Having regard to the Constitution, Article 108; Having regard to the Act of 6 August 1990 concerning the mutual funds and the national unions of mutual funds, Article 52, first paragraph, 11°, inserted by the Act of 26 April 2010 and amended by the Acts of 17 July 2015 and 13 March 2016; Having regard to the Act of 13 March 2016 on the status of and supervision over insurance or reinsurance undertakings, Article 677; Having regard to the opinions of the Inspector of Finances, given on 12 April, 3 May, 6 May and 24 June 2021; Having regard to the agreement of the Secretary of State for the Budget, given on 6 July 2021; Having regard to the opinions of the National Bank of Belgium, given on 17 March and 1 June 2021; Having regard to the opinions of the Council of the Control Office for the mutual funds and the national unions of mutual funds, given on 26 February and 14 May 2021; Having regard to the opinions of the Technical Committee established by the Control Office for the mutual funds and the national unions of mutual funds, given on 18 March and 11 June 2021; Having regard to the regulatory impact analysis, carried out in accordance with Articles 6 and 7 of the Act of 15 December 2013 containing various provisions concerning administrative simplification;

Vu la Constitution, l’article 108; Vu la loi du 6 août 1990 relative aux mutualités et aux unions nationales de mutualités, article 52, alinéa 1er, 11°, inséré par la loi du 26 avril 2010 et modifié par les lois des 17 juillet 2015 et 13 mars 2016; Vu la loi du 13 mars 2016 relative au statut et au contrôle des entreprises d’assurance ou de réassurance, l’article 677; Vu les avis de l’Inspection des Finances donnés les 12 avril, 3 mai, 6 mai et 24 juin 2021; Vu l’accord de la Secrétaire d’Etat au Budget, donné le 6 juillet 2021; Vu les avis de la Banque nationale de Belgique, donnés les 17 mars et 1er juin 2021; Vu les avis du Conseil de l’Office de contrôle des mutualités et des unions nationales de mutualités, donnés les 26 février et 14 mai 2021; Vu les avis du Comité technique institué auprès de l’Office de contrôle des mutualités et des unions nationales de mutualités, donnés les 18 mars et 11 juin 2021; Vu l’analyse d’impact de la réglementation réalisée conformément aux articles 6 et 7 de la loi du 15 décembre 2013 portant des dispositions diverses en matière de simplification administrative;

Having regard to Opinion 70.151/1 of the Council of State, given on 6 October 2021 in application of Article 84, § 1, first paragraph, 2°, of the laws on the Council of State, coordinated on 12 January 1973; On the proposal of the Minister of Economy and Work, of the Minister of Social Affairs, and on the advice of the Ministers meeting in Council; We have decided and decide:

Article 1. Without prejudice to Article 46, § 1, second paragraph, of the Act of 13 March 2016 on the status of and supervision over insurance or reinsurance undertakings, mutual insurance companies are exempt from compliance with the obligations referred to in Article 83/1, first paragraph, of the same Act, provided that this exemption does not detract from the suitability of the governance system of the mutual insurance company concerned, in particular the suitability of its supervision structures regarding effective management and the collegiality of the latter. The Control Office for the mutual funds and the national unions of mutual funds monitors compliance with this condition.

Art. 2. This Decree shall take effect as of 19 July 2021.

Art. 3. The Ministers competent for Economy and Social Affairs are charged with the implementation of this Decree.

Legal grounds

• the Decree of 7 June 2013 concerning the Flemish integration and civic integration policy, Article 8, first paragraph, and Article 9, first paragraph, replaced by the Decree of 18 January 2019, and Article 11, second paragraph, amended by the Decree of 18 January 2019.

Formal requirements The following formal requirement has been met:

• The Inspection of Finances gave its opinion on 22 November 2021.
• The Flemish Minister competent for budgetary policy gave his agreement on 25 November 2021.

Reasoning This decision is based on the following reasons:

• The Flemish Minister competent for equal opportunities, integration and civic integration decided on 13 July 2021 to select LEVL vzw as a candidate participation organization based on the application for recognition submitted and its substantive assessment by the Agency for Internal Administration.
• The selected candidate participation organization submitted a multi-year plan for the period 2022-2026 on 25 August 2021, which complies with the provisions of Article 5, § 1, of the Decision of the Flemish Government of 26 June 2020 implementing the Decree of 7 June 2013 concerning the Flemish integration and civic integration policy, with regard to the participation organization, and amending the Decision of the Flemish Government of 26 April 2019 implementing various provisions of the Decree of 7 June 2013 concerning the Flemish integration and civic integration policy with regard to the participation organization and the orientation of non-native speakers towards the most appropriate NT2 offer, and amending various provisions of the Decision of the Flemish Government of 29 January 2016 implementing the Decree of 7 June 2013 concerning the Flemish integration and civic integration policy, taking into account the policy priorities determined by the Flemish Minister competent for equal opportunities, integration and civic integration in the Ministerial Decision of 11 October 2020 on the determination of the policy priorities for the participation organization for the five-year period from 1 March 2021.

Vu l’avis 70.151/1 du Conseil d’Etat, donné le 6 octobre 2021, en application de l’article 84, § 1er, alinéa 1er, 2°, des lois sur le Conseil d’Etat, coordonnées le 12 janvier 1973; Sur la proposition du Ministre de l’Économie et du Travail, du Ministre des Affaires sociales, et de l’avis des Ministres qui en ont délibéré en Conseil; Nous avons arrêté et arrêtons :

Article 1er. Sans préjudice de l’article 46, § 1, alinéa 2, de la loi du 13 mars 2016 relative au statut et au contrôle des entreprises d’assurance ou de réassurance, les sociétés mutualistes d’assurance sont dispensées du respect des obligations visées à l’article 83/1, alinéa 1er, de la même loi à la condition que cette dispense ne porte pas atteinte au caractère adéquat du système de gouvernance de la société mutualiste d’assurance concernée en particulier l’adéquation de ses structures de surveillance de la direction effective et de la collégialité de cette dernière. L’Office de contrôle des mutualités et des unions nationales de mutualités veille au respect de cette condition.

Art. 2. Le présent arrêté produit ses effets le 19 juillet 2021.

Art. 3. Les ministres qui ont l’Economie et les Affaires sociales dans leurs attributions sont chargés de l’exécution du présent arrêté.
