The Superintendent of the Securities Market

HAVING SEEN:

File No. 2024010024 and Memorandum No. 687-2026-SMV/07 from the Office of Planning, Management and Integrity; through which the approval of a Procedure prepared by the Human Resources Unit for the selection of personnel under the regime of Law No. 30057, Civil Service Law - SERVIR, is proposed.

CONSIDERING:

That, Law No. 27658, Framework Law for the Modernization of State Management, declares the Peruvian State in a process of modernization with the aim of improving public management and building a democratic, decentralized state at the service of the citizen;

That, with Supreme Decree No. 103-2022-PCM, the National Policy for the Modernization of Public Management to 2030 was approved, as the main guiding instrument that will guide the process of modernization of public management in Peru towards the greater satisfaction of citizens;

That, with the aim of establishing the structure and content of the internal normative documents of the Securities Market Superintendence (SMV), as well as the specifications that regulate their elaboration, updating, approval and publication, DIR-SIG-PLS-001 - Directive on Internal Normative Documents was issued, whose Version 2.0 was approved by Superintendent Resolution No. 061-2021-SMV/02;

That, DIR-SIG-PLS-001 - Directive on Internal Normative Documents provides that Procedures are approved by Superintendent Resolution and contain the documented description of how the activities that make up a process must be executed, taking into account the elements that compose it and its sequence, thereby allowing coherent operation;

That, in accordance with what is provided for in the Directive on Internal Normative Documents, the Human Resources Unit identified the need to elaborate the procedure “PRO-GRE-RHH-030 - Personnel Selection Processes under the Regime of Law No. 30057, Civil Service Law – SERVIR”, in order to continue with the transition process of the SMV to the Civil Service Law, in accordance with Directive No. 004-2024-SERVIR-GDSRH - Rules for the management of selection processes under the regime of Law No. 30057, Civil Service Law, approved by Executive Presidency Resolution No. 050-2024-SERVIR-PE; and,

Being in accordance with what is established in numeral 21 of article 3 of the Unified Concordant Text of the Organic Law of the SMV, approved by Legislative Decree No. 26126, and by numeral 16 of article 12 of the Organization and Functions Regulation of the SMV, approved by Supreme Decree No. 216-2011-EF and its amendments;

RESOLVES:

Article 1.- Approve the procedure “PRO-GRE-RHH-030 - Personnel Selection Processes under the Regime of Law No. 30057, Civil Service Law – SERVIR”, version 1, which forms an integral part of this resolution.

Article 2.- Order the publication of this resolution and its annex on the digital site of the Securities Market Superintendence on the Peruvian State's Single Digital Platform (www.gob.pe/smv).
