AGREEMENT designating to the National Fund for Tourism Development (FONATUR), an entity of the Parastatal Public Administration, the federal real estate known as Club Deportivo de Acapulco (Centro Deportivo de Acapulco), with an area of 200,664.44 square meters, located at Calle Ejido Icacos (Polygon A) without number, Postal Code 39580, Municipality of Acapulco de Juárez, State of Guerrero, with Federal Real Estate Registry number 12-19549-7.

A seal bearing the National Emblem is placed at the margin, which reads: United Mexican States.- Treasury.- Ministry of

Treasury and Public Credit.- Institute of Administration and Appraisal of National Assets.- DST-007/2025.

AGREEMENT DESIGNATING TO THE NATIONAL FUND FOR TOURISM DEVELOPMENT (FONATUR), AN ENTITY OF THE PARASTATAL PUBLIC ADMINISTRATION, THE FEDERAL REAL ESTATE KNOWN AS

" CLUB DEPORTIVO DE ACAPULCO (CENTRO DEPORTIVO DE ACAPULCO) ", WITH AN AREA OF

200,664.44 SQUARE METERS, LOCATED AT CALLE EJIDO ICACOS (POLYGON A) WITHOUT NUMBER,

POSTAL CODE 39580, MUNICIPALITY OF ACAPULCO DE JUÁREZ, STATE OF GUERRERO, WITH

FEDERAL REAL ESTATE REGISTRY NUMBER 12-19549-7.

DR. PABLO ISRAEL ESCALONA ALMERAYA, President of the Institute of Administration and Appraisal of National Assets, a Decentralized Administrative Body of the Ministry of Treasury and Public Credit,

based on the provisions of articles 2 fraction I, 17, 26 fraction VI, 31 fractions XXIX and XXX of

the Organic Law of the Federal Public Administration; 2 fractions II, IV, V, VI and VII, 3 fraction III, 4, first paragraph, 6 fraction XXI, 11 fraction I, 13, 28 fractions I, III and VII, 29 fractions I and V, 61, 62, 66, 70 and 101

fraction V of the General Law of National Assets; 4, section G, fraction V, 48 and 49 of the Internal Regulations

of the Ministry of Treasury and Public Credit; and 3 fractions VIII, IX and X, 4 fraction I, subsection a) and 6 fractions

XXVI and XXXIII of the Regulations of the Institute of Administration and Appraisal of National Assets; I deem it appropriate to

issue this agreement, taking into account the following:

CONSIDERATIONS

FIRST.- That among the assets subject to the public domain regime of the Federation, is

the federal real estate known as " Club Deportivo de Acapulco (Centro Deportivo de Acapulco) ", with

an area of 200,664.44 square meters and Federal Real Estate Registry (RFI) number 12-19549-7, located

at Calle Ejido Icacos (Polygon A) without number, Postal Code 39580, Municipality of Acapulco de Juárez,

State of Guerrero.

SECOND.- That the ownership of the federal real estate described in the preceding consideration is accredited

through public deed number 1,566 dated May 15, 1945, granted before the notary of Licenciado

Manuel Andrade, Public Notary number 49 and of Treasury of the City of Mexico, in which the

gifted alienation carried out by Club Deportivo de Acapulco Sociedad Anónima, in favor of the

Federal Government, regarding the essential and necessary lands located in the place known as

" Icacos ", of the Municipality of Acapulco de Juárez, State of Guerrero, known as " Polygon A ", which include

the golf course, tennis courts, badminton courts and the club house, with an area of 27-54-44.00

hectares, which is registered in the Federal Property Registry under real folio 26077/6 dated

April 23, 2010.

THIRD.- That Topographic Plan number SC-326-2012, prepared at a scale of 1:1,500, approved and

registered under number DRPCI-4195-2012-T, dated July 30, 2012 and certified on February 6,

2025, by the Directorate of Public Registry and Real Estate Control, attached to the General Directorate of Policy and

Real Estate Management of the Institute of Administration and Appraisal of National Assets, records the area,

measurements and boundaries resulting from the topographic survey of the real estate subject to this Agreement,

for an area of 200,664.44 square meters.

FOURTH.- That through Land Use Certificate with office number 099/2025 dated February 19,

2025, the Directorate of Urban Development and Housing attached to the Ministry of Urban Development and

Public Works of the Constitutional City Council of Acapulco de Juárez, State of Guerrero, stated

that the authorized land use for the real estate subject to this Agreement is (HA) High Density Residential Zone.

FIFTH.- That through office number DG/DAF/0145/2025 dated March 31, 2025, the Director of

Administration and Finance and Real Estate Manager of the National Fund for Tourism Development

(FONATUR), an entity of the Parastatal Public Administration, requested the issuance of the Administrative Agreement

of Destination of the federal real estate subject to this Agreement, to use it as a public area for the

development of sports, tourism and leisure activities, as well as for its consolidation as a

business unit.

SIXTH.- That through Administrative Act dated April 22, 2025, the physical, legal, administrative and provisional delivery was recorded,

carried out by the Institute of Administration and Appraisal of National Assets,

a Decentralized Administrative Body of the Ministry of Treasury and Public Credit, in favor of the Fund

National for Tourism Development (FONATUR), an entity of the Parastatal Public Administration, regarding the

real estate subject to this Agreement, registered in the Federal Property Registry under Folio

Real number 26077/12 dated May 14, 2025.

SEVENTH.-

That through office number DA1116/D069 dated May 13, 2025, the Director of

Architecture and Conservation of Immovable Artistic Heritage of the National Institute of Fine Arts and

Literature, informed that the real estate subject to this Agreement, " ... does not have a Declaration of

Artistic Monument, published through Decree published in (sic) Official Journal of the Federation and also

is not considered within the National Catalog of Real Estate with Artistic Value of this Institute ... ".

EIGHTH.- That through office number 401.3S.1-2025/283 dated May 22, 2025, the Director of the

INAH Center in Guerrero of the National Institute of Anthropology and History, informed that, the real estate subject

to this Agreement, " ... is not contemplated as a Historical Monument, is not within the

context of any Historical Monument Zone; and there is no objection to giving the use that best suits it... ".

NINTH.- That the General Directorate of Administration of Federal Real Estate Assets of the Institute of

Administration and Appraisal of National Assets, in accordance with what is provided for in article 11 fraction V,

of the Regulations of this Institute, knew and reviewed from a technical legal point of view, the operation that is

authorized. The legal and technical documentation supporting the legal and administrative situation of the real estate, as well

as of this Agreement, is in the procedural file integrated by said General Directorate and was

properly compared with that which is in the Federal and Parastatal Real Estate Information System.

Likewise, based on article 9 fraction XIV in relation with article 11, fraction V of the

Regulations of the Institute, the Legal Unit issued an opinion regarding the present Agreement.

Therefore, and in accordance with the provisions established in articles 61, 62, 66 and 70 of the Law

General of National Assets, and being the purpose of the Federal Executive, the optimal use of the

federal real estate assets, prioritizing public institutions of different levels of Government

with federal real estate for the provision of public services under their charge, I have deemed it appropriate to issue the

following:

AGREEMENT

FIRST.- The federal real estate known as " Club Deportivo de Acapulco (Centro Deportivo de

Acapulco) ", located at Calle Ejido Icacos (Polygon A) without number, Postal Code 39580, Municipality of

Acapulco de Juárez, State of Guerrero, with Federal Real Estate Registry (RFI) number 12-19549-7 and

area of 200,664.44 square meters, is designated to the National Fund for Tourism Development (FONATUR), an entity

of the Parastatal Public Administration, to use it as a public area for the development of activities

sports, tourism and leisure, as well as for its consolidation as a business unit.

SECOND.- If the National Fund for Tourism Development (FONATUR), an entity of the Administration

Public Parastatal, gives the federal real estate designated to it a use different from that established by the present

Agreement, without prior authorization from the Ministry of Treasury and Public Credit, through the Institute of

Administration and Appraisal of National Assets; or if it ceases to use or need it, said asset with all

its improvements and accessions will be withdrawn from its service to be administered directly by this Institute, in

accordance with what is provided in article 68 of the General Law of National Assets.

THIRD.- In case construction, reconstruction, modification,

adaptation, conservation, maintenance, repair and demolition works are planned in the designated real estate, prior to its

realization, the National Fund for Tourism Development (FONATUR), an entity of the Administration Public

Parastatal, must manage before local and federal authorities, the obtaining of licenses, permits,

authorizations or any other similar that is required.

FOURTH.- The National Fund for Tourism Development (FONATUR), an entity of the Administration Public

Parastatal, must guard and supervise the real estate, being obliged to cover the necessary expenses for its

conservation and maintenance, and other inherent services that, if any, are generated, as well as the

corresponding insurance against damage to the real estate, in accordance with what is provided in articles

32 fraction IV and 66 of the General Law of National Assets.

FIFTH.- The designation only grants to the National Fund for Tourism Development (FONATUR), an entity

of the Parastatal Public Administration, the right to take advantage of the designated real estate for the use

authorized, but does not transfer ownership of it, nor grants any real right over it, in accordance

with what is provided in article 70 of the General Law of National Assets.

SIXTH.- The Institute of Administration and Appraisal of National Assets, within the scope of its powers,

through the General Directorate of Administration of Federal Real Estate Assets, will supervise the strict

compliance with this Agreement.

This Agreement will enter into force the day following its publication in the Official Journal of the Federation.
