Additional Measures for the Effective Implementation of the Program for the Construction and Reconstruction of Affordable Multi-Apartment Buildings in Cities for 2017-2020

The decree mandates the construction and reconstruction of 191 multi-apartment buildings totaling 554,800 square meters in Tashkent and other cities to house 7,919 families by the end of the year. It establishes a 15% average initial down payment for apartments, introduces a tiered down payment system in 2019, and provides for mortgage credit lines at a 3% annual interest rate for 20 years. On Additional Measures for the Effective Implementation of the Program for the Construction and Reconstruction of Affordable Multi-Apartment Buildings in Cities for 2017-2020

It is noted that, in accordance with the Decree of the President of the Republic of Uzbekistan "On Measures for the Implementation of the Program for the Construction and Reconstruction of Affordable Multi-Apartment Buildings in Cities for 2017-2020" dated November 22, 2016, No. PQ-2660, the State Committee of the Republic of Uzbekistan for Architecture and Construction, together with "ToshkentbosplanLITI" CJSC, "UzshaharsozlikLITI" CJSC, "ToshuyzhoyLITI" JSC, and "Toshgiprogor" JSC (hereinafter referred to as the main design institutes), has developed and implemented model projects for affordable multi-apartment buildings.

This year, in accordance with the decisions adopted to improve housing conditions for young families, residents of dilapidated houses, and other categories of citizens in need of housing improvement, the construction and reconstruction of 191 multi-apartment buildings with a total area of 554.8 thousand square meters are being carried out in Tashkent city and other cities of the republic. As a result, 7,919 city families in need of improved housing conditions will be provided with affordable and comfortable housing this year alone.

At the same time, studying the implementation of the program for the construction and reconstruction of affordable multi-apartment buildings in cities for 2017-2020 showed that the demand for affordable housing in the cities of the republic remains at a high level. More than 27,000 needy families have expressed their desire to buy apartments in affordable multi-apartment buildings being constructed under the Program in the coming years and have applied to regional commissions.

Currently, a number of serious shortcomings have been identified in organizing the construction of affordable housing and providing families with such housing, which necessitate the development of new approaches aimed at further improving the formation of the Program and increasing the efficiency of its implementation:

firstly, work on 41 affordable multi-apartment buildings is lagging behind the schedules in Tashkent city (24 buildings), Nukus city (7 buildings), Bukhara city (6 buildings), and Urgench city (4 buildings);

secondly, lags are observed in the construction of external engineering and communication networks, infrastructure facilities, and the landscaping of district areas in Nukus, Andijan, Bukhara, Termez, Samarkand, Guliston, Almalyk, Chirchik, and Bekabad cities;

thirdly, violations of urban planning norms and rules, poor quality of construction and installation works, and deviations from the project are being allowed, as a result of which 761 presentations were issued (205 to the customer, 399 to contracting organizations, 157 to design organizations), and more than 1.0 billion UZS were deducted from the volume of work performed for 34 objects.

In order to eliminate the shortcomings identified in the formation and implementation of the program for the construction and reconstruction of affordable multi-apartment buildings in cities for 2017-2020, to further fully satisfy the high demand of the needy population for affordable multi-apartment housing, and to ensure the consistent implementation of measures to raise the living standard and quality of the city population by expanding the scope of housing construction and mortgage lending:

The following are noted:

To the Chairman of the Cabinet of Ministers of the Karakalpakstan Republic K.R. Sariyev, the Governor of Bukhara Region U.I. Barnoyev, the Governor of Khorezm Region I.M. Sobirov, and the Mayor of Tashkent City R.J. Usmonov — that they failed to ensure adequate supervision over the implementation of multi-apartment building construction programs, which resulted in construction and installation works, as well as the construction of external engineering and communication networks, infrastructure facilities, and landscaping of district areas, lagging behind schedules;

To the Director of "Uzshahar Qurilish Invest" IC LLC Z.G. Narzullaev — that the functions entrusted to the engineering company for the construction and reconstruction of affordable multi-apartment buildings on a "ready-to-hand-over" basis, including technical supervision of the construction process, were not performed to an adequate level, which led to violations of construction deadlines set in contracts by some main contracting organizations and poor quality of construction and installation works;

To the State Committee of the Republic of Uzbekistan for Architecture and Construction (B.I. Zakirov, K.N. Tolanganov) and the heads of the main design institutes — that the most important parameters of project and estimate documentation for the construction of affordable multi-apartment buildings were not developed to an adequate level by the main design institutes, necessitating corrections, and that architectural-construction and authorial supervision over the quality of construction and installation works and compliance with urban planning norms and rules was not conducted to the appropriate level.

Taking into account the assessment of the real demand for affordable housing in the regions of the republic and the organization of construction works, the main parameters of the Program for the Construction and Reconstruction of Affordable Multi-Apartment Buildings in Cities for 2018-2020 (hereinafter referred to as the Program) for the Karakalpakstan Republic, regions, and Tashkent City are approved in accordance with Annexes 1 and 1a. The heads of the Cabinet of Ministers of the Karakalpakstan Republic, Governorships of regions and Tashkent City, "Uzshahar Qurilish Invest" IC LLC, the Ministry of Finance of the Republic of Uzbekistan, the Ministry of Economy, the Ministry of Construction, the State Committee for Land Resources, Geodesy, Cartography and State Cadastre, "Uzbekenergo" JSC, "Uztransgaz" JSC, "Uzbektelecom" JSC, and commercial banks are assigned personal responsibility for the timely resolution of organizational, technical, and financial issues related to ensuring the main parameters of the Program, as well as for the quality construction of affordable multi-apartment buildings, engineering and transport communications, infrastructure facilities, and the landscaping of areas. It is established that the heads of the Cabinet of Ministers of the Karakalpakstan Republic and the Governorships of regions and Tashkent City are assigned personal responsibility for the timely commissioning of affordable multi-apartment buildings, external engineering and communication networks, infrastructure facilities, landscaping of areas, as well as the resettlement of citizens into apartments.

It is accepted for information that the Ministry of Finance of the Republic of Uzbekistan is preparing the "Expansion of the Mortgage Market of Uzbekistan" project, which provides for the provision of mortgage credit resources to participating commercial banks — "Ipoteka-Bank" ATIB, "Asaka-Bank" ATB, and "UzSanoatQurilishBank" ATB (hereinafter referred to as participating commercial banks), in cooperation with the Asian Development Bank (hereinafter referred to as ADB), and the issue of attracting loans from the Turkish "Ziraat" State Bank is being developed in accordance with Annex 2.

The Ministry of Finance of the Republic of Uzbekistan shall finalize the procedure for obtaining the positive opinion of the ADB Board of Directors on the "Expansion of the Mortgage Market of Uzbekistan" (Phase 1) project by December 31, 2017.

The Cabinet of Ministers of the Karakalpakstan Republic, Governorships of regions, and Tashkent City, together with commercial banks, shall ensure, within one month, with the active participation of citizens' self-government neighborhood committees, the identification of creditworthy citizens among young families, residents of dilapidated houses, and other categories of citizens in need of housing improvement, in accordance with the established procedure, based on the principles of openness, transparency, and wide awareness; [ OKOB:

ensure the conclusion of contracts for the construction of affordable multi-apartment buildings and the formation of initial payments in 2018. The Ministry of Economy of the Republic of Uzbekistan (G.K. Saidova), together with the Ministry of Information Technologies and Communications (Sh.X. Shermatov), the Ministry of Finance (B.A. Khojaev), the Central Bank (B.M. Nurmuratov), the Cabinet of Ministers of the Karakalpakstan Republic, Governorships of regions and Tashkent City, and other interested ministries and departments, shall develop and implement an electronic system within two months that ensures the transparency of the distribution of housing and the provision of long-term preferential mortgage credits under the Program to young families, residents of dilapidated houses, and other categories of citizens in need of housing improvement.

the allocation of land plots for the construction of affordable multi-apartment buildings is carried out by the Cabinet of Ministers of the Karakalpakstan Republic, Governorships of regions and cities, in the established order, only in areas with high demand among the population, based on the orders of "Uzshahar Qurilish Invest" IC LLC and participating commercial banks; [ OKOB: 1. 07.00.00.00 Legislation on Finance and Credit. the preparation of construction sites, demolition of buildings located in the construction area, relocation of engineering communications, as well as the construction of incoming and internal branch water supply, sewage, electricity, gas supply, and communication networks is carried out by the Cabinet of Ministers of the Karakalpakstan Republic, Governorships of regions and cities, "Uzbekenergo" JSC, "Uztransgaz" JSC, and "Uzbektelecom" JSC, respectively, at the expense of local budget funds and the personal funds of user organizations;

the financing of multi-apartment building construction is carried out in the established order, depending on the formation of the list of creditworthy borrowers and their initial payments.

It is established that the following are the sources of financing the implementation of the Program and providing the customer and borrowers with credit:

initial payments of borrowers in accordance with the conditions specified in Annex 3 to this Decree; See previous edition.

the provision to participating commercial banks of funds from the State Budget of the Republic of Uzbekistan, international financial institutions, and other sources not prohibited by legislation, by opening a credit line in national currency for 20 years, including a 5-year preferential period, at an annual rate of 3 percent (in 2020, within the framework of the implementation of the Program — with a one-year preferential period and during the first 5 years, a rate increasing uniformly from a strictly fixed annual rate of 4 percent to the refinancing rate of the Central Bank of the Republic of Uzbekistan, and in the subsequent period, at the refinancing rate of the Central Bank of the Republic of Uzbekistan, taking into account the margin of participating commercial banks at 3 percent per annum); (Paragraph 3 of Item 7, in the edition of the Decree of the President of the Republic of Uzbekistan dated November 28, 2019, No. PF-5886 — National Database of Legislation, November 29, 2019, No. 09/19/5886/4133) See previous edition.

It is established that in the realization of multi-apartment buildings constructed in 2019, the Ministry of Finance provides funds to participating commercial banks in national currency for 20 years with a 3-year preferential period, at an annual rate of 3 percent for the first 5 years, and in the subsequent period, at a rate resulting from deducting the commercial bank's annual 4 percent margin from the refinancing rate of the Central Bank of the Republic of Uzbekistan. Consent is given to the proposal of the Ministry of Finance and the Central Bank of the Republic of Uzbekistan regarding the distribution of the number of affordable multi-apartment buildings in accordance with Annex 4 among participating commercial banks for providing mortgage credits to borrowers.

the development of new model projects for affordable multi-apartment buildings and the revision of existing ones, using modern requirements of urban planning, as well as energy-efficient and economical technologies, modern construction materials, and structures;

the high-quality connection of model projects for affordable multi-apartment buildings with each other, and the development of project and estimate documentation based on the agreed value of 1 square meter of total apartment area;

the implementation of organizational and technical measures to prevent unjustified price increases in the construction of affordable multi-apartment buildings;

the volume of work starting from the formed initial payments of borrowers and the resources of participating commercial banks within the framework of the 2018 Program shall be completed in the same year.

To the Minister of Construction of the Republic of Uzbekistan A.Kh. To the heads of participating commercial banks — "Ipoteka-Bank" ATIB O.M. Musaev, "Asaka-Bank" ATB K.K. Mullajonov, "UzSanoatQurilishBank" ATB A.K. Mirsatonov — regarding personal responsibility for ensuring timely and full financing by the customer, provision of borrowers with mortgage credits, and control over the targeted and efficient use of allocated loan funds. The Deputy Minister of Construction — Head of the Inspection in the Construction Sector K.N. Tolanganov shall establish systematic supervision over the strict compliance with established construction norms and rules, and the quality of construction, installation, and finishing works in the design and construction of affordable multi-apartment buildings in accordance with this Decree. Within the framework of the Program, for the construction of affordable multi-apartment buildings in 2018, as an exception:

it is permitted to designate contracting and design organizations without holding competitive auctions, by selecting the best offers from "Uzshahar Qurilish Invest" IC LLC;

it is permitted to carry out construction and installation works simultaneously with the development of project and estimate documentation by April 1, 2018. The Ministry of Economy of the Republic of Uzbekistan, "Uzmetkombinat" JSC, and "UzQurilishMateriallari" JSC shall ensure the allocation of metal products, cement, and construction glass under direct contracts and declared prices, starting from October of the current year, for the launch of 2018 works within the framework of the Program, based on the orders of the customer and the justified calculations of the main design organizations.
It is accepted for information the information from the State Committee of the Republic of Uzbekistan for Architecture and Construction, "Uzshahar Qurilish Invest" IC LLC, the Cabinet of Ministers of the Karakalpakstan Republic, and the Governorships of regions and Tashkent City regarding the increase in the total area of apartments and, accordingly, an increase in their value by 104.4 billion UZS in relation to the approved project and estimate documentation for the construction of affordable multi-apartment buildings in 2017.

In accordance with Annex 5, the initial payments of builders in the amount of 26.1 billion UZS and the funds of "Xalq Banki" ATB in the amount of 78.3 billion UZS are established as sources of financing the increased cost of expenses for the construction of affordable multi-apartment buildings in 2018. The State Committee "Uzgeodezkastr" of the Republic of Uzbekistan shall ensure the issuance of cadastral documents for completed affordable multi-apartment buildings to "Uzshahar Qurilish Invest" IC LLC without collecting state duties, fees, and other charges.
Amendments and additions are made to Annex 6 of the Decree of the President of the Republic of Uzbekistan "On Measures for the Implementation of the Program for the Construction and Reconstruction of Affordable Multi-Apartment Buildings in Cities for 2017-2020" dated November 22, 2016, No. PQ-2660.
Ministries and departments shall align the normative legal acts adopted by them with this Decree.
Supervision over the implementation of this Decree is assigned to the First Deputy Prime Minister of the Republic of Uzbekistan — Chairman of the Board of "Uzbekiston Temir Yo'llari" JSC A.J. Ramatov and Deputy Prime Minister of the Republic of Uzbekistan J.A. Kuchkarov.

AMENDMENTS AND ADDITIONS TO BE MADE TO THE Decree of the President of the Republic of Uzbekistan No. PQ-2660 dated November 22, 2016 "On Measures for the Implementation of the Program for the Construction and Reconstruction of Affordable Multi-Apartment Buildings in Cities for 2017-2020"

Paragraph 4:

In the second paragraph, the words "taking into account the margin of "Ipoteka Bank" JSC at the rate of 0.5 percent per year," shall be deleted;

In the fourth paragraph, the words "to young families, residents of old housing, and other categories of citizens in need of improving housing conditions, as well as to military servicemen of the Ministry of Defense of the Republic of Uzbekistan" shall be added after the word "apartments";

The sixth paragraph shall be stated in the following wording:

"sell in the manner established by legislation by providing mortgage loans for 10 years, including a 6-month grace period, with an interest rate not lower than the refinancing rate set by the Central Bank of the Republic of Uzbekistan, to other categories of the population if orders from young families, residents of old housing, and other categories of citizens in need of improving housing conditions are not received, provided that an initial contribution of at least 50% of the apartment value is paid."

In the second paragraph of Paragraph 7, the number "672.8" shall be replaced with the number "751.1";
In the fifth paragraph of Paragraph 17, the words "equipment and spare parts, passenger elevators, and individual boiler rooms" shall be replaced with the words "passenger elevators, individual boiler rooms, their equipment and spare parts, including components and materials for their production (assembly)";
Annex 1 shall be stated in the following wording:
