TECHNICAL INSTRUCTION for the application of electronic signature in the reporting procedure to the Croatian Financial Services Supervisory Agency

  1. Introduction

This Technical Instruction (hereinafter: Instruction) defines the method of electronically signing report files that supervised entities submit to the Croatian Financial Services Supervisory Agency (hereinafter: Hanfa) via Hanfa's website (reports.hanfa.hr).

  1. Terms

Certain terms, within the meaning of this Instruction, have the following meaning:

(1) Obligor is a supervised entity that is obliged to submit reports to Hanfa; (2) Signatory is a natural person authorized to sign reports of the supervised entity to Hanfa; (3) File is a file with data of the corresponding report that the Obligor must submit to Hanfa; (4) Qualified electronic signature is an electronic signature defined by Regulation (EU) No 910/2014 of the European Parliament and of the Council of 23 July 2014 on electronic identification and trust services for electronic transactions in the internal market and repealing Directive 1999/93/EC (OJ L 257/73 28. 8. 2014); (5) Authorized certificate issuer is a legal person authorized to issue digital certificates.

  1. Files for Signature

The list of files to be signed with a qualified electronic signature is prescribed by individual regulations, i.e., Hanfa's instruction for the corresponding type of report that the supervised entity is obliged to submit to Hanfa.

  1. Electronic Signing Procedure

(1) The Signatory of the file must have their crypto device, i.e., an appropriate medium issued by an authorized certificate issuer with two digital certificates, namely: a) authentication certificate and b) qualified certificate for electronic signature.

(2) When signing a file with a qualified electronic signature, the Signatory is obliged to use the option of separate saving of the original document from the file containing the electronic signature when it is technically necessary for submitting the report.

(3) For detailed instructions on working with the electronic signing system, the Obligor is obliged to contact the authorized Issuer of digital certificates.

  1. Final and Transitional Provisions

This Instruction will be published on Hanfa's website and enters into force on January 1, 2023.

Obligors are obliged to comply with this Instruction within 90 days, and no later than April 1, 2023.

Until April 1, 2023, the Technical Instruction for the Application of Electronic Signature in the Reporting Procedure to the Croatian Financial Services Supervisory Agency, CLASS: 011-02/12-04/01, REF. NO.: 326-01-12-1 of March 29, 2012, shall apply.

Upon expiry of the deadline from paragraph 3 of this Article, the Technical Instruction for the Application of Electronic Signature in the Reporting Procedure to the Croatian Financial Services Supervisory Agency, CLASS: 011-02/12-04/01, REF. NO.: 326-01-12-1 of March 29, 2012, shall cease to be valid.
