The Head of the Human Resources Unit

HAVING SEEN:

File No. 2025049776, which contains Report No. 888-2026-SMV/08.2 issued by the Human Resources Unit (hereinafter referred to as HRU for these purposes), endorsed by the Administration Office, through which it proposes to update the section on confident servants of the Direct Hiring Registry (hereinafter RCD);

CONSIDERING:

That, in accordance with Article 1 of the Unified Text of the Organic Law of the National Commission for the Supervision of Companies and Securities, approved by Legislative Decree No. 26126, modified by Law No. 29782, the Superintendencia del Mercado de Valores (SMV) is a specialized technical body attached to the Ministry of Economy and Finance with legal personality of internal public law and enjoys functional, administrative, economic, technical, and budgetary autonomy;

That, by Supreme Decree No. 216-2011-EF, published on December 2, 2011, and its amendments, the Regulation of Organization and Functions (ROF) of the SMV was approved;

That, by Executive Presidency Resolution No. 133-2024-SERVIR-PE, the agreement of the Board of Directors of the National Civil Service Authority – SERVIR, adopted in Session No. 14-2024-CD, was formalized, through which the Entity Position Chart (hereinafter CPE) of the Superintendencia del Mercado de Valores was approved;

That, pursuant to letter v. of Article 4 of Directive No. 002-2024-SERVIR-GDSRH, “Design and structure of positions and roles for the elaboration, approval, administration and modification of the Entity Position Chart”, approved by Executive Presidency Resolution No. 000017-2024-SERVIR-PE, the CD registry is defined as “(...) the planning and management document for the incorporation of positions/roles and positions that will be subject to direct hiring as long as it is projected that they will be occupied by civil servants of confidence of the public entity and/or meet another of the circumstances set forth in Article 178 of the General Regulation of Law No. 30057, Civil Service Law. In the case of servants with the condition of confidence, these are included regardless of their labor regime or hiring modality”;

That, numeral 6.3 of Article 6 Responsibilities of Directive No. 005-2024-SERVIR-GDSRH, “Direct hiring of positions under the civil service regime and maximum limit for temporary hiring”, approved by Executive Presidency Resolution No. 000058-2024-SERVIR-PE, provides that it is the responsibility of the HRU to keep the RCD and the resolutive acts approving it, published on the digital seat of the public entity, updated;

That, on the other hand, Article 9 of Directive No. 005-2024-SERVIR-GDSRH establishes that the RCD “(...) is administered in phase 2 of the process of Transition to the Civil Service Law, corresponding to the transition of public servants to the Civil Service regime. The public entity elaborates, administers and updates said document for the incorporation of positions and roles, through direct hiring.”, mentioning that Annex No. 01 “Direct Hiring Registry”, is composed of four (4) sections among which is the Section of confident servants;

That, pursuant to numeral 10.3 of Article 10 of Directive No. 005-2024-SERVIR-GDSRH, the HRU updates the RCD in its section of Confident Servants in accordance with numeral 10.2 of the aforementioned Directive, without affecting compliance with what is provided in Law No. 30057, Law No. 31419 and current regulations, under responsibility;

That, by Superintendent Resolution No. 062-2026-SMV/02, of June 5, 2026, Mr. Jorge Heraclio García Paz was appointed under the regime of Law No. 30057 – Civil Service Law, in the position of “Executive of the Logistics Unit”, position code CA40090;

That, by virtue of the aforementioned appointment and for the reasons exposed in the document of having seen, in compliance with the regulatory framework indicated, with the endorsement of the Administration Office, it corresponds to update the section of confident servants of the RCD of the entity considering the fields detailed in the annex of this resolutive act;

Being aware of the above and in accordance with the cited provisions of Directive No. 005-2024-SERVIR-GDSRH, Direct hiring of positions under the civil service regime and maximum limit for temporary hiring, approved by Executive Presidency Resolution No. 000058-2024-SERVIR-PE and numeral 12 of Article 26 of the Regulation of Organization and Functions of the Superintendencia del Mercado de Valores, approved by Supreme Decree No. 216-2011-EF and its amendments;

RESOLVES:

Article 1.- Approve the update of the section of confident servants of the Direct Hiring Registry of the Superintendencia del Mercado de Valores, in accordance with the Annex that forms an integral part of this Resolution.
