HAVING SEEN:
Administrative file No. 2021008834 and Adjunct Superintendent Resolution SMV No. 066-2025-SMV/10, dated December 31, 2025; and,
CONSIDERING:

Pursuant to Article 1 of the operative part of Adjunct Superintendent Resolution SMV No. 066-2025-SMV/10, dated December 31, 2025 (hereinafter, the RESOLUTION), it was resolved to declare partially founded the reconsideration appeal filed by Popular S.A. Investment Fund Administrator Society against Adjunct Superintendent Resolution SMV No. 055-2021-SMV/10;

This Superintendency notes that there has been a material error in Article 1 of the operative part of the RESOLUTION by stating that the declaration is regarding the aspect referred to the infringement for non-compliance with the Participation Regulations of the Capital Emprendedor Fund – Investment Fund, in accordance with what is provided by Article 212, numeral 212.1 of the Single Text of the General Administrative Procedure Law, Law No. 27444, approved by Supreme Decree No. 004-2019-JUS (hereinafter, TUO OF THE LPAG); since said error does not alter the substantial content, nor the meaning of the decision, it corresponds to be rectified;

It is necessary to state that, as provided by Article 212, numeral 212.2, of the TUO OF THE LPAG, the rectification adopts the forms and modalities of communication or publication that correspond to the original act, which is why it corresponds to this Adjunct Superintendency to issue the resolution

Being in accordance with what is provided in Article 32, numeral 16, of the Organization and Functions Regulations of the SMV, approved by Supreme Decree No. 216-2011-EF and its modification.
RESOLVES:
Article 1st.- Rectify the material error contained in the text of Article 1 of Adjunct Superintendent Resolution SMV No. 066-2025-SMV/10, dated December 31, 2025, which states:
"Article 1st.- Declare partially founded the reconsideration appeal filed by Popular S.A. Investment Fund Administrator Society against Adjunct Superintendent Resolution SMV No. 055-2021-SMV/10, in the aspect referred to the infringement for non-compliance with the Participation Regulations of the Capital Emprendedor Fund – Investment Fund, for the reasons exposed in this resolution."
This article must state:
"Article 1st.- Declare partially founded the reconsideration appeal filed by Popular S.A. Investment Fund Administrator Society against Adjunct Superintendent Resolution SMV No. 055-2021-SMV/10, in the aspects of Articles 2nd and 4th referred to (i) the non-compliance with the Participation Regulations of the Capital Emprendedor Fund – Investment Fund, for not observing provisions relative to the process of execution of guarantees and for not meeting the requirement of valuation of real estate given as guarantee for the approval of investments; and, (ii) the non-compliance in the preparation of the financial statements of Popular S.A. Investment Fund Administrator Society, respectively; for the reasons exposed in this resolution."
Article 2nd.- Transcribe this resolution to Popular S.A. Investment Fund Administrator Society.
