ACPR Compliance with EBA Guidelines on Instruments Available to Third-Country Branches

The Prudential Control and Resolution Authority (ACPR) declares compliance with EBA guidelines (EBA/GL/2026/03) regarding instruments that third-country branches can use immediately and without restriction to cover risks or losses under Article 48 sexies(2)(c) of Directive 2013/36/EU. These guidelines become applicable on January 11, 2027, specifically to branches listed in I of Article L. 511-10 of the Monetary and Financial Code. Establishments are required to take all necessary measures to adhere to these guidelines in accordance with Article 16 of Regulation (EU) No 1093/2010.

NOTICE Compliance of the ACPR with the guidelines of the European Banking Authority (EBA) regarding the instruments available to third-country branches that can be used immediately and without restriction to cover risks or losses under Article 48 sexies, paragraph 2, point c), of Directive 2013/36/EU (EBA/GL/2026/03)

The Prudential Control and Resolution Authority (ACPR) has declared itself compliant with the guidelines of the European Banking Authority (EBA/GL/2026/03) regarding the instruments available to third-country branches that can be used immediately and without restriction to cover risks or losses under Article 48 sexies, paragraph 2, point c), of Directive 2013/36/EU.

These guidelines are applicable as of January 11, 2027, to the branches mentioned in I of Article L. 511-10 of the Monetary and Financial Code. Establishments must take all necessary measures to comply with these guidelines, in accordance with the provisions of Article 16 of Regulation (EU) No 1093/2010 of the European Parliament and of the Council of 24 November 2010 establishing a European Supervisory Authority (European Banking Authority).
