The Superintendency of Banking, Insurance and Private Pension Fund Administrators modifies Annex C of Resolution SBS No. 4797-2015 to require geographic coordinates for branch inventories and updates Report No. 30 of the Financial System Accounting Manual to include these coordinates. It also amends Report No. 32-B to capture electronic money holder data by gender and electronic medium, and introduces a new quarterly format to track user numbers and transaction flows for mobile applications and homebanking. These formats must be submitted by multiple-operation companies, electronic money issuers, the National Bank, and the Agricultural Bank, with specific effective dates ranging from January 2023 to October 2023.

Resolution S.B.S. No. 02326-2022
The Superintendent of Banking, Insurance and Private Pension Fund Administrators:
CONSIDERING:
That, by means of Resolution SBS No. 6283-2013 and its modifying regulations, the Regulation on Electronic Money Operations was approved, which establishes the regulatory framework under which electronic money operations shall be governed;
That, by means of Resolution SBS No. 4797-2015, the Regulation on Opening, Conversion, Transfer or Closure of Offices and Use of Shared Premises, applicable to companies in the financial system, insurance companies and electronic money issuing companies, was approved;
That, by means of Resolution SBS No. 4798-2015 and its modifying regulations, the Regulation on Complementary Channels for Public Attention of Companies in the Financial System and Electronic Money Issuing Companies was approved;
That, by means of Resolution SBS No. 895-98 and its modifying and complementary regulations, the Accounting Manual for Companies in the Financial System was approved;
That, it is convenient to modify and/or create certain annexes, reports and formats with the objective of capturing information not available in the current formats, necessary to measure with greater precision the access and use of financial services and to identify gaps in financial inclusion;
That, in this sense, this Superintendency has considered it appropriate to require the georeferencing coordinates (longitude and latitude) in Annex C "Inventory of Operating Offices" established in the "Regulation on Opening, Conversion, Transfer or Closure of Offices and Use of Shared Premises", as well as in Report No. 30 "ATMs, Basic Operation Establishments and Correspondent ATMs" of Chapter V "Complementary Information" of the Accounting Manual for Companies in the Financial System, with the objective of measuring with greater precision the location of service points and better identifying gaps in access to financial services in the country;
Los Laureles Nº 214 - Lima 27 - Peru Tel. : (511)6309000 2 That, likewise, it is necessary to modify Report No. 32-B "Monthly Electronic Money Report" of Chapter V "Complementary Information" of the Accounting Manual for Companies in the Financial System, in order to capture the number of holders and/or electronic money accounts by gender and electronic medium (cell phone, pre-paid cards, others), in order to complement the information on the use of electronic money;
That, taking into account the growing trend in the use of digital channels, associated with homebanking and mobile applications, for payments by the population, motivated mainly by the health emergency situation the country is going through, and the relevance that digital payments have for financial inclusion objectives, it is considered appropriate to create a new Format "Operations through Mobile Applications and Homebanking", which captures the number of registered users and the flow of operations carried out through said channels;
That, for the purpose of collecting the opinions of the general public regarding the proposals for modification of the regulations applicable to supervised companies, the pre-publication of the draft resolution on the matter was ordered on the electronic portal of the Superintendency, under the provisions of the Thirty-Second Final and Complementary Provision of the General Law of the Financial System and the Insurance System and Organic Law of the Superintendency of Banking and Insurance – Law No. 26702 and its modifying regulations, hereinafter General Law, and in Supreme Decree No. 001-2009-JUS and its modifications;
Having the approval of the Adjunct Superintendencies of Banking and Microfinance, Risks, Economic Studies, Legal Advice, Insurance, Market Conduct and Financial Inclusion and General Secretariat; and,
In exercise of the powers conferred by paragraphs 7, 9 and 13 of Article 349 of the General Law;
RESOLVES:
Article First.- Modify Annex C "Inventory of Operating Offices" of the Regulation on Opening, Conversion, Transfer or Closure of Offices and Use of Shared Premises approved by Resolution SBS No. 4797-2015 according to the format shown in Annex 1 which forms an integral part of this Resolution, and is published on the institutional portal (www.sbs.gob.pe), in accordance with the provisions of Supreme Decree No. 001-2009-JUS and its modifications.
Article Second.- Modify Report No. 30 "ATMs, Basic Operation Establishments and Correspondent ATMs" and Report No. 32-B "Monthly Electronic Money Report" of Chapter V "Complementary Information" of the Accounting Manual for Companies in the Financial System approved by Resolution SBS No. 895-98 and its modifying and complementary regulations, according to the formats shown in Annexes 2 and 3 which form an integral part of this Resolution, and are published on the institutional portal (www.sbs.gob.pe), in accordance with the provisions of Supreme Decree No. 001-2009-JUS and its modifications.
Article Third.- Incorporate the Format "Operations through Mobile Applications and Homebanking" of quarterly frequency, according to the format shown in Annex 4 which forms an integral part of this Resolution, and is published on the institutional portal
Los Laureles Nº 214 - Lima 27 - Peru Tel. : (511)6309000 3 (www.sbs.gob.pe), in accordance with the provisions of Supreme Decree No. 001-2009-JUS and its modifications. The aforementioned format must be sent within fifteen (15) calendar days following the close of each quarter, through the Capture and External Validation Submodule - SUCAVE, according to the corresponding instructions.
Article Fourth 1 . - The modified formats, as well as the new format, which form an integral part of this Resolution, begin to be sent to this Superintendency according to the following detail: The Format "Operations through Mobile Applications and Internet Banking" must be sent by multiple-operation companies included in paragraph A of Article 16 of the General Law, electronic money issuing companies referred to in paragraph 4 of Article 17 of the General Law, the National Bank and the Agricultural Bank.
(*) Sections I, II, III and V of Report No. 32-B "Monthly Electronic Money Report" whose format was approved with Resolution SBS No. 2326-2022 enter into force for information corresponding to June 2023 which is sent in July 2023. Section IV of Report No. 32-B "Monthly Electronic Money Report" whose format was approved with Resolution SBS No. 2326-2022, is considered modified by Annex 2 of Resolution SBS No. 03932-2022 which enters into force for information corresponding to January 2023 which is sent in February 2023 2.
