is the General Intendancy for Compliance with Conducts of the Deputy Superintendency for Market Conduct Supervision, in accordance with the provisions of Article 10 of the aforementioned Sanctions Regulations and subsection 2 of Article 49 of the Regulations on Organization and Functions of the Superintendency of Securities Market – SMV, approved by Supreme Decree No. 216-2011-EF; That, from the review of the administrative sanctioning procedures referred to in the aforementioned files, it has been verified that there are common elements, and therefore they are related; and, In accordance with the provisions of Article 149 of the General Administrative Procedure Law, Law No. 27444 and the seventh paragraph of Article 12 of the Sanctions Regulations, approved by CONASEV Resolution No. 055- 2001-EF/94.10; RESOLVES: Article 1.- To accumulate files Nos. 2015035680, 2016009862 and 2016031962 for their joint resolution, which will form file No. 2015035680.
