Securities Commission of The Bahamas Notice on UN Sanctions List Amendment for DPRK Entity

Licensees and registrants of the Securities Commission of The Bahamas must ensure full compliance with section 3A of the International Obligations (Economic and Ancillary Measures) Act following the United Nations Security Council's amendment of its Sanctions List for the Democratic People’s Republic of Korea on 15 April 2024. Affected entities are required to confirm compliance within 30 days of the notice and quarterly thereafter using Form 1A or 1B, and must file an annual declaration by 31 January signed by at least two directors or one director and the compliance officer. Any matches involving sanctioned individuals or entities must be reported immediately to the Financial Intelligence Unit and the Director of Legal Affairs, while failure to submit required reports may result in disciplinary action including a minimum fine of $200.00 per day.

Date: 16 April 2024 To: All Registrants and Licensees Re: International Obligations (Economic and Ancillary Measures) Act, Chapter 16 (IOEAMA): Democratic People’s Republic of Korea Pursuant to section 3A of the International Obligations (Economic and Ancillary Measures) Act, Chapter 16 (IOEAMA), licensees and registrants of the Securities Commission of The Bahamas (the Commission) are hereby informed that on 15 April 2024, the Security Council Committee established pursuant to resolution 1718 (2006) enacted the amendments, specified with strikethrough and/or underline, in the United Nations’ press release attached hereto on its Sanctions List of individuals and entities.   1. https://press.un.org/en/2024/sc15664.doc.htm Licensees and registrants are urged to take all appropriate actions to ensure full compliance with section 3A IOEAMA, Part IV, “Implementation of United Nations Security Resolutions”, of the Anti-Terrorism Act, and regulation 8 of the Anti-Terrorism Regulations. Licensees and registrants must confirm compliance within 30 days of the date of this notice and on a quarterly basis thereafter by submitting Form 1A or 1B attached, as appropriate. Where there is a hit regarding a sanctioned individual or entities, licensees and registrants must report to the Financial Intelligence Unit and the Director of Legal Affairs at the Office of the Attorney General, A. Please note that licensees and registrants are also required to submit confirmation of compliance to the Commission where there are no findings or hits. Licensees and registrants are further required to file an annual declaration, certifying that their operations are in full compliance with the aforementioned legislative provisions, signed by at least two Directors of its Board of Directors or in the alternative, one Director and the compliance officer registered with the Commission. The Commission further advises that the filing deadline relative to the annual declaration is 31 January annually. See Form 2 attached.
