AGREEMENT amending various provisions of the Guidelines for the use of resources destined for paving actions in the corresponding municipalities, derived from proceeds generated from the regularization of used vehicles of foreign origin during fiscal year 2023, published in the Official Gazette of the Federation on January 31, 2023 and amended by the respective instrument published in that official dissemination body on April 28, 2023

ALEJANDRA CAÑIZARES TELLO, Head of the Unit of Policy and Budget Control of the Ministry of Finance and Public Credit, based on articles 31 of the Organic Law of the Federal Public Administration; 1, 75 and 85 of the Federal Budget and Fiscal Responsibility Law; 23, section I, subsection c), sub-subsection vii), second paragraph, of the Regulation of the Federal Budget and Fiscal Responsibility Law; 21 of the Internal Regulation of the Ministry of Finance and Public Credit, and 9 of the "Decree fostering the regularization of used vehicles of foreign origin", published in the Official Gazette of the Federation on December 29, 2022, and its amendments published in that official dissemination body on dates March 31 and June 30, 2023, and

WHEREAS

That on January 31, 2023, there were published in the Official Gazette of the Federation the "Guidelines for the use of resources destined for paving actions in the corresponding municipalities, derived from proceeds generated from the regularization of used vehicles of foreign origin during fiscal year 2023";

That the Guidelines referred to in the previous WHEREAS clause were issued to comply with the provisions of article 9 of the "Decree fostering the regularization of used vehicles of foreign origin", published in the Official Gazette of the Federation on December 29, 2022;

That due to the publication in the Official Gazette of the Federation on March 31, 2023 of the "Decree amending the diverse decree fostering the regularization of used vehicles of foreign origin", various provisions of the aforementioned Guidelines were amended by Agreement published in that official dissemination body on April 28, 2023;

That on June 30, 2023 there was published in the Official Gazette of the Federation the "Decree amending the diverse decree fostering the regularization of used vehicles of foreign origin", in which the validity of the decree was extended until September 30, 2023 and the state of Hidalgo was added as part of the federative entities that are beneficiaries of the federal public resources derived from the proceeds generated due to the regularization of vehicles referred to in said decree, and

That in accordance with the foregoing, it has been deemed appropriate to issue the following

Single Article. Numerals 1, 4, section II, 13, last paragraph, and 16, subsection f), of the Guidelines for the use of resources destined for paving actions in the corresponding municipalities, derived from proceeds generated from the regularization of used vehicles of foreign origin during fiscal year 2023, published in the Official Gazette of the Federation on January 31, 2023, and amended by Agreement published in that official dissemination body on April 28, 2023, are amended, to read as follows:

Chapter I

On General Provisions

1. These guidelines aim to establish the specific provisions for the use of resources that, charged to General Branch 23 Salary and Economic Provisions, the Ministry of Finance and Public Credit destines for paving actions in the municipalities of the states referred to in the "Decree fostering the regularization of used vehicles of foreign origin" published in the Official Gazette of the Federation on December 29, 2022, and its amendments published in that official dissemination body on dates March 31 and June 30, 2023, derived from the proceeds generated in fiscal year 2023 due to the regularization of used vehicles of foreign origin, as well as the regulations governing the application, monitoring, control, accountability and transparency of those resources.

The Federative Entities, the Municipalities or the Executing Instances, as appropriate, shall be responsible for accrediting before the oversight bodies the causes that motivated the requests referred to in the first and second paragraphs of this numeral.

Chapter VI

On Responsibilities in the Application of Subsidies

f) Fully comply by themselves with the commitments and responsibilities linked to the legal, financial, labor, administrative, tax and any other type of obligations related to the Paving Projects;

TRANSITORY PROVISIONS

SOLE. - This Agreement shall enter into force on the day of its publication in the Official Gazette of the Federation.
