AGREEMENT allocating to the Ministry of Finance and Public Credit, the federal property called Casa Leyes de Reforma, with an area of 934.00 square meters

AGREEMENT allocating to the Ministry of Finance and Public Credit, the federal property called "Casa Leyes de Reforma",

with an area of 934.00 square meters, located at

Avenida José María Morelos number 43, Zona Centro, Municipality of Veracruz, State of Veracruz de

Ignacio de la Llave, with Federal Real Estate Registry 30-26721-7.

VÍCTOR JULIÁN MARTÍNEZ BOLAÑOS, President of the Institute of Administration and Appraisals of National Assets, Decentralized Administrative Body of the Ministry of Finance and Public Credit, based on the provisions of articles 2 section I, 17, 26, 31 sections XXIX and XXX of the Organic Law of the Federal Public Administration; 2 sections II, IV, V, VI and VII, 3 section III, 4 paragraphs first and second, 6 section XXI, 11 section I, 13, 28 sections I, III and VII, 29 sections I and V, 61, 62, 66, 70 and 101 section V of the General Law of National Assets; 4, section G, section V, 48 and 49 of the Internal Regulations of the Ministry of Finance and Public Credit; and 1, 3 sections VIII, IX and X, 4 section I, subsection a) and 6 sections XXVI and XXXIII of the Regulations of the Institute of Administration and Appraisals of National Assets;

I have deemed fit to issue this agreement, taking into account the following:

CONSIDERATIONS

FIRST.-

That within the assets subject to the public domain regime of the Federation, is

the federal property called "Casa Leyes de Reforma", with Federal Real Estate Registry

30- 26721-7, with an area of 934.00 square meters, located at Avenida José María Morelos number 43,

Zona Centro, Municipality of Veracruz, State of Veracruz Ignacio de la Llave.

SECOND.- That the ownership of the federal property described in the preceding Consideration, is accredited

by contract dated August 29, 2008, through which, the transfer was formalized free of charge, in a pure and irrevocable manner of the property in question made by the Government of the State of Veracruz

Ignacio de la Llave in favor of the National Institute of Anthropology and History, which is registered in the Public Registry of Federal Property under Real Folio number 93184, dated November 03, 2008.

THIRD.- That the Topographic Plan number 1 of 1, prepared at scale 1:200, approved and registered on

September 20, 2023, under number DRPCI/7198/30-26721-7/2023/T and certified on September 27, 2023 by the Directorate of Public Registry and Real Estate Control, records the area, measurements and

boundaries of the property in question, mentioning in the notes table that, from the reconstruction of the polygon with the measurements and boundaries recorded in the antecedent, was obtained

an area of 946.98

square meters, which gives a difference of 12.98 square meters, equivalent to 1.39% in excess,

with respect to the area of 934.00 square meters, so the plan is technically correct,

in accordance with the technical specifications and requirements for the preparation of topographic and

planimetric plans with cadastral information that are made of the properties that are part of the Federal and Parastatal Real Estate Assets. Under this reasoning, the property does not lose its identity with respect to its

antecedent.

It is important to clarify that the physical polygon identified in this cartographic document, with total area of 974.06 square meters, product of the topographic survey, is composed of the following

fractions:

POLYGON "A", with an area of 935.45 square meters corresponding to the occupied area

according to the antecedent.

POLYGON "B", with an area of 38.61 square meters in use and possession.

Also, in the project there is the:

·

POLYGON "C", with an area of 11.53 square meters, which refers to an excess area accredited

in the antecedent, not occupied by the INAH.

FOURTH That by official letter number 712.2023.0109 dated February 16, 2023, the General Director

of Material Resources, Public Works and General Services and Real Estate Responsible of the Ministry of

Finance and Public Credit, requested that the destination of the federal property described in Consideration

First of this instrument be granted, to establish in the property a venue of a museum nature that

allows honoring and perpetuating the historical memory of the site where the Reform Laws were signed.

FIFTH.- That by Administrative Act dated March 3, 2023, the physical, legal, administrative and provisional delivery was recorded made by the Ministry of Culture through its Decentralized Administrative Body, the National Institute of Anthropology and History, in favor of the Ministry of Finance and Public Credit, through its Decentralized Administrative Body, the Institute of

Administration and Appraisals of National Assets, who at that same act receives and delivers physical, legal,

administrative and provisional to the Ministry of Finance and Public Credit, registered in the Public Registry of

Federal Property under Real Folio 93184/3 on March 15, 2023.

SIXTH.-

That by official letter number 1156-C/0854 dated July 21, 2023, the Directorate of Architecture and

Conservation of Real Estate Artistic Heritage of the National Institute of Fine Arts and Literature, informed that

the property object of this instrument, is not considered as an artistic monument or of artistic value.

SEVENTH.- That by official letter number 401.3S.1-2023/2009 dated July 24, 2023, the

National Coordination of Historical Monuments of the National Institute of Anthropology and History, determined

that the property object of this instrument, has no inconvenience in granting the use in favor of the

Ministry of Finance and Public Credit, however it will be necessary that in case of carrying out any type of work or jobs on the property, the corresponding procedures be carried out before that Institute.

EIGHTH.- That by official letter DOPDU/SDDU/TOP/1684/2023 dated August 16, 2023, the

Directorate of Public Works and Urban Development of the H. City Council of Veracruz, State of Veracruz de

Ignacio de la Llave, informed that the property object of this Agreement, is located at Avenida

José María Morelos number 43.

NINTH.- That by official letter DOPDU/SDDU/OT/1239/2023 dated September 19, 2023, the Directorate

of Public Works and Urban Development of the H. City Council of Veracruz, State of Veracruz de Ignacio de la

Llave, grants the Land Use License, specifically for the occupation of equipment use:

Museum, indicating a Land Occupation Coefficient (COS) of 0.70 and a Land Utilization Coefficient

(CUS) of 2.1 to 2.8, equivalent to 3 to 4 maximum construction levels (ground floor and three levels).

TENTH.- That the General Directorate of Administration of Federal Real Estate Assets of the Institute of

Administration and Appraisals of National Assets, in accordance with the provisions of article 11 section V,

of the Regulations of this Institute, knew and reviewed from the technical legal point of view, the operation that is

authorized. The legal and technical documentation that supports the legal and administrative situation of the property, as

well as of this Agreement, is in the procedural file integrated by said General Directorate and was

duly integrated and checked with that in the Federal and Parastatal Real Estate Information System.

Also, based on article 9 section XIV in relation to article 11, section V of the

Regulations of the Institute, the Legal Unit issued a favorable opinion regarding this Agreement.

Therefore and in accordance with the provisions established in articles 61, 62, 66 and 70 of the General Law of National Assets, and being the purpose of the Federal Executive the optimal use of the federal real estate assets, privileging the public institutions of the different levels of Government

with federal properties for the provision of public services under their charge, I have deemed fit to issue

the

following:

AGREEMENT

FIRST.-

The federal property called "Casa Leyes de Reforma" is allocated, with Federal Real Estate

Registry 30-26721-7, located at Avenida José María Morelos number 43, Zona Centro, Municipality of

Veracruz, State of Veracruz de Ignacio de la Llave, to the Ministry of Finance and Public Credit, for

establishing in the property a venue of a museum nature that allows honoring and perpetuating the memory

historical of the site where the Reform Laws were signed.

SECOND.- If the Ministry of Finance and Public Credit, gives the federal property that is allocated to it,

a use different from that established by this Agreement, without the prior authorization of the Ministry of Finance

and Public Credit, through the Institute of Administration and Appraisals of National Assets; or well, leaves it

unused or needed, said property with all its improvements and accessions will be withdrawn from its service to be

administered directly by this Institute, in accordance with the provisions in Article 68 of the General Law of National Assets.

THIRD.- In case construction, reconstruction, modification, works are planned

adaptation, conservation, maintenance, repair and demolition on the allocated property, prior to its

realization, the Ministry of Finance and Public Credit, must manage before the authorities of the orders of

corresponding government, the obtaining of licenses, permits, authorizations or any other similar that

is required.

FOURTH.- The Ministry of Finance and Public Credit, must custody and watch the property, being

obliged to cover the necessary expenses for its conservation and maintenance, and other inherent services

that, where appropriate, are generated, as well as the corresponding insurance against damage to the property, in

accordance with the provisions in articles 32 section IV and 66 of the General Law of National Assets.

FIFTH.- The allocation only confers to the Ministry of Finance and Public Credit, the right of

using the allocated property for the authorized use, but does not transmit the ownership of the same, nor grants

any real right over it, in accordance with Article 70 of the General Law of National Assets.

SIXTH.- The Institute of Administration and Appraisals of National Assets, within the scope of its attributes,

will monitor the strict compliance with this Agreement.

This Agreement will enter into force the day after its publication in the Official Gazette of the Federation.
