The Central Bank of Bolivia approves the 2013 Service Commission and Fine Tables, effective January 2, 2013, replacing previous resolutions 159/2011 and 048/2012. Financial entities are subject to specific percentage-based commissions on foreign transfers, letters of credit, and account maintenance, as well as fixed Boliviano fines for operational non-compliance such as insufficient funds, delayed ALADI reporting, and improper USD packaging.

BOARD RESOLUTION No. 212/2012
SUBJECT: INTERNATIONAL OPERATIONS MANAGEMENT - APPROVES SERVICE COMMISSION TABLE AND CENTRAL BANK OF BOLIVIA FINE TABLE FOR THE 2013 MANAGEMENT PERIOD.
HAVING SEEN:
Law 1670 of October 31, 1995, of the Central Bank of Bolivia (BCB).
The BCB Statute approved by Board Resolution No. 128/2005 of October 21, 2005 and subsequent modifications.
Board Resolution No. 159/2011 of December 13, 2011, which approves the Service Commission Table and the BCB Fine Table for the 2012 management period.
Board Resolution No. 048/2012 of April 24, 2012, which approves modifications to the BCB Service Commission Table for the 2012 management period.
The Report from the International Operations Management BCB-GOI-INF-2012-20 of December 5, 2012.
The Report from the Legal Affairs Management BCB-GAL-SANO-INF-2012-386 of December 7, 2012.
CONSIDERING:
That according to article 54, subsection n) of Law No. 1670, it is the responsibility of the Board to formulate policies regarding the internal management of the BCB, supervising their execution.
That according to article 11, numeral 45) of the BCB Statute, the Board has among its powers the authority to set annually the table of commissions to be charged for the services it provides.
That the International Operations Management, according to Report BCB-GOI-INF-2012-20, states that the commissions charged by the BCB for the provision of banking and financial services are intended to cover their respective operating costs, which is why it is necessary to periodically adjust these commissions, in order to adapt them to current market conditions.
That as expressed in Report BCB-GAL-SANO-INF-2011-386, in the opinion of the Legal Affairs Management, there is no legal impediment for the Board to consider the approval of the Service Commission Tables and the BCB Fine Tables for the 2013 management period.

THEREFORE, THE BOARD OF DIRECTORS OF THE CENTRAL BANK OF BOLIVIA RESOLVES:
Article 1.- Approve the Service Commission Table and the Fine Table of the Central Bank of Bolivia for the 2013 management period, which forms part of this Resolution as an annex, and which will enter into effect from January 2, 2013.
Article 2.- From January 2, 2013, Board Resolutions Nos. 159/2011 and 048/2012 are repealed, as well as all provisions contrary to this Resolution.
Article 3.- The Presidency and General Management are charged with the execution and compliance of this Resolution.
