The Superintendence of Banks of Panama instructs banking entities to conduct a comprehensive review of their fee schedules to ensure they contain updated amounts for commissions, charges, and interest rates applicable to active and passive products. Banks must also verify that their websites display this information in a visible and easily accessible space, rather than requiring deep navigation, to comply with Agreement No. 1-2011. This directive aims to ensure transparency so that users can clearly understand costs and make informed decisions.

Reference: Update of fee schedules

Dear General Manager:

By means of this letter, we remind you that Article 8 of Agreement 1-2011 "By which guidelines are issued for the transparency of information through the use of banking products and services" establishes that banking entities are obligated to maintain in public service offices a fee schedule containing the interest rates, commissions, and surcharges applied by the bank to each of the products and services offered, which must be located in a visible place within the establishment. Furthermore, it is provided that the list or fee schedule exhibited by the bank both in its public service offices and on its website and other dissemination media must include the date of its last update and the date of entry into force.

In this regard, we urge banking entities to, in compliance with this provision, conduct a comprehensive review of their fee schedules with the purpose of verifying that they contain the updated amounts of commissions and charges applicable to each of their products, as well as the corresponding interest rates for active products and passive products.

If, as a result of these internal reviews, the bank detects that there are commissions or charges that are currently not being collected, or that the costs of commissions or interest rates do not reflect the current reality, it must consequently make the corresponding updates to the fee schedule with the purpose of promoting transparency and allowing users of the banking system to clearly know what the costs of commissions and surcharges associated with the products or services they wish to contract are, and based on this, to be able to make informed decisions.

On the other hand, it is important to highlight that Article 11 of Agreement No. 1-2011, which refers to "information that the bank's website must contain regarding interest rates and commissions," establishes that banks must have on their website information regarding the interest rates and commissions that apply to their products and services in general in a visible and easily accessible space, with the purpose that users can know the fees applied by the bank. However, in some reviews conducted, it has been evidenced that not all banking entities' websites display this information in a visible and easily accessible space; on the contrary, it is necessary to perform a deep search on the website to locate this information.

Therefore, we urge banking entities to review their websites to verify that the publication of fee schedules, which include the publication of commissions and interest rates, appears in a visible and easily accessible manner, with the purpose of complying with the provisions of the regulation and allowing the client to access its content without greater difficulty.

We thank the Manager for issuing pertinent instructions to the personnel under their charge for the compliance with the present.
