AGREEMENT by which the Federal Property denominated Telegraphic Transmission Central Hidalgo del Parral is allocated to the service of the National Commission of Natural Protected Areas, Decentralized Administrative Body of the Secretariat of Environment and Natural Resources

Postal Code

33880, Municipality of Hidalgo del Parral, State of Chihuahua, is allocated to the service of the National Commission of Natural Protected Areas,

Decentralized Administrative Body of the Secretariat of Environment and Natural Resources.

VÍCTOR JULIÁN MARTÍNEZ BOLAÑOS,

President of the Institute of Administration and Appraisals of National Assets, Decentralized Administrative Body of the Secretariat of Finance and Public Credit, based on the provisions of articles 2 section I, 17, 26, 31 sections XXIX and XXX of the Organic Law of the Federal Public Administration; 2 sections II, IV, V, VI and VII, 3 section III, 4 paragraphs first and second, 6 section XXI, 11 section I, 13, 28 sections I, III and VII, 29 sections I and V, 61, 62, 66, 70 and 101 section V of the General Law of National Assets; 4 section G, section V, 48 and 49 of the Internal Regulations of the Secretariat of Finance and Public Credit; and 1, 3 sections VIII, IX and X, 4 section I, subsection a) and 6 sections XXVI and XXXIII of the Regulations of the Institute of Administration and Appraisals of National Assets;

I deem fit to issue this agreement, taking into account the following:

CONSIDERATIONS

FIRST. - That within the assets subject to the public domain regime of the Federation, is

the federal property denominated " Telegraphic Transmission Central Hidalgo del Parral " ,

with

Federal Real Estate Registry number 8-5825-9 and area of 700.075 square meters, located at Street

Domingo F. Sarmiento number 244, Neighborhood Fovissste Primero de Mayo, Postal Code 33880,

Municipality of Hidalgo del Parral, State of Chihuahua.

SECOND. - That the ownership of the federal property described in the Consideration that precedes, is

accredited by means of title deed number 866 dated 09 October 1984, in which is recorded the

donation free of charge made by the Municipality of Hidalgo del Parral, State of Chihuahua, in favor of the

Federal Government, which is registered in the Public Registry of Federal Property under Real Folio

number 88215 dated 21 June 2005.

THIRD. - That the Topographic Plan number 001, prepared at scale 1:100, approved and registered on

07 September 2023 by the Directorate of Public Registry and Real Estate Control, under number DRPCI/ 7195/8-5825-9/2023/T , records the area, measurements and boundaries of the property in question, it should be noted

that the notes table indicates that from the reconstruction of the polygon according to the technical data of measurements

and boundaries recorded in the antecedent, an area of 700.075 square meters was obtained, which gives

a difference of 2.135 square meters, equivalent to 0.30% in decrement, with respect to the area of

702.21 square meters, so it is considered technically correct according to the " Technical

Specifications and Requirements for the Preparation of Topographic and Planimetric Plans with Cadastral Information,

to be carried out on the properties that are part of the Federal and Parastatal Real Estate Heritage " . Under

this reasoning, the property does not lose identity with respect to what is described in the property antecedent.

FOURTH. - That by means of official letters number F00/DAF/0494/2023 and F00/DAF/1661/2023 dated 30 of

March and 24 August, both of 2023, respectively, the Director of Administration and Finance and

Real Estate Coordinator of the National Commission of Natural Protected Areas, Decentralized Administrative

Body of the Secretariat of Environment and Natural Resources ,

expressed its interest in obtaining

in its favor the allocation, of the federal property indicated in Consideration First of this Agreement, for the

establishment of the Administrative Office and Public Attention of the Flora and Fauna Protection Area

(APFF) Cerro Mohinora.

FIFTH . -

That by means of official letter number 401.3S.17-2023/TSL/165 dated 26 May 2023 , the

Directorate of the INAH Center Chihuahua, of the National Institute of Anthropology and History , confirmed that the

property described in Consideration First of this Agreement, due to its architectural characteristics and

era of construction, IS NOT CONSIDERED A HISTORICAL OR ARTISTIC MONUMENT, NOR IS

IT ADJACENT to one, and is located outside the protection perimeter of the HISTORICAL MONUMENTS

ZONE of the Municipality of Hidalgo del Parral, Chihuahua.

SIXTH. -

That by official letter number 0782-C/0561 dated 09 June 2023, the Directorate of Architecture and

Conservation of Immovable Artistic Heritage of the National Institute of Fine Arts and Literature , informed that

the property object of this instrument, is not considered as artistic monuments or of

artistic value.

SEVENTH. -

That by means of Alignment and Official Number Certificate dated 13 July 2023, the

Directorate of Municipal Public Works of the Municipal Government of Hidalgo del Parral, State of Chihuahua,

recorded that the property of this Agreement, is located on the street Domingo F. Sarmiento

number 244 of the Neighborhood Fovissste Primero de Mayo.

EIGHTH.

That by official letter number LUS 909/2020 dated 26 July 2023, the Directorate of Urban

Development and Municipal Ecology, of the Municipal Government of Hidalgo del Parral, State of Chihuahua, authorizes the

use of soil for Administrative Offices and Public Attention, since it is located in a sector

with Land Use RESIDENTIAL H2T, having to respect the alignment restriction

that the H.

City Council of Hidalgo del Parral marks; likewise it must respect a C.O.S of 0.75 and a C.U.S. of

1.75.

NINTH. - That the General Directorate of Administration of Federal Real Estate Heritage of the Institute of

Administration and Appraisals of National Assets, in accordance with the provisions of article 11 section V,

of the Regulations of this Institute, knew and reviewed from the technical legal point of view, the operation that is

authorized. The legal and technical documentation that supports the legal and administrative situation of the property, as

well as of this Agreement, is in the procedural file integrated by said General Directorate and was

duly integrated and checked with that existing in the Federal and Parastatal Real Estate Information System.

Likewise, and based on article 9 section XIV in relation to article 11, section V of the

Regulations of the Institute, the Legal Unit issued a favorable opinion regarding this Agreement.

For the foregoing and in accordance with the provisions established in articles 61, 62, 66 and 70 of the

General Law of National Assets, and being purpose of the Federal Executive the optimal use of the

federal real estate heritage, privileging the public institutions of the different levels of Government

with federal properties for the provision of public services under their charge, I have deemed fit to issue the

following:

AGREEMENT

FIRST. - The Federal Property denominated " Telegraphic Transmission Central Hidalgo del

Parral " , with Federal Real Estate Registry number 8-5825-9 and area of 700.075 square meters,

located at Street Domingo F. Sarmiento number 244, Neighborhood Fovissste Primero de Mayo, Postal

Code 33880, Municipality of Hidalgo del Parral, State of Chihuahua, is allocated to the National Commission of Natural

Protected Areas , Decentralized Administrative Body of the Secretariat of Environment and Natural

Resources , for the establishment of the Administrative Office and Public Attention of the Flora and Fauna Protection

Area (APFF) Cerro Mohinora.

SECOND. -

The Institute of Administration and Appraisals of National Assets shall carry out the physical delivery,

legal and administrative of the property that in this act is allocated to the National Commission of Natural Areas

Protected, Decentralized Administrative Body of the Secretariat of Environment and Natural

Resources.

THIRD. - If the National Commission of Natural Protected Areas, Decentralized Administrative

Body of the Secretariat of Environment and Natural Resources , gives the federal property that is

allocated, a use different from that established by this Agreement, without the prior authorization of the Secretariat of

Finance and Public Credit, through the Institute of Administration and Appraisals of National Assets; or well, leaves

to use or need it, said property with all its improvements and accessions shall be withdrawn from its service to be

administered directly by this Institute, in accordance with article 68 of the General Law of National

Assets.

FOURTH. - In case construction, reconstruction, modification,

adaptation, conservation, maintenance, repair and demolition works are planned on the allocated property, prior to its

realization, the National Commission of Natural Protected Areas, Decentralized Administrative Body of the

Secretariat of Environment and Natural Resources , must manage before the authorities of the levels of

corresponding government the obtaining of licenses, permits, authorizations or any other similar that is

required.

FIFTH. - The National Commission of Natural Protected Areas, Decentralized Administrative Body

of the Secretariat of Environment and Natural Resources , must custody and watch over the property, being

obliged to cover the necessary expenses for its conservation and maintenance, and other inherent services

that, as the case may be, are generated, as well as the corresponding insurance against damage to the property, of

accordance with the provisions in articles 32 section IV and 66 of the General Law of National Assets.

SIXTH. - The allocation solely confers to the National Commission of Natural Protected Areas, Decentralized

Administrative Body of the Secretariat of Environment and Natural Resources, the right of

use the allocated property for the authorized use, but does not transmit the ownership of the same nor grants

any real right over it, in accordance with article 70 of the General Law of National Assets.

SEVENTH. - The Institute of Administration and Appraisals of National Assets, in the scope of its

attributions, shall watch over the strict compliance of this Agreement.

This Agreement shall enter into force the day following its publication in the Official Gazette of the Federation.
