Agreement Designating the CADER Juchipila Federal Property to the Secretariat of Agriculture and Rural Development

AGREEMENT by which the Federal Property known as CADER Juchipila, with Federal Real Estate Registry 32-5570-6 with an area of 397.661 square meters, located at Calle Cardenal number 70, Reyna Elena Subdivision, Postal Code 99960, Municipality of Juchipila, State of Zacatecas, is designated to the Secretariat of Agriculture and Rural Development.

At the margin, a seal with the National Coat of Arms, which reads: United Mexican States.- FINANCE.- Secretariat of Finance and Public Credit.- Institute of Administration and Appraisal of National Assets.- DST-02/2024.

VÍCTOR JULIÁN MARTÍNEZ BOLAÑOS, President of the Institute of Administration and Appraisal of National Assets, a Decentralized Administrative Organ of the Secretariat of Finance and Public Credit, based on the provisions of articles 2, fraction I, 17, 26, 31, fractions XXIX and XXX of the Organic Law of the Federal Public Administration; 2, fractions II, IV, V, VI and VII, 3, fraction III, 4, paragraphs first and second, 6, fraction XXI, 11, fraction I, 13, 28, fractions I, III and VII, 29, fractions I and V, 61, 62, 66, 70 and 101, fraction V of the General Law of National Assets; 4, section G, fraction V, 48 and 49 of the Internal Regulations of the Secretariat of Finance and Public Credit; and 3, fractions VIII, IX and X, 4, fraction I, subsection a) and 6, fractions XXVI and XXXIII of the Regulations of the Institute of Administration and Appraisal of National Assets; deem it appropriate to issue this agreement, taking into account the following:

CONSIDERATIONS

FIRST. That among the assets subject to the public domain regime of the Federation, is the federal property known as "CADER Juchipila", with an area of 397.661 square meters and Federal Real Estate Registry 32-5570-6, located at Calle Cardenal number 70, Reyna Elena Subdivision, Postal Code 99960, Municipality of Juchipila, State of Zacatecas.

SECOND. That the ownership of the federal property described in the preceding Consideration is evidenced by public deed number 2450 dated August 5, 2016, granted by Licentiate Carlos Pinto Núñez, Public Notary number forty-three, of the City and State of Zacatecas, through which the formalization of the subdivision of plots and the formalization of the contract of free, pure and simple donation are recorded, by which the Honorable City Council of the Municipality of Juchipila, State of Zacatecas, donated to the Federal Government through the then Secretariat of Agriculture, Livestock, Rural Development, Fisheries and Food, which is registered in the Federal Public Property Registry under Folio Real number 150130 dated February 21, 2018.

THIRD. That topographic plan number 1 of 1 prepared at a scale of 1:100, approved and registered under number DRPCI/6515/32-5570-6/2019/T, on March 20, 2019 and certified on June 5, 2023, by the Directorate of Public Registry and Real Estate Control, records the area, measurements and boundaries resulting from the topographic survey of the property in question, with an area of 397.661 square meters, and an excess area of 7.087 square meters, which represent 1.814% compared to the property antecedent, which is within the tolerance permitted by the Institute of Administration and Appraisal of National Assets, derived from the different methods and measurement equipment.

FOURTH. That by letter number 158 dated March 2, 2022, the Director of Works and Public Services of the Honorable City Council of Juchipila, State of Zacatecas, issued a Certificate of Alignment and Official Number, in which it is recorded that the property subject to this Agreement is located at official number 70 of Calle Cardenal, in the Reyna Elena Subdivision, Municipality of Juchipila, State of Zacatecas.

FIFTH. That by letter number 348 dated April 27, 2022, the Director of Works and Public Services of the Honorable City Council of Juchipila, State of Zacatecas, issued a Certificate of Land Use, in which it determined that the property described in the First Consideration of this instrument is conditioned with land use type office, so it presents no incompatibility.

SIXTH. That by letter number 401.3S.17-2022/0984 dated May 27, 2022, the Director of the INAH Center Zacatecas, informed that the property subject to this instrument is not considered a historical monument, nor does it border other historical properties.

SEVENTH. That by letter number 512.-695-2022 dated October 6, 2022, the General Directorate of Material Resources, Properties and Services of the Secretariat of Agriculture and Rural Development, requested that the Administrative Agreement for the Destination of the federal property subject to this instrument be granted, to continue using it as offices for the "Rural Development Support Center Juchipila".

EIGHTH. That by letter number 512.01.-0394-2023 dated September 14, 2023, the General Directorate of Material Resources, Properties and Services of the Secretariat of Agriculture and Rural Development, reiterates the content of letter number 512.-695-2022 dated October 6, 2022, as well as the statement made by the Head of the Office of the Representation of the Secretariat of Agriculture and Rural Development in the State of Zacatecas, in which he states under oath of telling the truth, for the purposes of compliance with fraction V of article 62 of the General Law of National Assets, attending to the documentary antecedents of the file available, and to the statement on the Artistic Monumental quality and attending to its architectural composition, it is considered that it does not have the characteristics established in the Law of the Matter, to be considered an Artistic Monument; in accordance with what is established in criterion number 2/2011 of the Committee of Federal and Para-statal Real Estate Heritage, published in the Official Gazette of the Federation on January 19, 2012.

NINTH. That the General Directorate of Administration of Federal Real Estate Heritage of the Institute of Administration and Appraisal of National Assets, in accordance with what is provided for in article 11, fraction V, of the Regulations of this Institute, knew and reviewed from a technical-legal point of view, the operation that is authorized. The legal and technical documentation that supports the legal and administrative situation of the property, as well as of this Agreement, is in the procedural file integrated by said General Directorate and was duly integrated and compared with that which is in the Federal and Para-statal Real Estate Information System.

Likewise, and based on article 9, fraction XIV in relation to article 11, fraction V of the Regulations of this Institute, the Legal Unit issued an opinion regarding the procedency of this Agreement.

For the above and in accordance with the provisions established in articles 61, 62, 66 and 70 of the General Law of National Assets, and being the purpose of the Federal Executive the optimal use of the federal real estate heritage, prioritizing public institutions of the different levels of Government with federal properties for the provision of public services under their charge, I have deemed it appropriate to issue the following:

AGREEMENT

FIRST. The federal property known as "CADER Juchipila", located at Calle Cardenal, number 70, Reyna Elena Subdivision, Postal Code 99960, Municipality of Juchipila, State of Zacatecas, with Federal Real Estate Registry 32-5570-6 with an area of 397.661 square meters, is designated to the Secretariat of Agriculture and Rural Development, so that it continues to use it as offices for the "Rural Development Support Center Juchipila".

SECOND. If the Secretariat of Agriculture and Rural Development gives the federal property designated to it a use different from that established by this Agreement, without the prior authorization of the Secretariat of Finance and Public Credit, through the Institute of Administration and Appraisal of National Assets; or if it ceases to use it or needs it, said asset with all its improvements and accessions will be withdrawn from its service to be administered directly by this Institute, in accordance with what is provided in Article 68 of the General Law of National Assets.

THIRD. In the event that construction, reconstruction, modification, adaptation, conservation, maintenance, repair and demolition works are planned for the designated property, prior to their realization, the Secretariat of Agriculture and Rural Development must manage before local and federal authorities the obtaining of licenses, permits, authorizations or any other similar that is required.

FOURTH. The Secretariat of Agriculture and Rural Development must guard and supervise the property, being obliged to cover the necessary expenses for its conservation and maintenance, and other inherent services that may arise, as well as the corresponding insurance against damage to the property, in accordance with what is provided in articles 32, fraction IV and 66 of the General Law of National Assets.

FIFTH. The designation only confers upon the Secretariat of Agriculture and Rural Development the right to use the designated property for the authorized use, but does not transfer ownership of it, nor grants any real right over it, in accordance with what is provided in Article 70 of the General Law of National Assets.

SIXTH. The Institute of Administration and Appraisal of National Assets, within the scope of its attributes, will supervise the strict compliance with this Agreement.

This Agreement will enter into force the day after its publication in the Official Gazette of the Federation.
