Circular PI/MAF/CIR/01/2015 revokes Circular Letter No. 2 of 2002 with immediate effect due to contradictory provisions and conflicts with Regulation 3 of the Medical Aid Funds Act. The revoked circular pertained to payments made by medical aid funds or administrators to healthcare intermediaries. The Medical Aid Funds Act prohibits registered funds and administrators from paying or offering payment to any person for introducing new members or retaining existing ones.

SUBJECT: REVOCATION OF CIRCULAR LETTER NO. 2 OF 2002
1 Introduction
1.1 This Circular is issued by virtue of NAMFISA’s functions and powers and those of its CEO in his capacity as the Registrar of medical aid funds in terms of the Namibia Financial Institutions Supervisory Authority Act, Act No. 3 of 2001 and is applicable to all medical aid funds registered under the Medical Aid Funds Act, Act No. 23 of 1995.
1.2 The purpose of this Circular is to notify the industry of the revocation of Circular letter no. 2 of 2002, dated 19 April 2002, pertaining to the payment of healthcare intermediaries by medical aid funds and/or medical aid fund administrators.
2 Revocation of Circular letter no. 2 of 2002
As a result of NAMFISA’s on-going process of reviewing old Circulars, the Registrar has found that the aforesaid Circular letter no. 2 of 2002 contains contradictory provisions and is in conflict with Regulation 3 under the Medical Aid Funds Act which prohibits registered funds and administrators from paying or offering to pay any person for the introduction of a new member to a fund or for consenting to retain any person as a member of the fund. In light thereof, the aforesaid Circular is hereby revoked with immediate effect.
