AGREEMENT designating to the Decentralized Public Body of the Secretariat of Education, Science, Technology and Innovation of the State of Mexico, Colegio de Bachilleres del Estado de México, the federal property known as "Escuela Preparatoria Federal por Cooperación 2/74", with a surface area of 4,396.00 square meters, located at Avenida Felipe de Jesús Chaparro Number 211, Colonia Comunidad Temascalcingo, Locality Temascalcingo de José María Velasco, Municipality of Temascalcingo, Postal Code 50400, State of Mexico, with Federal Real Estate Registry 15-9543-0.

A seal bearing the National Coat of Arms is placed at the margin, which reads: United Mexican States.- Finance.- Secretariat of

COLEGIO DE BACHILLERES DEL ESTADO DE MÉXICO, THE FEDERAL PROPERTY KNOWN AS

" ESCUELA PREPARATORIA FEDERAL POR COOPERACIÓN 2/74 " , WITH A SURFACE AREA OF 4,396.00

SQUARE METERS, LOCATED AT AVENUE FELIPE DE JESÚS CHAPARRO NUMBER 211, COLONIA

COMUNIDAD TEMASCALCINGO, LOCALITY TEMASCALCINGO DE JOSÉ MARÍA VELASCO,

MUNICIPALITY OF TEMASCALCINGO, POSTAL CODE 50400, STATE OF MEXICO, WITH FEDERAL

REAL ESTATE REGISTRY 15-9543-0.

VÍCTOR JULIÁN MARTÍNEZ BOLAÑOS, President of the Institute of Administration and Appraisal of National Assets, a decentralized administrative body of the Secretariat of Finance and Public Credit, based on the provisions of articles 2, fraction I, 17, 26, 31, fractions XXIX and XXX of the Organic Law of the Federal Public Administration; 2, fractions II, IV, V, VI and VII, 3, fraction III, 4, paragraphs first and second, 6, fraction XXI, 11, fraction I, 13, 28, fractions I, III and VII, 29, fractions I and V, 61, 62, 66, 70 and 101, fraction V of the General Law of National Assets; 4, section G, fraction V, 48 and 49 of the Internal Regulations of the Secretariat of Finance and Public Credit; and 3, fractions VIII, IX and X, 4, fraction I, subsection a) and 6, fractions XXVI and XXXIII of the Regulations of the Institute of Administration and Appraisal of National Assets; and taking into account the following:

CONSIDERING

FIRST. - That among the assets subject to the public domain regime of the Federation, is the federal property known as "Escuela Preparatoria Federal por Cooperación 2/74", with

a surface area of 4,396.00 square meters, with Federal Real Estate Registry 15-9543-0, located at Avenida

Felipe de Jesús Chaparro Number 211, Colonia Comunidad Temascalcingo, Locality Temascalcingo de

José María Velasco, Municipality of Temascalcingo, Postal Code 50400, State of Mexico.

SECOND. -

That the ownership of the federal property described in the preceding Consideration is evidenced

by public deed number 13,382, volume CCLXXVII dated October 13, 2003, granted before the

notary of Licenciado José Víctor Reynoso Pablos, Holder of Public Notary Office number 69, of the State of Mexico,

through which, the protocolization of the sentence of domain information was recorded, issued in the

File Number 83/03, filed in the First Civil Court of the Judicial District of El Oro, Mexico,

regarding the property occupied by the Escuela Preparatoria Federal por Cooperación Key EMOS-2/74, "Prof.

Pinito Reynoso Bejarano", located at Avenida Felipe de Jesús Chaparro, without number, in Temascalcingo, with

a surface area of 4,395.56 square meters, which is registered in the Public Registry of Federal Property

under Real Folio number 145248 dated October 8, 2014.

That said public instrument was Validated through Agreement with folio number 106/2014 dated

October 1, 2014, registered in the Public Registry of Federal Property under Real Folio number

145248/1, on October 8, 2014.

THIRD. - That topographic plan number PT-001, prepared on a scale of 1:250, approved and registered

under number DRPCI/15-09543-0/5584/2015/T on November 24, 2015 and certified on June 13,

2023, by the Directorate of Public Registry and Real Estate Control, attached to the General Directorate of Policy and

Real Estate Management of the Institute of Administration and Appraisal of National Assets, reports the surface area,

measurements and boundaries resulting from the topographic survey of the property in question, stating in its

notes table that, "DEEDS No. 13382/1077 WITH DATE OF OCTOBER 13, 2003. THE

SURFACE AREA OBTAINED FROM THE TOPOGRAPHIC SURVEY IS 4,483.305 M2 AND THE SURFACE AREA

INDICATED IN THE TITLE OF PROPERTY IS 4,395.56 M2, WHICH GIVES US A DIFFERENCE OF

87.745 M2 EQUIVALENT TO (01.996 %) INCREASE, DIFFERENCE THAT IS WITHIN

THE TOLERANCE ACCEPTED BY INDAABIN AND IS DUE TO THE DIFFERENT METHODS AND

MEASURING EQUIPMENT USED." (sic)

FOURTH. -

That through official letter number 401.B(10)77.2015/214 dated January 26, 2015, the Delegate

of the INAH Center State of Mexico, of the National Institute of Anthropology and History, stated that,

"The original plot was originally intended to house the Municipal Cemetery, which has suffered several important

modifications where it currently houses the Colegio de Bachilleres del Estado de México, which is a

contemporary construction, located within the Founding Core of the Municipality.

On the perimeter wall, what was the access to the cemetery is still found, which has a

dating of the year 1886, it is a structure of quarry stone with mortar, it is defined as a Historical Monument.

Therefore, it is the competence of this Institute to regulate the interventions carried out on it".

FIFTH. - That through official letter number 1289-C/1213 dated July 26, 2021, the Director of

Architecture and Conservation of Immovable Artistic Heritage of the National Institute of Fine Arts and

Literature, informed that the property subject of the present instrument, "... is not included in the

INBAL List of Properties with Artistic Value."

SIXTH. - That through official letter number 210C07010000000/350/2022 dated November 7, 2022, the

General Director of the Colegio de Bachilleres del Estado de México, requested that the Administrative Agreement

of Destination of the federal property described in the First Consideration of the present instrument be issued, to continue

using it as campus 66 Temascalcingo II of the Colegio de Bachilleres del Estado de México.

SEVENTH. -

That through official letter number MTM/DDU/417/04/2023 dated April 18, 2023, the Director

of Municipal Urban Development of the Municipality of Temascalcingo of the State of Mexico, informed that, there

is no inconvenience whatsoever for the development of an educational equipment project at the secondary

level,

on the property subject of the present instrument, "... as long as it is carried out in accordance with

aspects related to urban development and historical, cultural and ecological preservation, where

strategies, guidelines, regulations and necessary actions are applied to promote the

development of the territory and thus be able to balance the demand for education in the population of

our municipality".

EIGHTH. -

That through Alignment Certificate with folio number 011 dated April 25, 2023,

the Director of Municipal Urban Development of the Municipality of Temascalcingo of the State of Mexico, made

it clear that the property subject of the present instrument corresponds to the official number 211, of Av. Felipe

de Jesús Chaparro, Temascalcingo, State of Mexico.

NINTH. - That through Administrative Act dated October 22, 2024, the physical, legal and administrative delivery

of the property subject of the present Agreement was recorded, which was carried out by the Secretariat of

Public Education, in favor of the Secretariat of Finance and Public Credit, through its decentralized administrative body,

Institute of Administration and Appraisal of National Assets, which in the same act, receives and delivers physically, legally, administratively and provisionally to the Decentralized Public Body

of the Secretariat of Education, Science, Technology and Innovation of the State of Mexico,

Colegio de Bachilleres del Estado de México, with the purpose that it continues to use it as campus 66

Temascalcingo II of the Colegio de Bachilleres del Estado de México, which is registered in the Public Registry

of Federal Property under Real Folios number 143874/1 and 145248/2, on December 31, 2024.

TENTH. -

That the General Directorate of Administration of Federal Real Estate Assets of the Institute of

Administration and Appraisal of National Assets, in accordance with what is provided for in article 11, fraction V,

of the Regulations of this Institute, knew and reviewed from a technical-legal point of view, the operation that is

authorized. The legal and technical documentation supporting the legal and administrative situation of the federal

property, as well as of this Agreement, is in the procedural file integrated by said General Directorate and

was duly compared with that which is in the Federal and Parastatal Real Estate Information System.

Likewise, and based on article 9, fraction XIV in relation to article 11, fraction V of the

Regulations of the Institute, the Legal Unit issued an opinion regarding the present Agreement.

For the above and in accordance with the provisions established in articles 61, 62, 66 and 70 of the

General Law of National Assets, and being the purpose of the Federal Executive the optimal use of the

federal real estate assets, prioritizing public institutions of different levels of Government

with federal properties for the provision of public services under their charge, I have deemed it appropriate to issue the

following:

AGREEMENT

FIRST. -

The federal property known as "Escuela Preparatoria Federal por Cooperación 2/ 74", located at Avenida Felipe de Jesús Chaparro Number 211, Colonia Comunidad Temascalcingo,

Locality Temascalcingo de José María Velasco, Municipality of Temascalcingo, Postal Code 50400, State

of Mexico, with Federal Real Estate Registry number 15-9543-0, with a surface area of 4,396.00 square

meters, is designated to the Decentralized Public Body of the Secretariat of Education, Science, Technology and

Innovation of the State of Mexico, Colegio de Bachilleres, to continue using it as Plantel 66

Temascalcingo II.

SECOND. -

If the Decentralized Public Body of the Secretariat of Education, Science, Technology

and Innovation of the State of Mexico, Colegio de Bachilleres del Estado de México, gives the federal property

that is designated to it, a use different from that established by the present Agreement, without prior authorization from the

Secretariat of Finance and Public Credit, through the Institute of Administration and Appraisal of National

Assets; or if it ceases to use or need it, said asset with all its improvements and accessions will be withdrawn

from its service to be administered directly by this Institute, in accordance with what is provided in article

68 of the General Law of National Assets.

THIRD. - In case construction, reconstruction, modification,

adaptation, conservation, maintenance, repair and demolition works are planned on the designated federal property, prior to

its realization, the Decentralized Public Body of the Secretariat of Education, Science, Technology and

Innovation of the State of Mexico, Colegio de Bachilleres del Estado de México, must apply to the

local and federal authorities, for the obtaining of licenses, permits, authorizations or any other similar

that is required, (specifically before the National Institute of Anthropology and History, as it is considered a

Historical Monument).

FOURTH. - The Decentralized Public Body of the Secretariat of Education, Science, Technology and

Innovation of the State of Mexico, Colegio de Bachilleres del Estado de México, must guard and supervise the

federal property, being obliged to cover the necessary expenses for its conservation and maintenance, and

other inherent services that, if any, are generated, as well as the corresponding insurance against

damage to the property, in accordance with what is provided in articles 32, fraction IV and 66 of the General Law of

National Assets.

FIFTH. -

The designation only grants the Decentralized Public Body of the Secretariat of

Education, Science, Technology and Innovation of the State of Mexico, Colegio de Bachilleres del Estado de

México, the right to use the designated federal property for the authorized use, but does not transfer the

ownership of it, nor grants any real right over it, in accordance with what is provided in article 70

of the General Law of National Assets.

SIXTH. -

The Institute of Administration and Appraisal of National Assets, through the Directorate

General of Administration of Federal Real Estate Assets within the scope of its attributes, will supervise the

strict compliance with this Agreement.

This Agreement will enter into force the day following its publication in the Official Gazette of the Federation.
